RESOLUTION NO. 90-0048
A RESOLUTION BY AN AFFIRMATIVE VOTE OF 4/5THS
OF THE MEMBERS OF THE CITY COMMISSION WAIVING
FORMAL COMPETITIVE SEALED BID PROCEDURES FOR
CONSTRUCTION AND EQUIPMENT FOR THE LEGION
PARR POLICE MINI -STATION PROJECT; RATIFYING,
,APPROVING AND CONFIRMING THE CITY MANAGER'S
FINDING THAT AN EMERGENCY EXISTS JUSTIFYING
SUCH WAIVER FOR SAID PROJECT; AUTHORIZING THE
CITY MANAGER TO ACCEPT THE LOWEST RESPONSIVE
AND RESPONSIBLE BID FOR THE CONSTRUCTION OF
NECESSARY IMPROVEMENTS AND INSTALLATION OF
EQUIPMENT AT SAID FACILITY UNDER SAID
PROJECT; ALLOCATING FUNDS THEREFOR IN AN
AMOUNT NOT TO EXCEED $70,000 FROM THE CAPITAL
IMPROVEMENT PROJECT OF THE SAME NAME, PROJECT
NO. 312021; FURTHER AUTHORIZING THE CITY
MANAGER TO EXECUTE AND/OR ISSUE THE NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, WITH THE SUCCESSFUL BIDDER(S).
WHEREAS, the City Manager has made a written finding that
the construction of a police mini -station at Leqion Park
constitutes a valid public emergency which requires the immediate
procurement of construction services and equipment to protect the
health, safety and welfare of residents and for the convenience
of the City; and
WHEREAS, the nature of said emergency is based on the
community's need for additional police protection and greater
visibility of police presence in the northeast area of the City
of Miami beginning in the summer of 1990; and
WHEREAS, the City Commission initially recognized the need
for said project by its adoption of Motion No. 88-1119 on
November 17, 1988; and
WHEREAS, a preliminary design of the project has been
donated through the efforts of the Greater Biscayne Boulevard
Chamber of Commerce; and
WHEREAS, it is necessary to begin construction in
February 1990 in order to complete the work for the Summer 1990;
and
WHEREAS, said deadline does not allow sufficient time for
the formal advertising, receipt of bids, and award of contracts
which are normally required procedures; and

WHEREAS, Sections 18-52.5 and 18-52.5 of the City Code make
provision for the emergency procurement of required goods and
services for public work projects and improvements; and
WHEREAS, the City Manager and Director of the Department of
Police recommend that informal bid procedures be utilized to
procure the needed services, equipment and/or materials for said
project; and
WHEREAS, after receipt of informal bids, contracts for said
services, equipment and/or materials will be awarded to the
lowest responsive and responsible bidder(s) by the City Manager;
and
WHEREAS, Ordinance No. 10542, adopted September 28, 1989,
established the Legion Park Police Mini -Station within the
Capital Improvement Program, Project No. 312021, and appropriated
$70,000 for said Project; and
WHEREAS, the foregoing is being presented at a properly
advertised public hearing before the City Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby incorporated herein by
reference thereto and adopted as if fully set forth in this
Section.
Section 2. The City Manager's finding that a valid
public emergency exists justifying such waiver for said Project
is hereby ratified, approved and confirmed.
Section 3. By an affirmative vote of 4/5ths of the
Members of the City Commission, formal competitive sealed bid
procedures for the procurement of services, equipment and/or
materials for the construction of the "Legion Park Police
Mini Station Project" are hereby waived.
Section 4. The City Manager is hereby authorized to
accept the lowest responsive and responsible bid(s) for necessary

construction and/or equipment for said Project./
Section 5. An amount not to exceed $70,000 is hereby
allocated therefor from the "Legion Park Police Mini -Station
Project", Capital Improvement Project No. 312021.
Section 6. The City Manager is hereby authorized to
execute and/or issue the necessary documents a/, in a form
acceptable to the City Attorney, with the successful bidder(s)
for construction and/or equipment for said Project.
Section 7. This Resolution shall become effective
immediately upon its adoption.

The herein authorization is subject to the passage of a five
day period of time from the date that the City Commission is
notified of the City Manager's selection of the acceptable
bid during which period any individual Commissioner may
object to such selection, said objection to result in the
City Manager's placement of the item on the next scheduled
City Commission meeting.
2/ The herein authorization is further subject to compliance
with all requirements that may be imposed by the City
Attorney, including but not limited to those prescribed by
applicable City Charter and Code provisions.

The Departments of Police, Public Works and Parks, Recreation and
Public Facilities have prepared the attached legislation. At the
November 17, 1988 City Commission meeting, the City Commission
granted a request from the Greater Biscayne Boulevard Chamber of
Commerce to appropriate funds in the amount of $70,000 to build a
proposed police mini --station in Legion Park as a priority project.
In subsequent action on April.. 27, 1989 the City Commission also
approved floor plans for the station to be located in Legion Park.
In view of the recurring criminal activity problem on N.E. Biscayne
Boulevard and the community's urgent need for greater police
visibility in the area, it is recommended that a new mini -station be
in operation by the summer of 1990. On this basis the City Manager
has made a written finding (attached) that the construction of the
Legion Park Police Mini -Station Project constitutes an emergency
situation requiring particular action to protect the health, safety
and welfare of residents and the convenience of the City.
