RESOLUTION NO.
A RESOLUTION BY 4/8THS AFFIRMATIVE VOTE OF
THE MEMBERS OF THE CITY COMMISSION RATIFYING,
APPROVING AND CONFIRMING THE ACTIONS OF THE
CITY MANAGER IN FINDING THAT VALID PUBLIC
EMERGENCY EXISTED AND IN RESCINDING THE AWARD
TO E & L LAWN AND TREE SERVICE FOR THE
REMOVAL OF EIGHTEEN (18) FICUS TREES AND
RESETTING OF FOUR (4) FICUS TREES AT MELREESE
GOLF COURSE FOR THE DEPARTMENT OF PARKS,
RECREATION AND PUBLIC FACILITIES SINCE IT
COULD NOT PROVIDE THE SERVICES DUE TO
PERSONNEL PROBLEMS; FURTHER, IN HIS ACCEPTING
THE BID FROM JUELLE, INC. THE SECOND LOWEST
RESPONSIBLE AND RESPONSIVE BIDDER AT A TOTAL
PROPOSED COST NOT TO EXCEED $19,990.00, USING
FUNDS THEREFOR PREVIOUSLY ALLOCATED UNDER
RESOLUTION NO. 89-608, ADOPTED JULY 13, 1989,1/
FROM THE 1988-89, OPERATING BUDGET; ACCOUNT
CODE NO. 580202-340; AUTHORIZING THE CITY
MANAGER TO INSTRUCT THE CHIEF PROCUREMENT
OFFICER TO ISSUE A PURCHASE ORDER FOR THIS
SERVICE.
WHEREAS, pursuant to public notice, sealed bids were
received May 18, 1989 and a contract was duly awarded July 13,
1989 by Resolution No. 89-608 for the removal of eighteen (18)
and resetting of four (4) fious trees at the Melreese Golf Course
for the Department of Parks, Recreation and Public Facilities;
and
WHEREAS, E & L Lawn and Tree Service, the lowest bidder, was
awarded the contract and was not able to provide the servioe due
to personnel problems; and
WHEREAS, funds for this service were allocated previously by
Resolution No. 89-608 from the 1988-89 Parks, Recreation and
Public Facilities/Golf Course Division Operating Budget, A000unt
Code No. 580202-340; and
WHEREAS, the City Manager's finding that a valid public
emergency existed and his reoision of the award to E & L Lawn and

Tree Service and his award of the contract to Juelle, Inc . , the
second lowest bidder, in the amount of $19,900.00 are hereby
ratified, approved and confirmed;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By an affirmative vote of 4/5ths of the
members of the City Commission, the actions of the City Manager
in finding that a valid public emergency existed and in
rescinding the award to 8 9 L Tree Service, under Resolution No.
89-608 , adopted July 13, 1989 ,1 /for the removal of eighteen (18 )
and the resetting of four (4) fious trees at the Helreese Golf
Course for the Department of Parks, Recreation and Public
Facilities since it could not provide this service due to
personnel problems and in awarding the contract to Juelle, Inc.,
the second lowest bidder, at a total proposed cost not to exceed
$19,900.00, using funds therefor previously allocated under
Resolution No. 89-608, adopted July 13, 1989, from the Parks,
Recreation and Publio Facilities Department/Golf Course Division
1988-89 Operating Budget, Account Code No. 580202-340, are hereby
ratified, approved and confirmed.
Section 3. The City Manager is hereby authorized to
instruct the Chief Procurement Officer to issue a Purchase Order
for this service.
Section 4. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission ratify
the action of the City Manager in declaring a valid public
emergency in authorizing the rescinding award of a contract for
the removal of (18) Ficus Trees and the resetting of (4) Ficus
Trees at Melreese Golf Course to E & L Lawn and Tree,Serv. and
authorizing the award to Juelle, Inc., the second lowest bidder,
and a minority female/owned firm.
BACKGROUND:
The Department of Parks, Recreation and Public Facilities has
worked with the Procurement office to prepare this legislative
item. The contract for removal of the trees was awarded
originally under Resolution No. 89-608 (adopted July 13, 1989).
The lowest bidder was notified of the award. E & L Lawn and
Tree, Serv. notified the Department of Parks, Recreation and
Public Facilities by phone and in writing to procurement
management that their company was not able to provide the
services due to personnel problems.
Therefore it was necessary to rescind the award of the removal of
_ the tree for the Melreese Golf Course. The service contract for
the Golf Course is now recommended for award to the second lowest
responsible and responsive bidder for the increased amount of
$1,750.00 for a new total proposed amount of $19,990.00. Funds
for this service were available in the 1988-89 budget of the
Parks, Recreation and Public Facilities/Golf Courses Division
Operating Budget and were carried over to the Budget for Fiscal
Year 1989-90.

The Department of Parks, Recreation and Public Facilities is
requesting that a valid Public Emergency be declared in
rescinding award of a contract for removal of eighteen (10) Ficus
Trees and the resetting of four (4) Ficus Trees at Melreese Golf
Course and authorizing award to the second lowest bidder.
The second lowest responsible and responsive bidder
in
accordance
with Bid No. 88-89-105 is Juelle, Inc., a
female -owned
firm. The
Juelle, Inc. bid is $19,990,00,

The previous Did was awarded to E. & L. Lawn and Tree Services,
Inc., untler Resolution No. 99-608 (adopted July 13, 1989). L. L.
Lawn and Tree Services, Inc. has nolA(ied the Departments of
Parks, Recreation and Public Facilities and GSA, Procurement
Management, that they will be unable to fulfill the contract due
to a shortage of personnel in the company.

as the
trees are dead and
falling as
golfers are playing.
Also,

Inc. is willing to
