AFFIRMING THE DECISION OF THE ZONING BOARD
AND GRANTING A SPECIAL EXCEPTION FROM
ORDINANCE NO. 9500, AS AMENDED, THE ZONING
ORDINANCE OF THE CITY OF MIAMI, FLORIDA,
ARTICLE' 20, SECTION 2018, SUBSECTION
2018.2.1, FOR THE CONSTRUCTION OF A SURFACE
PARKING LOT FOR THE PARKING OF PRIVATE
PASSENGER VEHICLES ONLY, AS EXCESS (NOT
REQUIRED) PARKING, AS PER PLANS ON FILE, FOR
THE PROPOSED RESTAURANT LOCATED AT 2340
SOUTHWEST 32 AVENUE, MIAMI, FLORIDA, FOR THE
PROPERTY LOCATED AT 3224 SOUTHWEST 23 STREET,

THIS SPECIAL EXCEPTION HAS A TIME LIMITATION
OF TWELVE MONTHS IN WHICH A BUILDING PERMIT
MUST BE OBTAINED", BY DECLARING THAT ANY
ADDITION TO THE EXISTING STRUCTURE WHICH
WOULD REQUIRE PARKING SPACES IN EXCESS OF
THOSE APPROVED PURSUANT TO THIS SPECIAL
EXCEPTION SHALL BE SUBJECT TO REVIEW OF A
PARKING PLAN AND APPROVAL BY THE CITY
COMMISSION.
WHEREAS, on September 28, 1989, the City Commission adopted
Resolution No. 89-865 affirming the decision of the Zoning Board
and granting a special exception from Ordinance No. 9500, as
amended, the Zoning Ordinance of the City of Miami, Florida,
Article 20, Section 2018? Subsection 2018.2.1, to allow the
construction of a surface parking lot for the parking of private
passenger vehicles only as excess (not required) parking on the
site, as per' plans on file, for the proposed restaurant at
2340 Southwest 32 Avenue, Miami, Florida, for the property
located at 3224 Southwest 23 Street, Miami, Florida and
approximately 3221 Southwest 23 Terrace, Miami, Florida, also

described as Lots 4 and 38, Black 9, MIAMI SUBURBAN ACRES, AMD.
(4-73) of the Public Records of Dade County, Florida; zoned
RG 1/3 General Residential (One and Two Family), subject to
certain conditions; and
WHEREAS, the City Commission wishes to clarify its intent by
declaring that any addition to the existing structure which would
require parking spaces in excess of those approved pursuant to
this special exception shall be subject to review of a parking
plan and approval by the City Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Resolution No. 89-865 adopted September 28, 1989
entitled "a Resolution affirming the decision of the Zoning Board
and granting a special exception from Ordinance No. 9500, as
amended, the Zoning Ordinance of the City of Miami, Florida,
Article 20, Section 2018, Subsection 2018.2.1, for the
construction of a surface parking lot for the parking of private
passenger vehicles only, as excess (not required) parking, as per
plans on file, for the proposed restaurant located at 2340
Southwest 32 Avenue, Miami, Florida, for the property located at
3224 Southwest 23 Street, Miami, Florida and approximately 3221
Southwest 23 Terrace, Miami, Florida, (more particularly
described herein); zoned RG-1/3 General Residential (one and two
family), and subject to review by the City Commission of any
future modification of plans that would increase the size of the
building located at 2340 Southwest 32 Avenue, Miami, Florida, to
more than 11,000 square feet, or of any future change that would
= impact the number of parking spaces or the parking lots located
at 3224 Southwest 23 Street and approximately 3221 Southwest 23
Terrace, Miami, Florida. This special exception has a time
limitation of twelve months in which a building permit must be

ENCLOSURES.
Per direction of the City Commission on July 13, 1989 and per Section 3201;
Zoning Ordinance 9500, and Section 62-62(b) of the City Code, the Planning
Department requests a review by the City Commission of the Zoning Board's
grant of special exception on July 10, 1989, to use two transitional lots for
off-street parking by Victor's Cafe, formerly - the site of the Studio
Restaurant, at 2340 S.W. 32nd Avenue.
By memorandum of March 17, 1989 (attached) the Zoning Administrator issued an
opinion allowing the continuation of a non -conforming use and structure at
this location, finding that demolition of the roof; 109 lineal feet of wall on
the north, west and south sides and relocation of the east wall did not
further the non -conformity of the structure or use.
Due to the approval of continued nun -conformity, the restaurant does not have
to meet the off-street parking requirements in the Zoning Ordinance (60 spaces
otherwise required) but only has to supply the number of spaces which were
formerly on -site 33 spaces on -site). Thereafter, on July 10, 1989, the
Zoning Board granted a special exception to allow use of two transitional lots
to the west of the restaurants for excess parking for the restaurant (31
additional spaces).
The Planning Departments' main contention is that all the parking to be
provided, including the parking on the transitional lots, should be defined as
parking (64 spaces, including on -site and transitional). Otherwise,
the restaurant will have on open invitation to expand the structure e.g., by
adding a banquet hail, while providing no additional parking, which will*have
a consequent negative impact on the neighborhood.
Secondly, the Planning Department continues to recommend a 10 foot buffer
between the residential area to the west and the parking lot rather than the 5
feet that is being proposed by the applicant.

opinion, from Joseph A. Genuardi, Zoning Administrator, in,
reference to proposed alterations and partial demolition of the
old Studio Restaurant building and site for a new Victorfs
Restaurant.
Mr. Genuardi discussed this with Miriam Maer,_ Assistant City
Attorney, last week and she indicated that jshe had no problems
with the opinion.

Following is my opinion on the continuation of nonconformities of a structure
and on -site parking at 2340 S.W. 32 Avenua.
1. The existing building which has been used as a restaurant
and which after alteration by new owners will be used as a
restaurAnt, is a permitted use under the CR•-fit7 zoning
classification. The' existing floor area together. tiiith
proposed additions will be below -the maximum floor area
permitted.
2.
Only a portion of the existing structure .is nonconforming
because it does not meet the required setbacks. Z4r13
includes the wall along S.We 32 Avenue, the gall along S.W.
23 Terrace and a portion of the wall Along the west side of
the property.
3.
It has been proposed to.complptely remodel. the interior -of
the building and replace the roof because of - its condition
dine to age and to change its appearance consistent with the
new ownership., This work does not affect the nonconformity
of the structure.
4.
During the removal of the roof and interior partition under
a demolition 'permit, approximately 42 L.F. of, wall at.the
west side of the ` building had to be removed because of the
poor condition. This portion is conforming and will be.
replaced at the same location and. therwfore does not affeet
the nonconformity of the structure.
5.
'In order to construct two small additions, approximately 35

In all cases described abovethe new wall will be. in
= conformity or will decrease the degree of nonconformity.
s The only 'nonconforming portion being replaced is due -to
public _taking. Therefore, it is my .opinion• that the
= building may be reconstructed as proposed.
s 8. The existing on -site parking does not meet the present City
of Miami Zoning Ordinance requirements. Therefore, it is a
- nonconforming chameter13tiC. of use. Section 2107:
— Nonconforming characteristic of use. does not contain a
- discontinuance section. Further, Section 210T•1 permits
changes which result in the same or lesser degree of noncon-
formity. It is proposed that the existing parking area be
— modified to provide addition parking spaces .for the

_ additions and also resulting in more spaces for the existing
= use.
_ The existing parking area also does not meet; the
- requirements of the City of Miami Guides and Standards;
_ however, Section 2017.4 permits modifications which lessen
-_. the degree of nonconformity .as much as is reasonably
= feasible in the circumstances of the case.

The proposed modification will provide all spaces meeting
- minim = size and required Aisles and will include more
landscaping than is existing. It is therefore my opinion
-- that the nonconforming parking area as ` modified is
permitted.

During the Agenda review for the July 10, 1989 Zoning Board
meeting, a question was raised as to the requirements along the
lot lines adjacent to RG-1/3 zoned lots.
Section 2018.2.1(c) of the Zoning Ordinance 9500 states that a
yard equivalent in width to the required side yard shall be
provided along any edge* not adjacent to a street.
The schedule of District Regulations under minimum space
requirements for an 19G-1/3 zoning district requires a minimum of
5 ft. or a total of 15 ft for the two side yards of the lot.
Lot 38 of the proposal is adjacent to a CR-3 zoned district on
the one side and a RG-1/3 on the other side. The CR-3'district
does not require a side yard and therefore the minimum of a five
(5) ft wide side yard is required on the side adjacent to the RG-
1/3 lot.
Lot 4 is adjacent to an RG-1/3 lot on both sides. However, lot
3, which is 50 ft wide, on the east side is being utilized as a
transitional parking Lot under a prior approval. The present
application extends this parking facility to the maximum 100 ft
allowed. If this had been submitted together as one '100 ft lot,
no yard would be required between lot 4 and lot Therefore,
the only side yard requirement is on the W.S. of lot 4 for a
minimum of five (5) ft.
Section 2005.7 Yard, defined; describes a yard as an open space
unoccupied and unobstructed- by any structure forty-two (42)
inches or greater. The ordinance does not restrict parking in a
yard except as required by the City of Miami Parking Guides and
Standards on page 1.8 which requires a minimum of three (3) ft of
landscaping along a lot line and on page 1.10 for street frontage
yards for special exception parking facilities'
In this case we have required five (5) ft of landscaping along
the lot line as has been required for similar cases over the
years.

It is therefore my opinion that the plans submitted for, special
exception parking facility are in compliance with minimum zoning
requirements.

special permits shall be referred to the director of the Department of Plating for his -
