HomeMy WebLinkAboutR-90-0091J-90-89 1/16/90 RESOLUTION NO.90-0091 A RESOLUTION AUTHORIZING FUNDING, NOT TO EXCEED $10.000, FROM THE CITY OF MIAMI LAW ENFORCEMENT TRUST FUND, TO COVER THE NECESSARY EXPENSES INCURRED BY THE COMBAT AUTO THEFT PROGRAM, UPON SUCH COSTS HAVING BEEN APPROVED BY THE CHIEF OF POLICE. WHEREAS, Florida State Statute 932.704(3)(a), as amended, authorizes the expenditure of forfeiture proceeds for law enforcement programs not considered normal operating expenses; and WHEREAS, the City of Miami, along with the rest of the nation has experienced an increase in auto thefts; and WHEREAS, this program would assist officers in identifying stolen vehicles and would deter thefts of registered vehicles; and WHEREAS, the Chief of Police has recommended adoption of this resolution and has determined that the expenditures proposed comply with Florida State Statute 932.704, as amended: and WHEREAS, funds to cover these necessary expenses have not been included in the Police Department's normal operating budget; and WHEREAS, funds to cover the necessary expenses required for this program are available in the City of Miami Law Enforcement Trust Fund; NOW, THEREFORE, BE IT RESOLVED BY THE, COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. It is respectfully recommended that a Resolution allocating funds for the "Combat Auto Theft" Program (C.A.T.), at a cost of $10,000, be approved. The Miami Police Department, along with the rest of the nation,. has experienced an increased number of auto thefts during the last year. The C.A.T. Program is designed to help prevent auto theft by registering the hours that a vehicle is not normally operated with the Community- Relations Unit of the Police Department. A decal is then affixed to the vehicle designating those hours. An officer spotting the decal has prior authorization from the owner to stop the vehicle. Based on this stop the officer can determine whether the vehicle has in fact been stolen. If the vehicle was stolen, the officer will articulate. the presence of the decal and its significance in his report in order to establish probable cause. It is, therefore, recommended that the Resolution authorizing the establishment of the "Combat Auto Theft" Program, and allocating funds therefor in the amount of $10,000, funding to be provided from the Law Enforcement Trust Fund, Project No. 690001, Index Code 290904-996, be approved.
