WHEREAS, the Miami Zoning Board at its meeting of January 8r 1990, Item No. 5, adopted Resolution ZB 5-90 by a nine to zero vote (9-0), granted a special exception as hereinafter set forth; and WHEREAS, a neighbor has taken an appeal to the City Commission from the Zoning Board's decision; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to affirm the decision of the Zoning Board; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. RECOMMENDATIONS PLANNING DEPARTMENT DENIAL AS REQUESTED, APPROVAL SUBJECT TO: A 6' MINIMUM HEIGHT CONCRETE WALL STUCCOED AND PAINTED ON BOTH SIDES SURROUNDING THE ENTIRE PERIMETER OF THE SUBJECT PROPERTY; AND A RESUBMITTAL OF THE LANDSCAPE PLAN SHOWING THE REPLACEMENT OF THE PROPOSED 10' TO 12' OAK OR MAHOGANY TREES BY 14' MINIMUM HEIGHT TREES. The subject request meets the density limitation of the Miami Comprehensive Plan 1989-2000 maximum density of 18 units per net acre. The size of the lot is 50' X 200' or .229 acres. The project should be improved by proposing a six foot (6') concrete wall to provide privacy to the proposed units and to buffer the adjacent low density residential area, said wall to be stuccoed, painted and maintained by the applicant on both sides. There is a proposal for four (4) units, there are two (2) offstreet parking spaces provided for each unit, for a total of eight (8). The trees that will be allowed to be removed are a 22" diameter mango, a 4" diameter date palm, and 5" diameter spruce.
