RESOLUTION NO. 90" 013E
A RESOLUTION REAFFIRMING THE CITY OF MIAMI'S
COMMITMENT TO HISTORIC PRESERVATION IN THE
CITY AS SET FORTH IN ARTICLE 16 OF THE CITY
OF MIAMI ZONING ORDINANCE BY OFFICIALLY
DECLARING THAT OWNER CONSENT WILL NOT BE A
CRITERION FOR THE DETERMINATION OF HISTORIC
DESIGNATIONS.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Seotion 1. The City of Miami's oommitment to historio
preservation in the City as set forth in Artiole 16 of the City
of Miami Zoning Ordinanoe is hereby reaffirmed by this offioial
declaration that owner oonsent will not be a oriterion for the
determination of historio designations.
Seotion 2. This Resolution shall beoome effeotive
immediately upon its adoption.

As you are aware the City of Miami received notice from
Metropolitan Dade County of its intention to file suit against
the City for the City's alleged policy of allowing property
owners to veto the historic preservation designation of their
propartiea.
Accordingly, as required by Section 164.103, Florida
Statutes the City must hold a public meeting to discuss the
proposed litigation in an effort to amicably settle the
controversy. This meeting must be held at the Pebruary 15, 1990
City Commission meet inch to comply with the statutory
requ-irementis.
In view of the requirements, please schedule •tho following
as a discuosion items
