HomeMy WebLinkAboutO-10712J-89-1099 2/15/90 ORDINANCE NO. 01 1?, AN ORDINANCE AMENDING ORDINANCE NO. 9500, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, BY AMENDING PAGE 4 OF THE OFFICIAL SCHEDULE OF DISTRICT REGULATIONS, BY INSERTING A NEW CR-3 COMMERCIAL - RESIDENTIAL (GENERAL) TITLE AND PROVIDING THAT THE SALE OF USED CARS IS PERMISSIBLE BY SPECIAL EXCEPTION SUBJECT TO A LIMITATION; AND PROVIDING AN APPROPRIATE EXCEPTION FOR SECONDHAND MERCHANDISING UNDER PRINCIPAL USES AND STRUCTURES, CR-3 COMMERCIAL RESIDENTIAL (GENERAL); CONTAINING A REPEALER PROVISION, SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of November 1, 1989, Item No. 2, following an advertised hearing adopted Resolution No. PAB 60-89 by a vote of 6 to 1, RECOMMENDING APPROVAL of amending Ordinance No. 9500, as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 9500, as hereinafter set forth: NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Page 4 of the Official Schedule of District Regulations, made a part of Ordinance No. 9500, the Zoning Ordinance of the City of Miami, Florida, as amended, is herein amended as follows:/ "USES AND STRUCTURES PRINCIPAL USES AND STRUCTURES 1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. 0U"I2 CR-3 COMMERCIAL -RESIDENTIAL (GENERAL) As For CR-2, except as provided below, and in addition: Permitted Generally 3. Retail establishments for sales of new automobiles, motorcycles and/or parts, equipment and accessories; for sale of new boats, marine motors, parts, equipment and accessories; for sale of pets and pet supplies; plant nurseries; building supply stores. Aside from plant nurseries and one accessory waiver (described in the next column, all commercial sales, display and service activities shall be within fully enclosed buildings. Aside from antique shops, art shops, jewelry and book stores, used cars as an accessory use and stores renting formal attire and hospital equipment, no such retail establishment shall deal in secondhand merchandise. ACCESSORY USES AND STRUCTURES CR. Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. - 2 - 01071 0 Section 4. Consideration of amending Ordinance 9500, as amenced, the Zoning Ordinance of the City of Miami, Official Schedule of District Regulations, p 4 of 6, under Accessory Uses and Structures, by inserting a new CR-3 Commercial - Residential (General) title and providing that the sale of used cars is permissible by special exception subject to a limitation of 30 percent of the building frontage on a block and providing for interim outside display and sales; and providing an appropriate exception for interim outdoor display and sales and for secondhand merchandise under Principal Uses and Structures, CR-3 Commercial Residential (General). REOUEST To make the sale of used cars, accessory to the sale of new cars, permissible by soeciai exception with conditions in the CR-3 zonino districts. RECOMMENDATIONS PLANNING DEPARTMENT Approval. ANAIYFIS Automobile dealer showrooms in the CR-3 districts on Biscayne Boulevard and S.W. 8th Street are now restricted to the sale of new cars. The cost of both new and used cars has increased dramatically. While the difference in cost of both new and used cars, particularly for luxury models, may represent thousands of dollars it only represents 10-20% on a percentage basis. Luxury auto dealers have comoiained that they are precluded from showing these expensive used cars in their showrooms. In this amendment the Department has some concern about the age of the used cars but is 010712 PAB 11/1/89 Item #2 _ Page 1 of 2 I fp" , satisfied that economic concerns (enclosed showroom costs) will dictate. The Department was also concerned about the potential introduction of open used cars lots on Biscayne Boulevard and S.W. 8th Street which could potentially detract from the mercnandising image. This amendment will assure that: a public hearing on a special exce�on will be held before the Zoning Boara on location and conditions. sales of used cars will be accessory to sales of new cars. - sales of used cars will be encloseg and only occupy a maximum of 30 of the street frontaae of the block. as an exception, the zoning boara, in attaching conditions, will only be able to waive the enclosed space requirement for a maximum of two years. RECOMMENDATIONS PLANNING ADVISORY BOARD At its meeting of November 1, 1989, the Planning Advisory Board adopted Resolution PAB 60-89 by a vote of 6 to 1, recommending approval of the aoove. CITY COMMISSION At its meeting of December 14, 1989, the City Commission continued the above to its meetina of January 25, 1990.
