AN ORDINANCE, WITH ATTACHMENT, AMENDING THE
SCHEDULE OF DISTRICT REGULATIONS OF ORDINANCE
NO. 9500, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED, BY CHANGING THE
UNIT DENSITY CAP UP TO 40 UNITS PER NET ACRE
AND DELETING STORIES ON PAGE 21 RG-2, GENERAL
RESIDENTIAL; BY ADDING A NEW ZONING DISTRICT
CLASSIFICATION OF "CON. CONSERVATION" ON
PAGE 6 TO BE RESERVED FOR ENVIRONMENTALLY
SENSITIVE AREAS; AND BY AMENDING THE ZONING
ATLAS OF ORDINANCE NO. 9500, THE ZONING
ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, BY CHANGING ZONING CLASSIFICATIONS
WHICH AFFECT APPROXIMATELY FIFTEEN PERCENT OF
THE TOTAL LAND AREA OF THE CITY, IN ORDER TO
BRING SAID ORDINANCE INTO COMPLIANCE WITH THE
MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN
1989-2000, PURSUANT TO SECTION 163.3202(1),
FLORIDA STATUTES, (1987), SAID CHANGES BEING
MORE PARTICULARLY DESCRIBED HEREIN; BY MAKING
FINDINGS; AND BY MAKING ALL THE NECESSARY
CHANGES TO AFFECTED PAGES OF SAID ZONING
ATLAS; CONTAINING A REPEALER PROVISION,
SEVERABILITY CLAUSE AND AN EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of. July 26, 1989, Item No. 2, following an advertised hearing
adopted Resolution No. PAB 35-89, by a 5 to 0 vote, RECOMMENDING
APPROVAL of a change of zoning classification, as hereinafter set
forth; and
WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Page 2 of the Official Schedule of District
Regulations, made a part of Zoning Ordinance 9500, the Zoning
Ordinance of the City of Miami, Florida, as amended, are hereby
amended as follows:1
1 Words and/or figures stricken through shall be deleted.
Underscored words and/or figures shall be added. The
remaining provisions are not in effect and remain unchanged.

"DISTRICTS
RG-2. GENERAL RESIDENTIAL
This district designation is intended to apply in areas
suitable for general residential development, including
attached one - and two-family dwellings and multiple
dwellings. Land use intensity sectors predominantly
applicable within such districts include 3 divisions.

I have determined that a scrivener's error was made
pertaining to the map (last page) of Ordinance 10710 adopted
February 15, 1990, which portrays a series of zoning atlas
amendments to Zoning Ordinance 9500.
I have been persuaded by the Planning Department, and based
on my own perception after review, that the map presently
attached to the subject ordinance is incorrect. Your office was
not supplied an updated version as the hearings progressed.
Consequently, please substitute the attached map in lieu of the
map currently attached to the ordinance to accurately reflect the
City Commission's final actions.
The attached map is identical to the published notice and
presentation material used for first and second readiPS�u
(December, 1989, and teary 15, 1990) .

(1) year after submission of its revised
comprehensive plan for review pursuant to
Section 163.3167(2) F.S., each municipality in
this state shall adopt or amend and enforce land

These amendments will bring Ordinance 9500, the
Zoning Ordinance of the City of Miami, in
compliance.

Please be advised that this Office is of the opinion that
the items listed below have notice problems which would render
them voidable if the City Commission were to act on them at the
subject meeting:
(a) PZ-2: This item's published title is incorrect. It
states that the applicant's request is for an amendment of the
comprehensive plan to a non-existent "residential -commercial"
v designation. Because this specific problem is not correctable on
the floor, it must be readvertised.
(b) PZ-3: This is a companion item to PZ-2 and should not
be heard until the City Commission acts upon the comprehensive
plan amendment requested in PZo2
(c) The map required by Florida Statutes to be published in
conjunction with zoning atlas changes of this magnitude was
deficient. It was reduced by the Miami Herald to a size which
made it illegible. Thus, it did not place the public on notice
as to the nature of the proposed changes.
(d) PZ-14: The Planning Advisory Board has not rendered a
recommendation of this item. Hence, it cannot be taken -up by the
City Commission while the Planning Advisory Board still has sole
jurisdiction. The City Commission can discuss the matter, but it
cannot take formal action adopting any portions of the proposed
new zoning ordinance on September 28th.
Additionally, regular Item No. 1 was not advertised in time
to satisfy City Code requirements. It could be addressed as an

emergency item. Should the City Commission desire to address
this item on an emergency basis, an ordinance has been prepared

The first provision states that the State Fire Marshall
shall promulgate rules and regulations for the establishment
of "uniform firesafety standards for .'.. mobile.home parks
..., of which standards the State Fire Marshall: shall be
the final administrative interpreting authority." Subsection
(d) of this provision states that these rules and regulations
shall be enforced in such a manner "as to prohibit the
displacement of currently placed mobile homes unlessere
Is" a threat of iiiiiriirient danger to the health, safety -pr
�selfare of the general'-public." This subsection also
• requires that consideration be given to the social and
economic inconveniences which may be caused by the rules
promulgated by the State Fire Marshall regarding mobile
homes.

The second provision expressly preempts'; to the state
all regulation and control of mobile home lot rents in mobile
home parks. and "all those other matters and things relating
to the landlord -tenant relationship treated by 'or falling
-within the purview of"' (emphasis supplied) Chapter 720,
Florida Statutes. All units of local government are
_expressly prohibited from taking any a.c.tion .including
enactment of rules, regulations or ordinances, with"respect
t&the matters preemptddtb the state.
