HomeMy WebLinkAboutO-10709a--90-39 1/24/90 ORDINANCE NO. 010709 AN ORDINANCE AMENDING THE ZONING ATLAS OF ORDINANCE NO. 9500, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, BY CHANGING THE ZONING CLASSIFICATION OF THE PROPERTY GENERALLY BOUNDED BY S.W. SECOND AVENUE ON THE EAST, THE MIAMI RIVER ON THE SOUTH, 1-95 RIGHT-OF-WAY ON THE WEST AND S.W. SECOND STREET ON THE NORTH (MORE PARTICULARLY DESCRIBED HEREIN), FROM WF-1/7 WATERFRONT INDUSTRIAL AND CG-1/7 COMMERCIAL GENERAL TO SPI-21 RIVER QUADRANT MIXED USE DISTRICT; MAKING FINDINGS; BY MAKING ALL NECESSARY CHANGES ON PAGE 36 OF SAID ZONING ATLAS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of January 17, 1990, Item No. 2, following an advertised hearing adopted Resolution No. PAB 7-90, by a 8 to 0 vote, RECOMMENDING APPROVAL of a change of zoning classification, as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Zoning Atlas of Ordinance No. 9500, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by changing the zoning classification from WF-1/7 Waterfront Industrial and CG-1/7 Commercial General to SPI-21 River Quadrant Mixed Used District for the property generally bounded by S.W. 2nd Avenue on the east, 1-95 right-of-way on the west, the Miami River on the south and S.W. 2nd Street on the north, more particularly described as: All of Lots 1, 2, 19-22 and parts of Lots 3, 4 and 18, of Block 140 N. ; All of Lots 1-3 and parts of Lots 4, 5, 6, 11, and 12, of Block 141 N. ; All of Lots 1 and 2, 010709 plus unpeatted area and vaoated right-of-way along Miami River of Block 142 N., MIAMI NORTH (JULIA D. TUTTLE, ET AL.), as recorded in Plat Book A, at Page 54, of the Public Records of Dade County, Florida; Parts of Lots 3 and 4, EAST RIVERSIDE, as recorded in Plat Book 28, at Page 43, of the Public Records of Dade County, Florida.1/ Section 2. It is hereby found that this zoning classification change: a. Is in conformity with the adopted Miami Comprehensive Neighborhood Plan; b. Is not contrary to the established land use pattern; c. Will not create an isolated district unrelated to adjacent and nearby districts; d. Is not out of scale with the needs of the neighborhood or the City; e. Will not materially alter the population density pattern or increase or overtax the load on public facilities such as schools, utilities, streets, etc.; f. Is necessary due to changed or changing conditions; g. Will not adversely influence living conditions in the neighborhood; h. Will not create or excessively increase traffic congestion or otherwise affect public safety; i. Will not create a drainage problem; J. Will not seriously reduce light and air to adjacent area; k. Will not adversely affect property values in the adjacent area; 1. Will not be a deterrent to the improvement or development of adjacent property in accord with —_ exists ng regulations ; Area south of S.W. 3rd Street is included in the final but unrecorded plat: Tracts "A" and "B "ALANDCO SECTION ONE", said area includes vested rights -of -way. M. Will not constitute a grant of special privilege to an individual owner as contrasted with protection of the public welfare. Section 3. Page No. 36 of the Zoning Atlas, made a part of Ordinance No. 9500 by ref erenoe and description in Article 3, Section 300 of said Ordinance, is hereby amended to ref leot the ohange,made necessary by this amendment. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. Approval. 010709 PAB 1/17/90 Item #2 Page 1 of 2 BACKGROUND The entire River Quadrant area bounded by Miami Avenue, the Miami River, I-95 and S.W. 2nd Street has been the subject of discussion for more intensive zoning and development for the past 10 years. The Planning Department has long supported more intense zoning, the Commission has approved the Downtown Miami Master Plan, which recommended increasing the Floor Area Ratio (FAR) allowed to 6; the principal impediments to development have been a) the Central FPL electrical substation in the middle of the area and b) the diverging views of the property owners. This proposal is based on the cooperation and consent of Alandco, a subsidiar of FPL, and their property (with one exception west of S.W. 2nd Avenue and south of S.W. 2nd Street. ANALYSIS This mixed use district, if applied to this area, will allowed mid -intensity mixed uses which are less than the CBD, but are comparable to other middle -intensity districts such as Omni SPI-6, Brickeli SPI-5 and Central Brickell SPI-7, which surround the CBD and provide a transitional stage from the high -intensity multiple use CBD to the low intensity discrete commercial -or -residential zoning districts beyond.
