HomeMy WebLinkAboutO-10707a-90-49 1/3/90 ORDINANCE NO. 010707 AN ORDINANCE AMENDING THE ENVIRONMENTAL PRESERVATION DISTRICTS AND SCENIC TRANSPORTATION CORRIDORS ATLAS OF THE CITY OF MIAMI, FLORIDA, BY DESIGNATING, GENERALLY, ALL PUBLIC RIGHTS -OF -WAY IN THE AREA FROM SOUTHWEST 1ST AVENUE TO SOUTHWEST 8TH AVENUE BETWEEN SOUTHWEST 23RD ROAD AND SOUTHWEST 27TH ROAD (A.K.A. "THE BRICKELL HAMMOCK PARKWAY SYSTEM," AND MORE PARTICULARLY DESCRIBED HEREIN), AS A SCENIC TRANSPORTATION CORRIDOR; MAKING FINDINGS; MAKING ALL NECESSARY CHANGES ON PAGES NO. 37 AND 38 OF SAID ATLAS; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board at its meeting of December 20, 1989, Item No. 3, following an advertised hearing adopted Resolution No. PAB 70-89, by an 8 to 0 vote, RECOMMENDING APPROVAL of this designation, as hereinafter set forth; and WHEREAS, the Miami Heritage Conservation Board, at its meeting of November 21, 1989, adopted Resolution No. HC-89-30, by a vote of 5 to 0, RECOMMENDING APPROVAL of the herein Soenio Transportation Corridor designation; and WHEREAS, the Brickell Hammock Parkway System is the distinctive feature of this neighborhood, the likes of which can be is found in very few other Miami neighborhoods; and WHEREAS, the subdivision containing the subject parkway system was platted in 1921 by City of Miami pioneer Mary Brickell who designed the System of divided landscaped "Parks;" and WHEREAS, the unique landscape character of the parkway system includes medians and swale areas with a single species of trees as well as those with mixed species; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this Soenio Transportation Corridor designation as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Official Atlas of Environmental Preservation Districts and Soenio Transportation Corridors of the City of Miami, Florida, is hereby amended by designating the following public rights -of -way and the public rights -of -way of the area therein circumscribed from S.W. 1st Avenue to S.W. 8th Avenue between S.W. 23rd Road and S.W. 27th Road, generally described as the "Briokell Hammock Parkway Systems," and more particularly described as the circumscribed public rights -of -way from the North right-of-way ("r.o.w.") line (extended) of S.W. 1st Avenue, between the East r.o.w. line of the S.W. 23rd Road and the West r . o . w . line of the S.W. 27th Road, BRICKELL HAMMOCK UNIT NO. 1, according to the plat thereof, as recorded in Plat Book 8, Page 113, of the Public Records of Dade County, Florida, as a Scenic Transportation Corridor. Section 2. The City Commission hereby finds that the Briokell Hammock Parkway System has a unique landscape character and an extensive tree canopy and is of substantial environmental importance to both residents and visitors for the following reasons: a. The parkway system is the distinctive feature of this neighborhood and is found in few other Miami neighborhoods; b. The subdivision was platted in 1921 by pioneer Mary Briokell who designed the system of divided landscaped "Parks"; and c. The unique landscape character of the parkway system includes medians and swale areas with a single species of trees as well as those with mixed species. Section 3. Pages numbered 37 and 38 of the City of Miami Atlas of Environmental Preservation Districts and Scenic Transportation Corridors are hereby amended to reflect the changes made necessary by this designation. -2-. 010707 Seotion 4. Consideration of amending the Environmental Preservation Districts and Scenic Transportation Corridors Atlas of the City of Miami, Florida, by designating the Brickell Hammock Parkway System specifically defined as all public rights -of -way northwest of S.W. 1st Avenue within the subject area, as a Scenic Transportation Corridor, pursuant to the criteria and procedures in Section 17-6 Environmental Preservation Districts, Chapter 17 Environmental Preservation, of the City Cade. REQUEST To designate the parkway and medians northwest of S.W. 1st Avenue within the Brickell Hammock Unit No. 1 Subdivision in the Roads area as a Scenic Transportation Corridor. RECOMMENDATION PLANNING DEPARTMENT Approval. HERITAGE CONSERVATION BOARD Approval, 5 to 0. BACKGROUND At the request of the Miami - Roads Neighborhood Civic Association, the City Commission on September 14,. 1989, directed the Heritage Conservation Board to consider the possible designation of medians in Roads neighborhood as a Scenic Transportation Corridor. On October 17, 1989, the Heritage Conservation Board PAB 12/20/89 Item #3 Page 1 of 2 010707 conducted a preliminary evaluation of th request and determined that the medians appeare to meet the criteria as set forth i Section 17-6(B)(3) of Chapter 17 of the Miatr City Code. At a public hearing on November 21 1989, the Heritage Conservation Boar recommended designation of the Parkway System a a Scenic Transportation Corridor.
