ORDINANCE NO. 010706
AN EMERGENCY ORDINANCE AMENDING
SECTION 52.6-5 AND SUBSECTIONS (a) AND (c) OF
SECTION 52.6-3 OF THE CODE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED, THEREBY
INCREASING THE NUMBER OF VOTING MEMBERS OF
THE MIAMI SPORTS AND EXHIBITION AUTHORITY
("AUTHORITY") TO THIRTEEN; PROVIDING FOR A
MEMBER OF THE CITY COMMISSION TO SERVE AS
CHAIRPERSON OF THE AUTHORITY FOR A ONE YEAR
TERM, SAID APPOINTMENT TO BE REVIEWED EACH
YEAR; PROVIDING FOR THE SELECTION OF THE
EXECUTIVE DIRECTOR OF THE AUTHORITY BY ITS
MEMBERS, SUBJECT TO CITY COMMISSION APPROVAL
BY A FOUR -FIFTHS (4/5THS) VOTE; AND REQUIRING
THAT MONTHLY REPORTS BE FURNISHED TO THE
AUTHORITY AND THE CITY COMMISSION WITH
RESPECT TO THE OPERATION, MAINTENANCE AND
FINANCIAL CONDITION OF THE AUTHORITY;
CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Commission of the City of Miami, Florida,
desires to increase the number of members of the Miami Sports and
Exhibition Authority ("Authority"); and
WHEREAS, the City Commission also desires to appoint one of
its members as the Chairperson of the Authority; and
WHEREAS, in order to enhance the autonomy and cohesiveness
of the Authority, the City Commission has decided that the
Executive Director of the Authority should be selected by members
of the Authority, subject to City Commission approval;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Subsections (a) and (c) of Section 52.6-3 of
the Code of the City of Miami, Florida, as amended, are hereby
amended in the following particulars:/

remaining provisions are now in effect and remain unchanged.

Governing body.
(a) Composition. The authority shall consist of

(o) Term of members. The voting members shall
serve at the pleasure of the city commission for the
following terms of office: Group 1 shall consist of
six (6) members who shall serve a two-year term of
office; Group 11 shall consist of five fty) B18 L01

Section 2. Section 52.6-5 of the Code of the City of
Miami, Florida, as amended, is hereby amended in the following
particulars:?/
"Sec. 52.6-5. General powers and responsibilities of
the director.
Upon the effective date of the incumbent
director's resignation and thereafter, the vtty-mazrager
members of the
authority shall. within- ninety (90) days of such
vacancy�gpoint a new director of the authority. Such
anointment and the terms and conditiong of the new
director shall take an oath before entering upon any
duties. The director shall act as the chief executive
officer of the authority. Subject to the policy
directives of the authority, the director shall have
general supervision over and be responsible for the
operation and maintenance of all authority properties,
activities, and facilities. The director shall attend
all meetings of the authority, shall furnish the
authority and the city commission a monthly report with
respect to the operation, maintenance and financial
condition of the authority, and shall from time to time
have prepared and shall furnish such reports, audits
and other information relating to said authority as may
be required by the authority. 1n the event that the
director shall for any reason be temporarily incapable
of exercising the powers and performing the duties and
functions of this office, the

director of the authority as so designated by the

Section 3. All ordinances or parts of ordinances in
conflict herewith insofar as they are in conflict with the
provisions of this Ordinance are hereby repealed.
Section 4. If any section, part of this section,
paragraph, clause, phrase or word of this Ordinance is declared
invalid, the remaining provisions of this Ordinance shall not be
affected.
Section B. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public needs for the
preservation of peace, health, safety, and property of the City
of Miami.
Section 6. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 7. This Ordinance shall become effective
immediately upon its adoption.
