A RESOLUTION, WITH ATTACHMENTS, MODIFYING THE DECISION
OF THE HERITAGE CONSERVATION BOARD AND APPROVING A
CERTIFICATE OF APPROVAL AS AMENDED BY THE CITY
COMMISSION, FOR DEVELOPMENT ACTIVITY INVOLVING THE
CONSTRUCTION OF A FRONT AND BACK ENTRANCE, WALLS, AND
A PRIVATE ROAD FOR THE PROPOSED TENTATIVE PLAT FOR THE
PROPERTY LOCATED AT 3952 DOUGLAS ROAD, COCONUT GROVE,
FLORIDA ("DE GARMO ESTATES"), REQUIRING TREE REMOVAL
AND RELOCATION, WITHIN ENVIRONMENTAL PRESERVATION
DISTRICT NO. 48-1 AND THE DOUGLAS ROAD SCENIC
TRANSPORTATION CORRIDOR.
WHEREAS, the Heritage Conservation Board at its meetinm of December 19,
1989, Item No. 2, following an advertised public hearing, adopted Resolution
No. HC-89-31 (attached) by a six to two (6-2) vote APPROVING a Certificate of
Approval which required modifications to the original plans with final
approval by the Heritage Conservation Board; and
WHEREAS, the Heritage Conservation Board at its meeting of January 16,
1990, Item No. 6, following an advertised public hearing, reviewed amended
plans and adopted Resolution No. HC-90-3 by a seven to zero (1-0) vote
APPROVING, subject to conditions, a subsequent Certificate of Approval; and
WHEREAS, pursuant to Section 11415(b), Miami City Code, Mr. and !ors.
Bruce Berckmans, Jr. have taken an appeal to the City Commission from approval
of said Certificate; and
WHEREAS, the City Commission after careful consideration of this matter
finds that the stated reasons or grounds for the appeal justify modifying the
decision of the Heritage Conservation Board and issuing a Certificate of
Approval as so modified;
NOW,, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The decision of the Heritage Conservation Board in the herein
matter is hereby modified and the Certificate of Approval authorized through
Resolution HC-90-3 (attached) for development activity involving the
construction of a front and back entrance, walls, and a private road for the
proposed tentative plat#1320D for the property located at 3952 Douglas Road,
Coconut Grove, Florida ("DeGarmo Estates"), proposing tree removal and

I. The approximately 59 existing trees proposed to he removed and the
approximately 33 trees proposed to be relocated shall either remain in
place, or only if located in the proposed road, shall be relocated; and
2. The maximum height of the main entrance gate feature at Douglas Road shall
be 16 feet as measured from the average grade elevation at a point midway
between the two towers (which point is 18.46' City of Miami Datum), and
the mass of the feature shall be reduced by at least 33 percent.
Section 2. This Resolution shall become effective immediately upon its
adoption.

It is recommended that the Commission uphold the decision of the Heritage
Conservation Board in authorizing a Certificate of Approval for development
activity for the proposed De Garmo Estates Tentative Plat 1320-8 at 3952
Douglas Road, involving the construction of a front and back entrance, walls,
a private road, and also involving tree removal and relocation, located within
Environmental Preservation District 48-1 and the Douglas Road Scenic
Transportation Corridor, per plans on file.
BACKGROUND
An adjacent property owner has filed an appeal (attached).
By Resolution HC-90-3; January 16, 1990, the Heritage Conservation Board
authorized a revised Certificate of Approval by a vote of 7 to 0 (attached).
The Heritage Conservation Board accepted the applicant's plans, noting changes
to the entrance towers, but subject to conditions pertaining to walls, tree
canopy and signage.
�: Previously on December 19, 1989 by Resolution HC-89-31 the Board had
authorized a certificate, subject: to more extensive conditions by a vote of
6 to 2.
The file, containing all pertinent information on which the action was based,
is attached; plans will be available at the Commission hearing.

Mr. and Mrs. Bruce Berckmans wish to appeal the
decision of the Heritage Conservation Board on January 16,
1990 approving the application for tree removal and
development within the Douglas Road Scenic Transportation
Corridor at 3952 Douglas Road ( De Garmo Estates ) and the
Certificate of Approval allowing development within the
Environmental Preservation District 48-1 at the same address.
The application for tree removal approved by the Board
does not comply with the City of Miami's,standards for tree
removal and development nor with the minimum standards set
out in Dade County Ordinance 89-9.

Staff Recommendation: A proposed tentative plat for the DeGarmo
Estates was given conceptual approval by the
Heritage Conservation Board on July 18, 1989.
The tentative plat has not yet been approved by
the Plat and Street Committee. This application
seeks approval of entrances and walls, with
corresponding tree removal and relocation.
The eight foot entrance wall and gates on
Douglas Road are formal in design, massive in
scale, and out of character with other design
features along the Main Highway Scenic
Transportation Corridor. This impact is
somewhat lessened, however, because they are set
back approximately 45-60 feet from the edge of
Douglas Road.
The lower wall within the traffic island
provides a useful, physical barrier at an
intersection where cars from Main Highway have
often crashed into the existing wall. The
identification of the subdivision name on the
wail may be appropriate for a subdivision in
Kendall or South Dade, but not Coconut Grove.
The design of the entrance should serve as the
project's identification. Furthermore, Chapter
17 discourages the placement of signs along
Scenic Transportation Corridors.
The Planning Department is also concerned with
the proposed landscape treatment along the
Douglas Road entrance. The planting plan
proposes to remove- or relocate all existing
trees within 50 feet of the edge of Douglas
Road. These trees include phoenix palms, royal
palms, and ficus trees. although the Planning
Department understands the applicant's desire to
create visibility and an identity for the
entrance to his project, the Department is
concerned about the removal of some of the
existing trees and the resulting lack of canopy
at an already wide open intersection. The

proposed eight royal palms within the traffic
island are not adequate in canopy coverage. The
bareness is out of character with the Scenic
Transportation Corridor. The Planning
Department would prefer two to three large
mahogany trees at each end of the island.
The Board and applicant may also wi3h to
conpletely reconsider the formal, synnetrical
architectural and landscape treatment of the
Vougias Read entrance. other less format
treatments may be more in Character with the
Scenic Transportation Corridor, yet equally
appropriate to an expensive subdivision. One
need only look at the entrances to Vizcaya and
its farm village to see how effective an
asymmetrical arrangement with irregularity
spaced shade trees can be.
The Planning Department commends the applicant
on reducing the height of the walls within the
subdivision to four feet. These walls will be
more in keeping with the existing character of
the site. The Department, however, is concerned
about the formal treatment of the planting
plant. The use of only one species of shade tree
inside the walls is not in character with the
site, where a large number of different trees
have been randomly planted. More variety in
plant material is called for. Furthermore, the
plantinV plan does not take into consideration
the existing trees just inside the proposed
walls. For instance, a large oak (022) is
located west of the plaza at lot rd where new
trees are proposed. Also, the large oak (0125)
and Mahogany (i+l381) proposed to remain within
the right -of -Nay along Midway Street are not
considered in the planting plan. All existing
trees should be shown on the planting plan, as
well as the new location of relocated trees.
The Planning Department recommends that the
application for a Certificate of Approval be
approved, subject to the redesign of the Dougias
Road entrance and planting plan to address the
concerns addressed above. The Department also
encourages the applicant to resubmit his
application for a tentative plat prior to the
next Heritage Conservation Board meeting so the
Board will know whether the proposed plat
complies with all conditions of the Plat and
Street Committee.
CITY COMISSION At its meting of February 15, 1990, the City
Comission continued consideration of the above
to its sleeting of March 8, 1990.

=n addition to the above requirements, you should lie aware of

include paving, drainage, landscaping, sidewalks, etc. In
some cases this could represent a substantial investment
on your part.
2. The alteration, relocation or installation of utilities
such as storm and sanitary sewers, electric, telepnone,
water, etc., caused by this plat will be at the property
owner's expense. Also, utility easements may be required
on the property being platted.
A building permit :rill not be issued on the property being
platted until the final plat s recorded. Also, the
Oersificate of Occupancy for any building construction will

We are writing to you about some concerns we have
with the proposed DeGarmo Estates Housing Development
as the intersection of Main Highway and Douglas Road in
Coconut Grove. This proposal and the plan for,*t will
come before the City Commission in early March. We
will be unable to attend the meeting, so are writing
you instead.
We are anxious to see that the project will not
put more traffic down El Prado Boulevard, as this is a
residential neighborhood. We would hope that during
construction and for all-time, the plan would be for
this gated community to have all traffic entering and
exiting onto the major thoroughfare, Douglas Road.
The towers being planned for the entry gate to the
development are 25 feet tall. This is as high as a
three-story building, if the ceilings were built to
minimum code on each story. Such structures that
are quite large at the base, would make a very
imposing statement in the South Grove, and we feel
they would be inappropriate adjacent to historic
Main Highway.

DeGar.mo Estates and _uy wife and I made it our home there
for 22 years until she died. WHile I don't approve of the
town houses allowed to be built on the property, I rep l i v,,<
nothing can be done about that, however I object vehemently
to:
1) The entrance proposed of two 27 foot toners uith arch
between and
2) The removal of the oak trees.
First, the entrance as I have seen it drawn looks like one
that belongs to a shopping center and most certainly not in
any way in keeping with what belongs in the residential area
of the village of Coconut Grove. Secondly, to cut down four
or five oak trees that as far as I know are the largest in
Coconut Grove (200 to 300 years old) is not short of criminal.
I know the developer's "promise" to plant other trees, but as
I understand the ordii)ance, he can cut down a 48 inch diameter
tree and can replant 48 1 inch trees. This is ridiculous.
I hope sincerely you will prevent these two things from happen-
ing and wi__11 see that this monstrous development is defeated.

I will not be able to attend the city commission meeting
on Thursday, March 8th, due to a prior committment.
Please note my objection to the proposed plan at DeGarmo
Estates. I cannot understand why anyone would allow or favor
the construction of a 27-foot arch at the historic Main
Highway -Douglas Road entrance, nor the removal of the
beautiful trees that grace the site.
You will be doing the developer a great favor by
disallowing this incongruous arch at one of the loveliest
sites in Coconut Grove, as surely no one would admit to
living, within such a tasteless entrance.
The Grove has much charm, history and character, rare
and vanishing qualities in our great city. Please help us
maintain the character and integrity of this magnificent

As you know, WTVJ is the only media outlet in South Florida
with an ongoing environmental protection and awareness campaign.
It is in the spirit of this effort that my wife Caren and I who
are Miami taxpayers and residents of Coconut Grove urge you to
reject the proposed plans for the DeGarmo Estate Project at Main
Highway and Douglas Road which includes massive tree removal and
construction of a 25 ft. high arch at the entrance. This matter
will be heard at 6 p.m. at the March 8 City Commission meeting.
There are numerous compelling reasons for rejecting the plan
by developer Carlos Cacciamani. Although we do not oppose his plan
to build homes on the 3.5 acre property, the part we seriously
object to includes:
® The property lies within an environmental preservation district
and is adjacent to a state -designated historic roadway and a city -
designated scenic transportation corridor.
er The developer plans to unlawfully remove all the trees on the
site, replace them with trees with less canopy and group those trees
in the center of the site. The replacement trees will never grow a
canopy similar to the one which will be destroyed, thereby stripping
the character of an enormous section of prime central Coconut Grove
property.
e Land which has been stripped of its canopy can no longer support
the kinds of plant life which are in character with the rest of the
Grove. The effect will be a 3.5 acre hole in the middle of the grove,
rendering it totally out of character with the surrounding neighbor-
hood.
a Three other 9-10 acre estates along Main Highway and Douglas
Road are for sale or currently slated for development. If the City
permits the stripping of trees on the DeGarmo Estate, a terrible

canopy are planted, our r4randchildren will. not .l.i�.,e to see them mature.
The developer plans to build two 25-foot towers connected. by an
3.8 foot wide arch at the Main I7ighway/Douglas Road entrance to the
project. 25 feet is higher than the roof of the second floor of our
home --an original. DeGarmo home. The design and scale of this arch
is totally out of context historically and architecturally with the
area and with the DeGarmo style. Again, should a structure such as
this be approved, we could face a wall of concrete arches the length
of Main Highway as new projects are built.
0 The elimination of so :many trees will ultimately change the
character of the Grove so dramatically that it will no longer be the
attraction it is now to so many visitors. Visitors to the Grove don't
stop to take pictures of concrete --they stop to take pictures of the
trees. The potential negative economic impact is significant.
What concerns us most of all is that Mr. Cacc.iamani's proposal
somehow managed to obtain approval from the citv's Heritage Conservation
Board, theoretically our watchdog organization. There is apparently
no sensitivity here to maintaining they integrity of Miami's premiere
neighborhood.
As members of the Entrada Association, we join many other
Coconut Grove Community groups such as the it Prado Community Association
in asking for your support.
Thank you for your consideration of this issue. Hopefully, together
we will continue to work towards the long --term nurturing and development
of Miami.

We have grave concerns reqF.-,dinq tll(, fate of an eSf_,Ite
in our neighborhood that is about to be developed.
The property address is 3952 Douglas Road, and will he
called "De Garmo Estates". It is approximately 3.5 acres, and
is an EPD - Environmental Pteservation District, and it
sits at the intersection of two Scenic Transportation
Corridors. (Main Highway and Douglas Road)
The owner/developer's plans include a walled
subdivision with ten houses, the removal or relocation of
all existing trees within 601 of the edge of Douglas Road
and removal of virtually all of the trees on the rest of
the site. The plan also calls for a formal, massive entrance
with 251 high towers connected by an arch over the roadway
with gates and walls exten(fing to either side of the
property.
Because this property is an EPD, and at the intersection
of two Scenic Transportation Corridors, the Heritage
Conservation Board has to approve the developers plans for
tree removal and the entrance ( walls and gates ) before it
can go to Street and Plat. On January 16, 1990 the HC Board
approved the plan. An adjoining property owner to the site
has filed an appeal that will be heard before the City
Commission on February 15, 1990.
We have only to look around us in Coconut Grove, the
South end in particular, to see that the trees and canopy
have always been carefully protected. Two reasons for this
are consideration for the environment at large, and the
basic esthetics concerned. This area is desirable not only
to its residents, but to people around the world who visit
0iis section of the City, because of the casual, elegance
and very lack of formality that is bore.
Traditionally the City has been wise in its zoning
?I;actices to be consistent with what is already here, to
maintain the residential areas as residential areas without
'clutter and confusion. Hence, the most beautiful and
valuable real estate in the City. The developer for "De
Garmo Estates" wants to completely change, forever, this
picture. We will be looking at enormous amounts of concrete,
a very formal design and 251 high towers. There is nothing
like this anywhere in the South end of the Grove. Should we
start a trend, set a precedent so the character of this area
Is changed forever? Ile say no. Homes and trees are fine,
monuments are not. We love the Grove the way it is and pay
dearly for it in real estate and property taxes.
On February 15, please vote to save the trees, and the
neighborhood from a Miami Arc de Triomphe.

Dear Mayor Suarez:
I am writing this letter on my law office stationary but as
a resident of St. Gaudens Road in Coconut Grove. I am very
concerned that the City would consider allowing the developer of
the DeGarmo property to erect any substantial entry feature of the
type presently contemplated, and further concerned that a
substantial number of mature trees presently located on the site
would be allowed to be destroyed.
Each of you live within the city of Miami and recognize the
aesthetic treasure that is Coconut Grove. Reasonable people
recognize that both population and economic pressures will mean
that some change to Coconut Grove is inevitable, and sometimes this
means that large estates will give way to single family home
development. however, the proposed destruction of the trees and
construction of the towers and arch cannot be reasonably
demonstrated as necessary for the developers economic success, and
must be recognized as completely inconsistent with the values of
those of us who have lived many years in Coconut Grove as well as
the community at large.
I urge you to vote responsibly and protect the character of
the community.
