RESOLUTION NO. 90-0188
A RESOLUTION CONCERNING THE "MIAMI MAGIC"
FIVE --MILE RUN AND THREE-MILE FUN WALK TO BE
CONDUCTED BY THE JUNIOR LEAGUE OF GREATER
MIAMI ON APRIL 21, 1990, AND THE PROGRESSIVE
DINNER GALA TO BE CONDUCTED BY JUNIOR LEAGUE
OF GREATER MIAMI ON APRIL 21, 1990 AND
APRIL 22, 1990: AUTHORIZING THE PARTIAL
CLOSURE OF DESIGNATED STREETS TO THROUGH
VEHICULAR TRAFFIC DURING THE FIVE -MILE RUN
AND THREE-MILE FUN WALK SUBJECT TO THE
ISSUANCE OF PERMITS BY THE DEPARTMENTS OF
POLICE AND FIRE, RESCUE AND INSPECTION
SERVICES; FURTHER CONDITIONALLY APPROVING THE
PARTIAL USE OF STREETS IN DOWNTOWN MIAMI FOR
SAID ORGANIZATION°S PROGRESSIVE DINNER GALA,
A FUND RAISING EVENT DURING THE EVENING OF
APRIL 21, 1990; SUBJECT TO THE EXERCISE OF
COMPLETE CONTROL OVER SUCH USE BY THE
DEPARTMENT OF POLICE: AUTHORIZING A ONE -DAY
PERMIT TO SELL BEER AND WINE IN CONNECTION
WITH SAID EVENTS SUBJECT TO THE ISSUANCE OF
ALL PERMITS REQUIRED BY LAW; SAID APPROVAL
AND AUTHORIZATIONS BEING CONDITIONED UPON THE
ORGANIZERS PAYING FOR THE COST OF CITY
SERVICES AND UPON THE REgUIREMENT THAT THE
CITY WILL BE INSURED AGAINST ANY POTENTIAL
LIABILITY.
WHEREAS, the Junior League of Greater Miami, Inc, will
conduct the 1990 Miami Magic Five -Mile Run, Three -Mile Fun Walk
on April 21, 1990, and the Progressive Dinner Gala on April 21,
1990 and April 22, 1990; and
WHEREAS, certain streets must be partially closed to conduct
the Five -Mile Run and Three -Mile Fun Walk event between the hours
of 7:00 A.M. and 11:0U A.M.; and
WHEREAS, the Junior League of Greater Miami is requesting
the use of certain streets in Downtown Miami for the evening
Progressive Dinner Gala from 7:00 P.M. on Saturday, April 21,
1990 to 1:UU a.m. Sunday, April 22, 1990; and
WHEREAS, the Juni.or League of Greater Miami has requested
authorization for a one -day permit to sell beer and wine in
connection with said event, subject to the issuance of all
permits required by law;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITE'
OF MIAMI, FLORIDA:
Section 1. in order to effectuate safe passage during the
1990 Miami Magic Five -Mile Run and Three -Mile Fun Walk the
following streets are hereby partially closed to through
vehicular traffic on Saturday, April 2.1, 1990 as specified below:
7:00 A.M. to 11:00 A.M.:
Biscayne Boulevard (westernmost lane) from Northeast Third
Street to Southeast Second Sheet.
Southwest Second Street from Biscayne Boulevard to Southeast
Second Avenue.
Southeast Second Avenue from Southeast Second Street to
Brickell Avenue Bridge.
Brickell Avenue from Southeast Fifth Street to Southeast
Eighth Street.
Southwest Eighth Street from Southwest Thirteenth Avenue to
Brickell Avenue.
Southwest Thirteenth Avenue from Southwest Eighth Street to
West Flagler Street. (Close two lanes of Flagler Street)
Flagler Street from Southwest Thirteenth Avenue to Biscayne
Boulevard.
Included in the herein closure are all streets, avenues,
alleys, ways and thoroughfares which intersect the specified
areas delineated in this Section.
Section 2. Such closing of streets is subject to State
approval and issua►ece of permits by the Departments of Police and
Fire, Rescue and Inspection Services. Said permit from the
Department of Police is to be issued upon full approval of the
Chief of Police after giving all due consideration to the safety
and traffic needs of residents, businesses, and religious
institutions in the area for entering and crossing through said
arterials and upon the favorable exercise of the City Manager's
judgement predicated upon all factors set forth herein.
Section 3. The partial use of streets in downtown Miami
during the evening "Progressive Dinner Gala", from 7:00 P.M. on
Saturday, April 21, 1990 to 1:00 A.M. Sunday, April 22, 1990 is
hereby approved subject to the exercise of complete control over
such use by the Department of Police after giving all due
consideration to the safety and traffic needs of residents,
businesses, and religious institutions in the area for entering
and crossing through said arterials.

Section 4. Upon the issuance of a temporary permit by the
Florida Department of Business Regulations, Division of Alcoholic
Beverages and Tobacco, to distribute beer and wine pursuant to
City Code Sec. 54--12.1, the request of the organizers to
distribute beer and wine for a one -day period in connection with
the "Miami Magic" events is hereby granted subject to the
issuance of all permits required by law.
Section 5. The herein approval and authorizations are
hereby conditioned upon the organizers paying for all costs of.
City services associated with said events and the requirement
that the City be insured against any potential liability.
Section 6. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION:
It is respectfully recommended that the City Cr_,mr:issicri adort the
attached resolution authorizing the partial closure of certaln
streets �n connection with the 1990 Miami Magic Five -Nile Pun and
Three -Mile Fun Walk, the use of certain streets during the evening
Progressive Dinner Gala and a one -day permit to sell beer and wine
during the said events to be held Apr::l 21, 1990., subject to the
issuance of permits by the Departments of Police and Fire, Rescue and
Inspection Services and the requirement that the City be insured
against any potential liability. The above authorizations are
conditioned upon the organizers raying for the cost of all necessary
City services.
URCKGROUND :
The Department of Commun:.ty Development has prepared the apprcpr1ate
legislation in connection with the 1990 Miami Maalc Five -Mlle Fun,
Three -Mile Fun Walk and Progressive Dinner Gala to be conducted by
the Junlor League of Greater Miami, Inc. on Saturday, April 21, 1990.
The Junior League of Miami has conducted the Miami Magic event .gin
Downtown Miami during the .last four years.
