HomeMy WebLinkAboutO-10716Lei '1• _1 1 AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 10642, ADOPTED SEPTEMBER 28, 1989, AS AMENDED, THE CAPITAL IMPROVEMENT'S APPROPRIATIONS ORDINANCE, BY REDUCING APPROPRIATIONS TO THE PROJECT ENTITLED "BAYFRONT PARK REDEVELOPMENT - SOUTH END AND CHOPIN PLAZA COURT", CIP PROJECT NO. 331305, IN THE AMOUNT OF $500,000, FROM STATE OF FLORIDA, DIRECT APPROPRIATIONS - FY '89, AND INCREASING APPROPRIATIONS TO THE PROJECT ENTITLED "BAYFRONT PARK REDEVELOPMENT - PEPPER FOUNTAIN", PROJECT NO. 331306, IN THE SAME AMOUNT OF $500,000, FROM THE STATE OF FLORIDA, DIRECT APPROPRIATIONS - FYI 89; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 10642 on September 28, 1989, establishing appropriations for the implementation of capital improvements in the City of Miami; and WHEREAS, said Ordinance No. 10642 established appropriations for Capital Improvements Project No. 331305, "Bayfront Park Redevelopment - South End and Chopin Plaza Court"; and WHEREAS, certain issues, including but not limited to unstable soil conditions, minor structural settling, and cracking, have given rise to the need for additional funding on the project; and WHEREAS, said funding is available from as yet unused monies from the State of Florida, Direct Appropriations - FY '89, in the amount of $500,000 for the Bayfront Park Redevelopment - South End and Chopin Plaza Court; and WHEREAS, the repairs needed are to be made as expeditiously as possible for the benefit and enjoyment of the citizens and the general public; and WHEREAS, the City Commission adopted Motion No. 90-58 on January 11, 1990, indicating its approval for the use of said State legislative grant funds, subject to their being sufficient funds remaining available for the construction of a small amphitheater in the south end of Bayfront Park, and upon the condition that the legislative sponsors of the grant have no o1o7IG objection to such use at this time, and express their agreement to the City's small amphitheater proposal; and WHEREAS, the City Administration has obtained the consent of the grants legislative sponsors to such use and also confirmed the availability of adequate funds for the completion of the small amphitheater; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MUM, FLORIDA: Section 1. Section 1 of Ordinance No. 10642, adopted September 28 1989, as amended, is hereby amended in the following particulars: 1 "Section 1. The herein appropriations are hereby made for implementation of all municipal capital improvements of the City of Miami, including new capital improvement projects scheduled to begin during fiscal year 1989-90. The herein appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as re -appropriations of prior fund appropriations. The source of revenues to support the herein appropriations is hereby identified by fund and project with the project appropriations and revenues therefor being set forth for seven program areas (I-VII) based upon use or functional category within said areas, as follows: Total Appropriations ( $ X 000) IV. Od `'k REFERENCES: City Manage ENCLOSURES: It is respectfully recommended that the City Commission adopt the attached ordinance amending the Capital Appropriations Ordinance No. 10642, which reduces appropriations for "BAYFRONT PARK REDEVELOPMENT - SOUTH END AND CHOPIN PLAZA COURT", Project No. 331305, in the amount of $500,000 from the State of Florida, Direct Appropriations - FY 189, and increases appropriations for "BAYFRONT PARK REDEVELOPMENT - PEPPER FOUNTAIN", Project No. 331306, in the amount of $500,000 from the State of Florida, Direct Appropriations - FY '89. The Department of Public Works and the City Manager's staff have determined that there exists a need to increase appropriations for the project entitled "Bayfront Park Redevelopment - Pepper Fountain", CIP Project No. 331306, in the amount of $500,000. The fountain at Bayfront Park has encountered unforeseen difficulties which have increased the cost of the project. Additionally, some minor structural settlement has occurred, which requires cosmetic correction. Unstable soil conditions at the site have contributed to these problems. Funds for these repairs are to be provided from unused monies in another Bayfront Park account, namely the South End and Chopin Plaza Court. This amendment is being presented so that the project can be quickly funded, and construction completed as soon as possible.
