COKMITMRNT TO HISTORIC PRESERVATION Zit THE
CITY AS SET FORTH IN ARTICLS 16 OF THE CITY
OF MIAMI ZONING ORDINANCE BY OFFICIALLY
DECLARING THAT OWNER CONSENT WILL NOT BE A
CRITERION FOR THE AETERHINATION CIF -HISTORIC
DESIGNATIONS.
RE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
PLORZDA
Seotion 1. The City of Miami's oommitment to historio
preservation in the City as set forth in Artiole 18 of the City
of Miami zoning Ordimmnoe Is hereby reaffirmed by this offiolal
declaration, that owner oonsent will not be a oriterion for tha
determination of historic designations.
Seotion a. This Resolution shall beoome effective
immediately upon its adoption.

DISCUSSION:
At its meeting of February 15, 1990, the City Commission adopted Resolution 90-138
pertaining to owner consent (attached) and directed the Planning Department to
study the County Attorneys recommendation to settle this litigation by directing
the Administration to initiate legislation transferring the designation of
historic properties from the Zoning Ordinance to the City Code and, thereby,
granting to the Heritage Conservation Board the authority to designate historic
properties, with appeal to the City Commission. Listed below are the pros and
cons of such an action.
PROS CONS
City Commission would no longer City Commission would give up

bonuses or incentives to
applicants as part of the
designation process. (It may
still be possible to offer
incentives by retaining an HC
overlay in the Zoning Ordinance
for designated properties that
may wish to take advantage of
such incentives.)
