HomeMy WebLinkAboutR-90-0238i-90-302 3/22/90 RESOLUTION NO. 90-0238 A RESOLUTION DIRECTING THE CITY'S ADMINISTRATION TO RESPOND TO THE DRAFT ENVIRONMENTAL IMPACT STATEMENT FOR THE MIAMI METROPOLITAN DETENTION CENTER (FEBRUARY 23, 1990), PREPARED BY THE U.S. BUREAU OF PRISONS, BY EXPRESSING OPPOSITION TO ANY JAIL FACILITY DOWNTOWN AND REFERENCING PREVIOUS CITY COMMISSION RESOLUTIONS ON THE ISSUE; AND MAKING RECOMMENDATIONS ON POSSIBLE SITES FOR USE IF THE FEDERAL GOVERNMENT PROCEEDS WITH CONSTRUCTION OF THE JAIL FACILITY DOWNTOWN IN SPITE OF THE CITY'S PROTEST. WHEREAS, the City Commission adopted Resolution No. 87-388, April 30, 1987, expressing its opposition to the location of additional jail facilities within the City of Miami, Florida; and WHEREAS, the City Commission adopted Resolution No. 89-978, October 26, 1989, further expressing its opposition to any proposal to locate a jail or detention facility in the downtown area of the City of Miami; and WHEREAS, the City Commission has adopted Resolution Nos. 86-1018, December 11, 1986, and 87-214, February 26, 1987, similarly expressing opposition to the establishment of downtown detention facilities; and WHEREAS, the City Commission has been informed that the U.S. Government apparently intends, notwithstanding the aforementioned protest, to proceed with plans to locate a short-term jail facility in downtown Miami; and WHEREAS, the U.S. Department of Justice, Federal Bureau of Prisons, is seeking comments on the draft Environmental Impact Statement for the proposed Metropolitan Detention Center in downtown Miami; and WHEREAS, the Federal government is considering the following sites for location of said federal detention facility: Site A: located directly to the north of the new Federal Courthouse and to the west of the proposed CITY COMMISSION MEETING OF MAR 22 1950 RESULUTION >O-028 REMARKS: Federal Law Enforoement Building. The historic Chaille Block of buildings at 401--447 North Miami. Avenue is on the western end of "Site A" and represents an opportunity for historic preservation by incorporating the historic buildings into the design of the detention facility. These buildings are eligible for listing on the National Register of Historic Places; federal agencies must allow the Advisory Council of Historic Preservation the opportunity of commenting on all projects affecting historic properties. The buildings were also designated as a historic district- by the City Commission in December 1988. JAe B: located on the west side of North Miami Avenue between N.W. 4th Street and N.W. Sth Street. This site is adjacent to City of Miami Off -Street Parking Department Lot 10. Site Q: located directly south of the Federal Court building in the approximate center of the block bounded by N.E. 1st Avenue, N.E. 3rd Street, North Miami Avenue and N.E. 2nd Street. This site is adjacent to the new facility for the New World School of the Arts; and WHEREAS, although the City Commission remains resolutely opposed to any site in downtown Miami, it is making the herein recommendations on site selection in rank order to mitigate possible damage to civic activities in proximity to the above described proposed sites; and WHEREAS, the aforementioned kites are in proximity to education facilities attended by thousands of young adults and other citizens; and WHEREAS, the City Commission is still of the opinion that the City of Miami can ill -afford the negative financial impact resulting from the removal of valuable downtown real estate from property tax rolls; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The Administration of the City of Miami is hereby directed to respond to the draft Environmental Impact Statement for the Miami Metropolitan Detention Center (February 23, 1990). prepared by the U.S. Bureau of Prisons, by expressing opposition to any jail facility being located downtown and _2 _ 90-0238 including therein referenoes to City of Miami Resolution Nos. 86-1016, December 11, 1986; 87-214, February 26, 1987; 87- 388, April 30, 1987, and 89-•978, October 20, 1989, and by expressing the City Commission's position that if a jail is to be located downtown, it should only be a small holding facility; further, by stating that if such a facility is to be located downtown on any of the proposed sites, then the City Commission hereby reluctantly expresses its preference for sites A, B, and C, in that specific rank order. Section 3. The City Administration is further directed in its response to make it unequivocally clear that Sites B and C are particularly objectionable because of proximity to the Downtown Campus of Miami Dade Junior College and that Site C is even more objectionable because it adjoins the New World School of the Arts, which is a secondary school. Odic(�; y� REFERENCES: Item PL-3 City Commission City Manager VVV"'���fjj Meeting of March 22, 1990 'ENCLOSURES: DISCUSSION: The U.S. Department of Justice, Federal Bureau of Prisons, is seeking comments on the Draft Environmental Impact Statement for the proposed Metropolitan Detention Center in downtown tliami. The Commission has established their policy of opposing construction of new jails in the downtown area. The Administration will convey the Commission's opposition in responding and in addition, needs any further instructions which the Commission cares to offer. The proposed detention center is a 1,000 unit short-term facility designed to house pre-trial and unsentenced detainees who are going through the federal judicial process. There are three sites under consideration, eac'1 of which is located directly adjacent to the existing Federal Courts in downtown Miami (see attached map): Site A is located directly to the north of the new Federal Courthouse and to the west of the proposed Federal Law Enforcement Building.
