A RESOLUTION ACCEPTING THE PLAT ENTITLED
"FERN ISLE GARDENS", A SUBDIVISION IN THE
CITY OF MIAMI; AND ACCEPTING THE DEDICATIONS
SHOWN ON SAID PLAT; AND AUTHORIZING AND
DIRECTING THE CITY MANAGER AND CITY CLERK. TO
EXECUTE THE PLAT AND PROVIDING FOR THE
RECORDATION OF SAID PLAT IN THE PUBLIC
RECORDS OF DADE COUNTY, FLORIDA.
WHEREAS, the City Department of Public Works recommends the
acceptance of the plat:
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The plat entitled "FERN ISLE GARDENS" is a
replat of Tract I, Revised Plat Fern Isle, according to the Plat
thereof as recorded in Plat Book 35 at Page 77 of the Public
Records of Dade County, Florida, less the north 10 feet thereof
for road purposes, less that part previously conveyed and now
known as PERELIS SUBDIVISION, recorded in Plat Book 102, at Page
77, and less that part previously conveyed for the East-West
Expressway in O.R. Book 5568 at Page 1.58, all lying in Section
34, Township 53 South, Range 41 East, City of Miami, Dade County,
Florida, which subject plat by reference is made a part hereof as
if fully incorporated herein and which plat, together with the
dedications shown thereon, and the dedications to the perpetual
use of the public of all existing and future planting, trees and
shrubbery on said property, is hereby accepted and confirmed by
the City of Miami, Florida.

Improvements
On June 9, 1988, through Resolution No. 88•-569, the City
Commission approved in principle, the conveyance and the
granting of development rights to the Allapattah Business
Development Authority for the development of two (2) medium
density residential housing projects on the City -owned Fern
Isle Nursery Site located at 2400 Northwest 14th Street.
In order to move this project forward, it is necessary that t:he
City facilitate the final plat of the property prior to the
transfer of ownership to the Allapattah Business Development
Authority. As you maybe aware, tentatively plat approval from
the City's Street and Plat Committee was secure at their
December 5, 1989 meeting, subject to certain conditions being
Gatisfied.
This memorandum serves to identify the source of funds which
will defray the cost of providing the subdivision off site
improvements for the proposed development(s). Funds are
available from the Affordable housing Development Program,
account code 579901-340-321024 for the purpose of funding the
said improvements. It is my understanding that the cost for
providing the said off site improvements is approximately
$135,000. It is also my understanding that the required $300
platting fee and the $200 preparation fee, plus recording fee
will be waived by your Department.

TO: DADE COUNTY, a political subdivision of the State of Florida.
With the understanding that this opinion of title is furnished to DADE
COUNTY, FLORIDA, in compliance with its Ordinance No. 57-30, and as an
inducement for acceptance of a proposed final subdivision plat covering the
real property hereinafter described, it is hereby certified that I have
examined the complete Abstract of Title completely covering the period from
the BEGINNING to JANUARY 3 A.D., 1990 at 2:30 P. M., inclusive, of the
following described real property:

"FERN ISLE GARDENS"
LOCATED ON N.W. 14 STREET & N.W. 24 AVENUE
A SUBDIVISION IN THE CITY OF MIAMI, FLORIDA
The accompanying Plat entitled "FERN ISLE GARDENS" was
prepared by Weidener Surveying & Mapping P.A.. It is in correct
form for submission to the City Commission and is forwarded with
a recommendation that it be approved.
PERTINENT INFORMATION REGARDING THE PLAT:
1. The property platted is a replat of Tract I, Revised Plat
Fern Isle, according to the Plat thereof as recorded in Plat
Book 35 at Page 77 of the Public Records of Dade County,
Florida, less the north 10 feet thereof for road purposes,
less that part previously conveyed and now known as PERELIS
SUBDIVISION, recorded in Plat Book 102, at Page 77, and less
that part previously conveyed for the East-West Expressway
in O.R. Book 556P at Page 158, all lying in Section 34,
Township 53 South, Range 41 East, City of Miami, Dade
County, Florida. The area platted consists of three (3)
tracts containing 4.7+ acres. It is zoned RG 2/6.
2. The location of the streets and the widths conform with the
standards of the Department of Public Works of the City of
Miami, Florida.
3. As certified to by James P. Weidener, Registered Land
Surveyor, this Plat complies with the plat filing Laws of
the State of Florida.

T!}e Certificate of Title Examination dated January 3, 101)(1,
signed by Gary V. Smith, Attorney, indicates that the fee
simple title to the property platted is correctly vested in
the City of Miami, a municipal Corp. and the Plat has been
correctly executed.
The area platted is not encumbered by mortgages.
The bond, agreement and covenant have been waived for
subdivision improvements by the Public Works Department in
lieu of the fact that the City owns the property and the
City Housing Agency is doing the platting. However, the
Housing Agency has supplied the Public Works Department with
a letter identifying charge codes that they will be
responsible for the S135,000 in subdivision improvements
required at this site.
The attached Resolution has been prepared for the acceptance
of the Plat by the City Commission of Miami, Florida.

RECOMMENDATION:
it is respectfully recommended that the City Commission adopt a
resolution accepting the plat "Fern Isle Gardens" and approving
recording the same in the Public Records of Dade County, Florida.
BACKGROUND:
The Department of Public Works has reviewed this plat, and has
determined that it is now in order for acceptance by the City
Commission.
The proposed record plat entitled "FERN ISLE GARDENS" is a replat
of Tract I, revised Plat Fern Isle, according to the Plat thereof
as recorded in Plat Book 35 at page 77 of the Public Records of
Dade County, Florida, less the north 1;1 feet thereof for road
purposes, less that part previously conveyed and now known as
PERELIS SUBDIVISION, recorded in Plat Book 102, at page 77, and
less that part previously conveyed for the East -blest Expressway
in O.R. Book 5563 at Page 15g, all lying in Section 34, Township
5:? South, Range 41 East, City of Miami, Dade County, Flori da.
The area platted consists of three (?) tracts containing 4.7+
acres. It is zoned PG 2/6.

Commission to consider in making their decision:
