"� "� A RESOLUTION APPOINTING CERTAIN INDIVIDUALS - TO SERVE AS MEMBERS ON THE MIAMI WATERFRONT ADVISORY BOARD OF THE CITY OF MIAMI, FLORIDA. WHEREAS, Ordinance No. 10459, adopted .July 14, 1988, created the Miami Waterfront Advisory Board and established organizational and operating guidelines for said Board; and WHEREAS, members were appointed to said Waterfront Advisory Board by said Ordinance, and by Resolution No. 88-927, adopted October 6, 1988, and Resolution No. 88-1201, adopted December 15, 1988; and WHEREAS, two ( 2 ) vacancies exist as a result of the removal of two (2) regular members for non-compliance with the administrative guidelines outlined in Ordinance No. 10459; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; _ Section 1. Fernandez, City Attorney, dated October 11, 1988, outlining some guidelines to assist members of City Boards and Committees in complying with the Government in the Sunshine Law. Also enclosed, for informational purposes, is another memorandum from the City Attorney, dated April 3, 1989 on legal requirements concerning Coriflict of Interest and Dual Office Holding circumstances which may prohibit your membership in said bodies. Odl o ;, :j 1 j REFERENCES City Manager. ) ENCLOSURES RECOMMENDATION: = It is respectfully recommended that the City Commission adopt the attached resolution appointing two (2) regular members to the Miami Waterfront Advisory Board. BACKGROUND: The Department of Parks, Recreation and Public Facilities has prepared the attached legislation. The purpose of this resolution is to fill existing vacancies by appointing (2) regular members to the Board. -- According to the atached January 22, 1990 memorandumfrom the City Clerk, these vacancies exist as a result of the removal of Mr. Tony Descalzo and Mr. Jose Luis from the hoard for not complying with the administrative guidelines established in Ordinance No. 10459. .These guidelines restrict a member's absences to less that one half of the cumulative meetings held within a one year period and prohibit three (3) consecutive absences, unless excused by the Board. The above -mentioned vacancies correspond to the following categories: CATEGORY A: One (1) position, expiring September 8, 1990. (To be appointed by Vice Mayor Dawkins) CATEGORY B: One (1) position, expiring September 8, 1991. (To be appointed by Commissioner De Yurre) The Board consists of a total of ten (10) regular members and one (1) alternate. The Board herby requests that Mr. Tony Descalzo and Mr. Jose Luis be removed from the Board for not complying with the above -mentioned criteria. Both of these members have missed three consecutive meetings and Mr. Tony Descalzo has been absent from one half of the cumulative meetings held in 1.989. (See attached attendance record). The Waterfront Boarrd shall be infcrmed of waterfront issues at the same time or before said issues are presented to other committees or boards. LENGTH OF TERM: Three years (staggered). Category A has a 2-year term initially, 3 years thereafter. Category B has a 3-year term. APPOINTED BY: City Commission (each Commissioner makes two appointments). The alternate shall be appointed from among the individuals nominated by the Mayor or any Commissioner. QUALIFICATIONS: Board members must be residents of the City of Miami, maintain a place of business or office in the City or own real property in the City.
