BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The following individual is hereby reappointed as a member on the City of Miami General Employees' and Sanitation Employees' Retirement Trust Board of Trustees to serve a term of office to expire on November 31, 1991: Section 2. OD10 City ManAger Enclosed herein please find a copy of R-90-288 which was passed and adopted by the City of Miami Commission at its meeting held on April 12, 1990, reappointing you to serve as a member on the Board of Trustees of the City of Miami General Employees' and Sanitation Employees' Retirement Trust. Pursuant to the Financial Disclosure law, Chapter 84-318(3), Laws of Florida, and as a member of the General & Sanitation Employees' Retirement Trust Board, you will be required to file a Statement of Financial Interests form with the Supervisor of Elections, Dade County Department of Elections. Their address is: Metro Dade Center, 19th Floor, 111 N.W. 1st Street, Miami, Florida 33130 (Tel: 375-5553). Sections 2-305 through 306 of the City of Miami Code require all elective and appointive officers or employees of the City to submit to the City Clerk a Statement of Real Property Owned by him/her, whether the title be either legal or equitable, whether owned in whole or in part, as well as a Statement of Corporate Real Property in which he/she has a controlling interest, or is an officer. Enclosed herein please find a copy of said forms to fill out. Kindly complete and return them to us at your earliest convenience. Also enclosed is a copy of a memorandum from Jorge L. Fernandez, City Attorney, dated October 11, 1988, outlining some guidelines to assist members of City Boards and Committees in complying with the Government in the Sunshine Law. Also enclosed, for informational purposes, is another memorandum from the City Attorney, dated April 3, 1989 on legal requirements concerning Conflict of Interest and Dual Office Holding circumstances which may prohibit your membership in said bodies. It is recommended that the City Commission reappoint one elected trustee member as a member of the City of Miami General Employees' and Sanitation Employees' Board of Trustees per the attached resolution in accordance with Ordinance No. 10002. BACKGROUND: City of Miami Code Section 40-227 (Ordinance No. 10002), provides for the appointment of a nine member board of trustees to administer and manage the retirement plan known as the "City of :Miami Genera' Employees' and Sanitation Employees' Retirement Trust". Of these nine members, one is to be selected by the City Manager, two by :,ae general employees (AFSCME bargaining unit), and two by the sanitation employees (SEA bargaining unit). Four independent trustees, who are not City employees, are to be selected by the City Commission. Two of such trustees shall be selected from a list of six persons submitted by the AFSCME according to its constitution and bylaws, and two such trustees shall be selected by the SEA according to its constitution and bylaws.
