OW724 AN EMERGENCY ORDINANCE SETTING FORTH CONDITIONS WHICH SHALL DETERMINE THE ORDER OF SERVICE AT A BOARD MEETING BY THE TWO ALTERNATE MEMBERS OF THE CITY'S CODE ENFORCEMENT BOARD AND PROVIDING THAT THE LATE APPEARANCE AT A SCHEDULED BOARD MEETING BY A REGULAR MEMBER SHALL NOT AFFECT THE CONTINUED SERVICE OF SUCH ALTERNATE MEMBER(S) FOR THE REMAINDER OF SUCH BOARD MEETING; FURTHER CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Notwithstanding any contrary code provision, the alternate member whose initial term of office is one year, if he or she be present at the scheduled commencement time of a board meeting, shall act as a member of the board should any regular board member not be present at such time; if such alternate member is not present at such time, then the other alternate member, if present, shall act as a regular member of the board. If more than one regular member is not present at such time, the alternate member whose initial term of office is two years shall, if present, act as a regular board member. After such alternate member or members have begun to serve at a board meeting, the late appearance of a regular member or members shall not affect the continued service of the alternate member or members for the remainder of such meeting. Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. 0107= Section 4. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami. Section S. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 6. It is the intention of the City Commission that the provisions of this Ordinance shall become and be made a part of the code of the City of Miami, Florida, as amended, which provisions may be renumbered or relettered and that the word "ordinance" may be changed to "section", "article", or other appropriate word to accomplish such intention. Section 7. This Ordinance shall become effective immediately upon its adoption. PASSED AND ADOPTED this 1990.
