Od City Manager 0 DATE : Qjl(,fFILE SUBJECT Public Hearing to Consider Locations for Recreational Facilities In Overtown (Miami Heat Community REFERENCES Foundation) ENCLOSURES As discussed at the April 12, 1990 City Commission Meeting, we have set a public hearing for 11:00 AM during the April 26th Commission Meeting to consider potential locations in Overtown for new indoor and outdoor recreational facilities offered to the City and to the Overtown community by the Miami Heat Community Foundation. It is the Intent of this hearing to receive Input from the community and to decide upon a final site for these recreational facilities. Should thi.s hearing result in the selection of Gibson Park for these facilities, authorization will be requested to execute a letter agreement, in a form acceptable to the City Attorney, between the City and the Miami Heat Community Foundation. Attached Is a proposed letter agreement submitted by the Miami Heat Community Foundation for discussion purposes. iu>r{ 9 3V LAI I 990 (iAR -9 Reginald A. Richardson Executive Director The City Manager 300 Pan American Drive Miami, Florida 33133 MARCH 5, 1990 ATTENTION: Cesar Odio, City Manager RE: Gibson Park Community Center Gentlemen: In accordance with our several di.scusssions concerning our common interest in providing recreational. programs, activities and facilities for the use and benefit of the residents of Miami, in general, and the youth of Overtown, in particular, the Miami Ileat Community Foundation, a Florida non-profit corporation (the "Foundation") is pre- pared to enter into binding agreements with the City and such other third parties as necessary, to acheieve the foregoing, though subject to the following general terms and conditions: 1. PROPERTY: The City shall lease to the Foundation the property more particularly described and known as Gibson Park (the "Property") constaining approximately 7.3 acres. The lease shall be for a period of thirty (30) years and shall provide for a total rental payment by the Foundation in the amount $1.00 per year. The City shall be responsible to comply with any bidding requirements that may be applicable under the Miami Code. 2. IMPROVEMENTS: The Foundation shall, at its sole cost, and expense, develope, construct and equip a community/ atheletic center in accordance with a master plan to be approved by the City. Any substantial deviations from the master plan as approved, shall be subject to the prior approval of the City. 3. EXECUTIVE BOARD: There shall be an executive board of the community center who shall be responsible for estab- lishing the policies, objectives and goals of the community center, and shall appoint the initial executive board which shall consist of the following twelve (12) members: Miami Neat Gommun ly foundation 3915 Biscayne Boulevard Miami, fC 33137 (305) 576-6492 (305) 577.6444 Nome of the 1990 NBA All -Star Weekend 903 1Z _1 r -... (a) Two (2) residents fron the,Overtown community. (b) Two (2) members of the clergy. (c) Two (2) representatives from the Operator (as defined herein). (d) Two (2) representatives from the Foundation. (e) Two (2) representatives selected from the City. (f) One (1) representatives from the business community. (g) One (1) representative from the youth of the community. (This person should be under the age of 25 years of age.) The excecutive board shall, at all times be chaired by the Foundation. The executive board shall. approve the annual budget and plan submitted by the Operator. Removal of the -1 Operator, as well as approval of a new Operator, shall - in each instance, require a three fourths (3/4) affirmative vote of the executive board. 4. OPERATOR: The initial Operator for the community center shall be The Boys Clubs of Miami, Inc., a non-profit Florida corporation. The operator shall be responsible for - the day-to-day operation of the community center in accordance with the rules and regulations to be promulgated by the Operator and approved by the executive hoard. The operation of the community center will not interfere with the day-to- day operation and use of the Center by students at Douglas Elementary School. The Operator shall be responsible to pay for all operating expenses of the Center and to _ maintain, repair and replace any of the facilities within the community center and shall maintain the same in a good state of repair, in clean condition at all times. The Operator shall be responsible for proper an.d adequate super- vision and control of the use of the community center at all times. The Operator shall have the financial capability to operate and maintain the community center without financial aid from either the Foundation or the City. The Operator will not charge a general membership fee to any person to become a member of the community center. 5. FOUNDATION GUARANTY: The Foundation., at the request of Coimmissioner Dawkins, will guaranty that the community center will operated at no cost to the city for a minimum of five years from the date that it opens to the public. Once we have agreed on the general outline, we can then proceed with the perparation of specific documents. We would appreciate hearing from you at your earliest convenience. VII. February 28, 1990: The Heat Foundation made a presentation to the meting with the City Manager and Overtown Advisory Board explaining the plan for the Athletic Complex. VIII. March 1, 1990: The Executive Committee of the Overtown Advisory Board, Inc. issued a press release expressing pleasure about Heat Community Foundation's commitment to Overtown. However, it again restated its opposition to the use of Gibson Park for two reasons: i. Such use would detract .from the memory of the life and work of the late City Commissioner the Rev. Canon Theodore Gibson. ii. The Overtown community would lose a park instead of gaining another badly needed recreational facility. IX. March 14, 1990: Reginald Richardson sends a letter to Donald F. Benjamin, Interim President of the Overtown Advisory Board, stating that Gibson Park had already been given to him by the City of Miami to develop and construct the athletic complex and that the "fight" was between the Overtown Advisory Board and the City of Miami regarding the choice of Gibson Park. As a result, another meeting was set up with the Heat and the City Manager and the Overtown Advisory Board because the entire Board supported the position of the Executive Committee. page 3 of 3 - OAB Schedule of Information XI. March 20, 1990: The City Manager called another meeting with the Overtown Advisory Hoard and the Heat Community Foundation to review progress. It was agreed at the meeting to look at sites other than Gibson Park. XII. March 22, 1990: The City Manager and the Overtown Advisory Board visited one site which appears to be suitable (not Gibson Park). XIII. April 12, 1990: A public hearing before the City Commission was set for April 26, 1990 to execute a letter of agreement with the Heat Foundation should Gibson Park be chosen as the site for the facility. XIV. April 23, 1990: A community meeting was held in Gibson Park for the community to express its will about the location. It is reported that there were five speakers who spoke against the Gibson Park location. All speakers are members of the Overtown Advisory Board,Inc. NB It should be carefully noted that in September 1989 the City of Miami gave to the Heat Community Foundation free access to use Gibson Park for the facility. The Overtown Advisory Board, inspite of City of Miami Resolution 82-645, had advised the City of Miami against such an action since June 1989. It is almost amusing to note how the City of Miami has been making fools of the members of the Overtown Advisory Board by pretending to be meeting in earnest to decide on a location for the Heat Athletic Complex when in fact is already a "done deal." Whatever happened to the commitment of the City of Miami to Overtown in Resolution 82-645 of 1982? SECRETARIAT We suggest that you advise your staff to consider space other than Gibson Park, and we also suggest that you encourage your staff and The Heat to demonstrate at least a little respect for the community by initially consulting with us on matters pertaining to Overtown. It is of extreme importance for us to have a sense of ownership and belonging. Inclusion can make a difference in establishing peoplehood. It is my understanding that the commitment from the foundation is to provide a physical structure which will include, but not be limited to, a basketball court, classroom facilities, and related services. IA order to facilitate this very generous overture by the Heat Foundation, it was requested that the City of Miami provide the physical site (land) at no cost to the Heat Foundation to construct a community athletic complex. A more specific site designation can be made upon receipt of your architect's technical drawings and renderings of the facilities land needs. Provided that we can come to a satisfactory arrangement as to the 1) park management 2) park maintenance, and 3) management and design of non- structural recreation facilities (track, football field, swimming pool, etc.), I would not be opposed to recommend to the City Commission that we would consider developing a specific Adopt -A - Park program that would be tailored to the Miami Heat Community Foundation's commitment. Benjamin - (305) 373-0881 At a meeting of the Executive Committee of the Overtown Advisory Board, Inc. great concern was expressed regarding the plans that were being developed by the Miami Heat for using the Theodore Gibson Park in Overtown to build a facility for the Heat and the Community. The City Manager recently invited the OAB to meet with him and representatives of the Heat in order to ensure that there was understanding and support for the effort. While the OAB is pleased with the commitment that the Heat has made regarding Overtown, the Board has never supported the conversion of the Theodore Gibson Park from its present use as a park to that of a building which takes up all of the open space. "The Board has always felt that the Heat should erect its building on another location in Overtown, but. that it should work with the City of Miami to up -grade Gibson Park", said Mrs Anne -Marie Adker, Vice President of the OAB. Mr Donald F. The Committee fully agreed with these opinions and has planned to meet with the City Manager and, hopefully, Ted Arison and Lou Schafell of the Heat to urge them to do what is necessary to up -grade the Gibson Park and to enhance its image and the symbol of the late City Commissioner ibson. However, the Heat should find another site. The community cannot afford to lose a park. The OAB feels that there are several sites in Overtown that can .be used to build the facility which the Heat is planning. We feel compelled to clear up an obvious misconception on the part of the Overtown Advisory Board and yourself. When the MIAMI HEAT and its players committed to build a Community Center for the children of Overtown, all that we asked from the City of Miami was that they to designate a parcel of land for us to build on. Nothing more. We are going to fund this project totally independent on any out- side interests. The City of Miami offered us Gibson Park. They could have offered us any parcel of land. We gave the City of Miami no criteria or rules to follow. The City, under the direction of the City Manager, once again, offered Gibson Park to be the home of the Community Center. Please recall that this very issue was raised by you and Mrs. Adker at our last City CoYrnission appearance and that after hearing from all parties concerned, I was directed by the Commission go forward with the project with Gibson Park as the site. My goal has always been to get the Community Center built as quickly as possible so the children of Overtown can benifit by having a state-of-the-art Community Center available to them in their community. The MIAMI HEAT players have stated their commitment to involve themselves and their wives in this wonderful project. Their commitment, along with many others who are committed will assure -that our children will have access to a unique and much needed resource.
