RESOLUTION NO.
A RESOLUTION EXTENDING FOR FORTY-FIVE DAYS
THE PERIOD DURING WHICH A BOND SHALL BE
POSTED FOR THE MONIES NEEDED FOR THE
INSTALLATION OF BARRICADES AT NORTHEAST 70TH
STREET, NORTHEAST 71ST STREET, AND NORTHEAST
72ND STREET AT THE ZONING DISTRICT BOUNDARY
LINE LOCATED AT THE EASTERLY SIDE OF BISCAYNE
BOULEVARD IN THE CITY OF MIAMI AND
ELIMINATING THE REQUIREMENT THAT A BOND BE
POSTED TO GUARANTEE THE MAINTENANCE OF THE
AFOREMENTIONED BARRICADES.
WHEREAS, a group of property owners has requested that the
City restrict vehicular access to certain streets within the
Bayside neighborhood; and
WHEREAS, the City Commission adopted Resolution No. 89-360
on April 13, 1989, authorizing for a 90-day trial period for
temporary barricades across Northeast 70th Street, Northeast 71st
Street and Northeast 72nd Street at the zoning district boundary
line located at the easterly side of Biscayne Boulevard in the
City of Miami, Florida, subject to certain conditions which have
been met; and
WHEREAS, the Police Department, Fire, Rescue and Inspection
Services Department, Solid Waste Department and Metropolitan Dade
County Public Works Department have evaluated the effects of the
vehicular access restriction upon their respective operations
during the 90-day trial period and have expressed no substantial
objections to the permanent restriction of vehicular access to
the aforesaid street provided that access for emergency vehicles
be allowed at all times; and
WHEREAS, Section 54-17 of the Code of the City of Miami,
Florida, gives the City Commission the power, after a properly
advertised public hearing, to require that vehicular access to a
particular street be prohibited where such prohibition is found
to be in the best interest of the public; and

WHEREAS, pursuant to due public notice, a public hearing was
held before the City Commission on January 11, 1990 as to any
objections to the permanent prohibition of vehicular access to
the aforesaid streets and no objections were sustained by the
City Commission; and
WHEREAS, the City Commission therein found that the
permanent prohibition of vehicular access to the aforesaid
streets is in the best interest of the public; and
WHEREAS, the City Commission adopted Resolution No. 90-0062
on January 11, 1990, directing that vehicular access to Northeast
70th Street, Northeast 71st Street and Northeast 72nd Street at
the zoning district boundary line located at the easterly side of
Biscayne Boulevard in the City of Miami, Florida, be permanently
prohibited providea that the .following conditions occur:
a) that the residents secure and post a bond with the
Public Works Department within one hundred twenty (120)
days from the date of this Resolution, for the monies
needed to install and maintain the aforementioned
barricades in the amount of Thirty Thousand Dollars
($30,000.00); and
b) that the design of the barricades by approved by the
Fire, Rescue and Inspection Services Department, the
Police Department and the Public Works Department; and
c) that all of the barricades be installed by licensed
contractors retained by the Public Works Department
after posting of the bond, as set forth in Paragraph
(a) above;
and
WHEREAS, the property owners failed to secure and post the
required bond within one -hundred -twenty (120) days from the date
of Resolution No. 90-0062; and

WHEREAS, a group of property owners proposed to the City an
alternate design for the aforementioned barricades which design
was approved by the Fire, Rescue and Inspection Services
Department, the Police Department and the Public Works Department
and the cost of which is estimated at Six Thousand Dollars

($6,000.00); and
WHEREAS, the property owners requested that the City reduce
the amount of the bond required to guarantee the installation and
maintenance of the aforementioned barricades from Thirty Thousand
Dollars ($30,000.00) to Six Thousand Dollars ($6,000.00); and
WHEREAS, pursuant to due public notice, a public hearing was
held before the City Commission on May 24, 1990 to consider the
property owners' request that the aforementioned bond be .reduced
from Thirty Thousand Dollars ($30,000.00) to Six Thousand Dollars
($6,000.00); and
WHEREAS, the City Commission after careful consideration of
the property owners' request on this matter, deems it advisable
and in the best interest of the public to deny the property
owners' request and to grant inotead an extension of forty-five
(45) days for the residents to secure and post the aforementioned
bond and the elimination of the requirement that the required
bond guarantee the maintenance of the barricades;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section I. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. It is hereby directed that the period during
which the residents shall secure and post a bond with the Public
Works Department for the monies needed to install the barricades
as set forth herein in the amount of Thirty '_housand Dollars
($30,000.00) be extended for a period of forty-five (45) days
from the date of this Resolution.

Section 3. it is hereby directed that the requirement
that a bond be posted to guarantee the maintenance of the
barricades be eliminated.
Section 4. This Resolution shall become effective
immediately upon its adoption.
