RESOLUTION NO.
A RESOLUTION AUTHORIZING AN INCREASE IN THE
CONTRACT AMOUNT OF $60,000, IN THE CONTRACT
BETWEEN THE CITY OF MIAMI, FLORIDA AND SIGMA
CONSTRUCTION AND ENGINEERING CORP., DATED
FEBRUARY 20, 1990, FOR THE DEMOLITION OF
FORMER INCINERATOR NO. 1, CAPITAL IMPROVEMENT
PROJECT NO. 311018, SAID FUNDS TO BE PROVIDED
FROM THE CAPITAL IMPROVEMENTS ORDINANCE NO.
10642, WITH FUNDS ALREADY ALLOCATED TO THE
PROJECT; FURTHER RATIFYING THE CITY MANAGER'S
WRITTEN FINDING THAT THE HEREIN INCREASE
RESULTED FROM EMERGENCY CIRCUMSTANCES BY AN
AFFIRMATIVE VOTE OF FOUR -FIFTHS OF THE
MEMBERS OF THE CITY COMMISSION, AND ADOPTING
THE FINDINGS AND CONCLUSIONS SET FORTH IN THE
PREAMBLE OF THIS RESOLUTION.
WHEREAS, there exists a contract, dated February 20, 1990,
between the City of Miami, Florida and Sigma Construction and
Engineering Corp. for DEMOLITION OF FORMER INCINERATOR NO. 1,
Capital Improvement Project No. 311018; and
WHEREAS, an increase in contract of $60,000 is required to
cover the cost of removing and disposing of asbestos containing
material that has been found in the roof, floor tiles and piping
.insulation inside the incinerator building which must be removed
from the building before the demolition can proceed; and
WHEREAS, the City Manager has made a written finding that a
valid emergency existed for the work to be done; and
WHEREAS, the Director of the Department of Public Works
recommends the increase in contract to cover the additional
costs; and
WHEREAS, funds to cover the increase are available from
money already allocated to the project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. After a properly advertised public hearing,
the finding of the City Manager set forth in the Preamble to this

Resolution is hereby ratified by an affirmative vote of four. -
fifths of the City Commission, and adopted as if fully set forth
in this Section.
Section 2. The contract between the City of Miami,
Florida and Sigma Construction and Engineering Corp. for the
Demolition of Former Incinerator No. 1, Capital Improvement
Project No. 311018, dated February 20, 1990, is hereby increased
by $60,000, with funds for the increase to be provided from
monies already allocated to the project. .,.
Section 3. This Resolution shall become effective 2
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the
attached resolution authorizing an increase in contract in the
account of 5,,,, O,OQO.nn in the contract between the City of Miami ,
Florida and Sigma Construction and Engineering Corp. for the
DE14OLITION OF FORMER INCINERATOR NO. 1 C.I.P. Oroject 1o.
said funds to be provided from the 1990 Capital Improvements
Ordinance No. 10661_ with funds already allocated to the project;
further ratifying the City +Manager's written finding that the
herein increase resulted from emergency ci rcurnstances ty an
affirmative vote of four -fifths of the members of the City
Commission and adopting the finding and conclusions set forth in
the preamble of this resolution.
3ACKGROUND:

Additional asbestos containing materials have been identified in
roofing materials, floor the and as insulation on piping inside

As required by City ordinances, an increase of $IJ,nOO or more in
a City contract must by accompanied by a finding by the City
'tanager that -the increase resulted from emergency circumstances,
and such a finding has been prepared and signed. It is further
required that a Public Nearing be held, and the Public Nearing
has been scheduled.

Based on i nformati on suppl i ed to me by the Di rec for of the
Publ is Works Department, I have found that there exists an
emergency need for an increase in contract amount of
S60,000.00 in the contract between the City of li ami ,
Florida and Sigma Construction and Engineering Corp, for the
Demolition of Former Incinerator No. 1.
The reason for the emergency need is as follows:
