A RESOLUTION APPROVING THE CHIEF PROCUREMENT OFFICER'S DECISION TO REJECT THE PROTEST RECEIVED FROM NATIONAL ECONOMIC RESEARCH ASSOCIATES, INC. IN CONNECTION WITH THE REQUEST FOR PROPOSALS FOR A MINORITY/WOMEN OWNED BUSINESS ENTERPRISE'S DISPARITY REPORT AND MINORITY/OWNED BUSINESS UTILIZATION PLAN. WHEREAS, in connection with the Request for Proposals for a Minority/Women Owned Business Enterprise's Disparity Report and Minority/Owned Business Utilization Plan, determined by the Chief Procurement Officer in his role as the arbiter of bid protests, pursuant to Section 18-56.1 of the City Code, as am nled, that the protest filed by National Economic Research Associ tes, Inc. be rejected as it lacks merit for the reason set forth below; and WHEREAS, the reason that this protest lacks merit is that in rating the proposals the firm of National Economic Research Associates, Inc. was not one of the three top proposals and therefore not invited to interview with the Selection Committee; and WHEREAS, the Chief Procurement Officer's rejection has been approved by the City Manager and the City Attorney; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The Chief Procurement Officer's rejection of the protest received from National Economic Research Associates, Inc., in connection with the request for proposals for a Minority/Women Owned Business Enterprise's Disparity Report. and Minority/Owned Business Utilization Plan, is hereby approved. Cesar REFERENCES: City Manag ENCLOSURES: _ i RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution approving the recommendation from the Chief Procurement Officer and concurred by the City Manager to reject the protest received from National Economic Research Associates, Inc. BACKGROUND: The submission of proposals by various firms were reviewed based upon the factors identified in the RFQ document. Utilizing these categories, proposals were rated from lowest to highest by the Director of the Office of Minority/Women/Business Affairs and the top three firms were invited to interview with a selection committee. Although this firm was rated as "well qualified," three other firms were rated "very well qualified" And were considered superior to this proposal. The protest was reviewed by the Chief Procurement Officer and found without merit. This finding was approved by the City Manager and was duly notified to National Economic Research Associates, Inc. ODIO City Manager I, as Chief Procurement officer of the City of Miami, have read your bid protest, talked with the employees involved in the issue and reviewed the pertinent documents. Pursuant to my duties under Section 18-56.2, City of Miami Code, I have determined that your bid protest is without merit for the reasons set forth below. The City Manager and the City Attorney have approved my determination.
