RFnK)1,(_.TTT(�T NO.'9 O — 3 3 6 A RESOLUTION AUTHORIZING TliE PURCHASE OF INTC)XILIZER EQUIPMENT AND TWO ELECTRONIC MEASURING DEVICES; AND ALLOCATING FUNDS THEREFOR, IN AN AMOUNT NOT TO EXCEED $33,000, FROM THE LAW ENFORCEMENT TRUST FUND, SUCH COSTS HAVING BEEN APPROVED BY THE CHIEF OF POLICE. WHEREAS, Florida State Statute 932.704(3)(a), as amended, authorizes the expenditure of forfeiture proceeds for law enforcement purposes not considered normal operating expenses; and WHEREAS, the City of Miami Police Department has been designated as a testing site for persons arrested for driving under the influence; and WHEREAS, the Health and Rehabilitative Services Department of the State has provided the Department with an Intoxilizer 500OR utilized for the testing of those arrested persons; and WHEREAS, it is the responsibility of the Department to obtain any and all additional equipment necessary to implement the program; and WHEREAS, additional Intoxilizer 5000R's are necessary in order to conduct the testing in different areas of the City; and WHEREAS, the Electronic Measuring Devices would be utilized in traffic accidents and fatality investigations; and WHEREAS, any equipment/services purchases will still be required to go through the established procurement procedures; and WHEREAS, the Chief of Police has recommended adoption of this Resolution and has determined that the expenditures proposed comply with Florida State Statute 932.704, as amended; and WHEREAS, funds to cover the necessary expenses required for this equipment are available in the City of Miami Law Enforcement Trust Fund; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORI DA : Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Odio City Manager DATE : 1 1 A( 14.1990 FILE SUBJECT . Resolution for the purchase of Intoxilizer Equipment and Two Electronic Measuring Devices REFERENCES: ENCLOSURES. It is respectfully recommended that a Resolution be passed for the purchase of Intoxilizer Equipment, at an estimated cost of $30,000, and two Electronic Measuring Devices, at an estimated cost of $3,000. Funding is to be from the Law Enforcement Trust Fund. The Miami Police Department has become a testing site for persons arrested for driving under the influence. As a testing facility it is necessary that the Department purchase equipment to fulfill its obligations in the processing of prisoners. This program is being coordinated by the Health and Rehabilitative Services Department of the State. Health and Rehabilitative Services has supplied the Department with one piece of breath testing equipment, an Intoxilizer 5000R. It is the responsibility of the Police Department to obtain all. additional equipment. The Traffic Enforcement Unit will administer the testing in various locations within the City. The Enforcement Detail is also updating equipment needed for traffic accident and fatality investigations. The requested Electronic Measuring Devices would provide an, accurate measurement of vehicles and evidence at the scene of fatal traffic accidents and would measure the tinting on the Windows of vehicles. It is, therefore, recommended that the Resolution authorizing the purchase of Intoxilizer_ Equipment, at an estimated cost of $30,000, and two Electronic Measuring Devices, at an estimated cost of $3,000, funding to be from the Law Enforcement Trust Fund, Project No. 690001, Index Code 290904--996, be approved. 90- 336 C4 3 -1 AFFIDAVIT I, Perry L.
