ORDINANCE NO.
AN ORDINANCE OF THE CITY OF MIAMI, FLORIDA,
AUTHORIZING A BOND ELECTION TO BE HELD ON
SEPTEMBER 4, 1990, WITH RESPECT TO THE ISSUANCE
OF NOT TO EXCEED $30,000,000 LOCAL STREET AND
DRAINAGE IMPROVEMENT BONDS OF THE CITY OF
MIAMI, FLORIDA, AND THE LEVYING OF A TAX TO PAY
THE PRINCIPAL AND INTEREST THEREON;
ESTABLISHING A FORM OF THE NOTICE OF BOND
ELECTION; ESTABLISHING A FORM OF THE OFFICIAL
BALLOT FOR SAID ELECTION; AUTHORIZING CERTAIN
OFFICIALS OF THE CITY TO TAKE ACTIONS REQUIRED
IN CONNECTION THEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
SECTION 1. This Ordinance Is enacted pursuant to the
Charter of the City of MIamI, Florida, Chapter 166, Florida
Statutes, the Constitution of the State of Florida and other
applicable provisions of the law.
SECTION 2. Notice of the bond election heretofore called by
Ordinance No. 10738 to be held on Tuesday, September 4, 1990,
shall be published in two newspapers of general circulation
published on a daily basis in The City of Miami, Florida, at
least twice, once In the fifth week and once in the third week
prior to the week In which that election is to be held, the date
of the first publication In each of said newspapers to be at
least thirty days before said election, which notice shall be
substantially in the following form:

As provided by Ordinance No. 10738 duly adopted by the City
Commission of The City of Miami, Florida, on May 24 ,
1990, an election will be held on Tuesday,

For the purpose of submitting to the qualified electors of
The City of Miami, Florida, the following question:
"Shall bonds of The City of Miami, Florida, In
an aggregate principal amount not exceeding
thirty mll lion dollars ($30,000,000) be Issued
under the provisions of Ordinance No. 10738
for the purpose of paying the costs of LOCAL
STREET AND DRAINAGE IMPROVEMENTS in The City of
Miami, Florida, such bonds to be Issued at one
time or from time to time, and to mature at such
time and In such amounts as shall be
subsequently established by ordinance or
resolution of the City Commission, but in no
event longer than twenty (20) years from the
date of such bonds, to bear Interest at a rate
or rates not to exceed the maximum rate
permitted by Florida law and to be payable from
ad valorem taxes unlimited as to rate and
amount?"
Ordinance No. 10738 provides that for the prompt payment
of the principal of and Interest on each such Issue of bonds
there shall be assessed, levied and collected a separate tax,
without limitation as to rate or amount, on all taxable property
within the corporate limits of The City of Miami, Florida
(excluding homestead exemptions as required by applicable law),
over and above all other taxes authorized to be levied by The
City of Miami, Florida, sufficient to pay such principal and
Interest as the same respectively become due and payable. Each
such Issue of bonds shall be redeemable prior to their
respective maturities at such times and prices and under such
terms and conditions as may be established by subsequent
ordinance or resolution of the City Commission prior to the sale
and Issuance of each such Issue of bonds.
The polls at said election will be open from 7:00 A.M.
until 7:00 P.M. the same day.
The City of Miami, Florida, shall be authorized to Issue
any of said bonds If the herein question for the Issuance shall
be approved by a majority of the votes cast by the qualified
electors of The City of Miami, Florida, voting on such question.

Such bond election shall be held at the polling places In
The City of Miami, Florida, in the several election precincts
designated by the Board of County Commissioners of Dade County,
Florida as set forth below, which are the same polling places as
for other elections of The City of Miami, Florida.

SECTION 3. A description of the registration books and
records which pertain to election precincts wholly or partially
within The City of Miami, Florida, and which The City of Miami,
� Florida Is adopting and desires to use for holding such special
eclal
bond elections Is as follows:
All registration cards, books, records and certificates
pertaining to electors of The City of Miami, Florida and
established and maintained as official by the Supervisor of
Elections of Dade County, Florida, in conformity with the
provisions of the general laws of the State of Florida are
hereby adopted and declared to be, and shall hereafter be
recognized and accepted as, official registration cards, books,
records and certificates of The City of Miami, Florida.
SECTION 4. Since The City of Miami, Florida has established
the permanent registration system under state law, and the
general election laws of the State of Florida require fourteen
(14) days prior approval by the Board of County Commissioners of
Dade County, Florida, for acceptance of branch office
registration and that the registration books be closed thirty
(30) days prior to the date of such bond election, registration
for such bond election shall be at the office of the Supervisor
of Elections of Dade County, Florida, 111 N.W. list Street,
Miami, Florida.
SECTION 5. Said bond election shall be held at the polling
places in the several precincts, respectively, in The City of
Miami, Florida as set forth in the foregoing Notice of Bond
Election. Not less than twenty (20) days before said election
the City Commission shall designate the Inspectors of Election
j and Clerk of Election for each precinct and, at least fifteen

j (15) days before the election, shall publish the names of such
f Inspectors of Election and Clerk of Election in a newspaper of
general circulation published In The City of Miami, Florida.

SECTION 6. At qualified electors of ine City of Miami,
Florida, shall be permitted to vote in said election, and the
Supervisor of Elections of Dade County, Florida is hereby
requested, authorized and directed to furnish, at the cost and
expense of The City of Miami, Florida, a list of all qualified
electors residing in The City of Miami, Florida, as shown by the
registration books and records of the office of said Supervisor
of Elections, and to duly certify the same for delivery to and
use of the election of officials designated to serve at the
respective polling places in said election precincts.
SECTION 7. Matty Hirai, the City Clerk to The City of
Miami, Florida, is hereby designated and appointed as the
official representative of the City Commission of The City of
Miami, Florida, In all transactions with the Supervisor of
Elections of Dade County, Florida, in relation to matters
pertaining to the use of the registration books and the holding
of said election.
SECTION 8. The official ballot to be used at said election
shall be In full compliance with the laws of the State of
Florida with respect to absentee ballots and the use of Computer
Election System (CES), and shall be in substantially the
following form:

SECTION 9. For the question described above, electors
desiring to vote for the approval of said question shall be
Instructed to punch straight down with the stylus through the
hole next to the phrase "FOR THE MEASURE (For Bonds)" within the
ballot frame containing the statement relating to said question,
and electors desiring to vote against said question shall be
Instructed to punch straight down with the stylus through the
hole next to the phrase "AGAINST THE MEASURE (Against Bonds)"
within the ballot frame containing the statement relating to
said question.
SECTION 10. The City Clerk shall cause to be prepared
absentee ballots containing the question set forth In Section 8
above for the use of absent electors entitled to cast such
ballots in said election.
SECTION 11. This Ordinance shall become effective on
adoption upon second and final reading thereof.

I have just noticed that wording contained in Ordinance No. 10739, passed
and adopted by the City Commission on May 24, 1990, relating to the bond
election ballot question, states, in part, as follows:
"FOR THE MEASURE
(FOR BONDS).
AGAINST THE MEASURE
(AGAINST BONDS) rr
Your attention is drawn to F.S. 100.341 ("Bond referendum ballot").
I feel that in keeping with said statute, perhaps we would be well
advised to restate the question appearing in Ordinance 10739 as follows:
"FOR BONDS
AGAINST BONDS
I am aware of the fact that on bond issues, bond counsel usually drafts
the wording of the ballot question. Perhaps the City should remind them
in the future of this little directive -contained in the cited statute.
Personally, I would like to keep the ballot wording consistent. Kindly
let me have your input in this respect as soon as possible.

RECOMMENDATION:
It Is respectfully recommended that the City Commission adopt the
attached two (2) Ordinances for first reading providing for the
holding of a Bond Election in the City of Miami on
September 4, 1990, for the issuance of $30,000,000 Local Street
and Drainage Improvement Bonds.
BACKGROUND:
The Department of Public Works has completed a review of the
Clty's capital Improvement needs for local street rebuilding and
storm drainage expansion for fiscal years 1991-1997. It has been
determined that expenditures of $35,000,000 will be needed for
the projects shown on the attached list. The major portion of
these expenditures will finance the rebuilding of 50 miles of
local streets with an additional resurfacing of 220 miles. The
City has a total of 805 miles of streets .to maintain.
Approximately $25 million of the bonds will fund roadway surface
Improvements and $5 million will be used to construct storm
drainage facilities In connection with these Improvements. The
additional $5 million will be supplemented from Stormwater,
Utility Trust Funds to complete the roadway Improvement program
for a total of $35 million.
Delays in providing local street and drainage Improvements will
very likely result in continued flooding or poor drainage, and In
roadway deterioration which could necessitate costly rebuilding
rather than less costly resurfacing. Additionally, well
maintained streets are needed to support Miami's continued
growth, alleviate traffic congestion and, to comply with the
State's Growth Management Plan.
