HomeMy WebLinkAboutO-10736J-90-234 3/21/90 rr�� ORDINANCE NO. 10 7 `� 6 AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 10642, ADOPTED SEPTEMBER 28, 1989, AS AMENDED, THE CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE, BY INCREASING THE APPROPRIATION FOR THE EXISTING PROJECT ENTITLED "MORNINGSIDE STREET IMPROVEMENTS" IN THE AMOUNT OF $200,000 FROM 1984 STORM SEWER GENERAL OBLIGATION BONDS; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE. AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission adopted Ordinance No. 10642 on September 28, 1989, to establish appropriations for capital improvements, continue previously approved capital improvement projects, and establish new capital improvement projects to begin during fiscal year 1989-90; and WHEREAS, said Ordinance No. 10642 appropriated $2,400,000 for Morningside Highway Improvement; and WHEREAS, at the January 12, 1989 City Commission meeting, the City Commission approved a request from several property owners residing within the Morningside Highway Improvement District to make substantial changes to the existing design of the street improvements; and WHEREAS, said changes to the existing design required the re -engineering of a majority of the existing design plans and an increase in the amount of construction work required; and WHEREAS, the Metropolitan Dade County Department of Environmental Resources Management has established strict regulations to protect Biscayne Bay and is requiring extensive storm drainage system modifications to prevent polluted storm water from entering Biscayne Bay; and WHEREAS, it is now in order to increase the funds appropriated for the aforementioned project by $200,000 from 1984 Storm Sewer General Obligation Bonds to accomplish the Morningside Improvement; 10736- NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this section. Section 2. Section 1 of Ordinance No. 10642, The Capital Improvement Appropriations Ordinance adopted September 28, 1989 as amended, is hereby amended in the following particulars: 1/ "Section 2. The herein appropriations are hereby made for implementation of all municipal capital improvements of the City of Miami, including new capital improvement projects scheduled to begin during fiscal year 1989-1990. The herein appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriations of prior fund appropriations. The source of revenues to support the herein appropriations is hereby identified by fund and project with the project appropriations with revenues therefor being set forth for seven program (I-VII) areas based upon use or functional category within said areas, as follows: TOTAL APPROPRIATIONS ($ X000) VI. Al ordinances, or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of this section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. Manager Approval is DATE : ` ^ R 3 1990 FILE RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached ordinance amending Ordinance No. 10642, the City's Capital Improvement Appropriations Ordinance, to increase the appropriation for Morningside Highway Improvement, Project No. 341116. BACKGROUND: The Department of Public Works, in order to accomplish the rebuilding of streets within the Morningside neighborborhood, is proposing an amendment to the City's Capital Improvement Appropriations Ordinance No. 10642 to increase the appropriation for Morningside Highway Improvement, Project No. 341116, by $200,000. At the January 12, 1989 City Commission meeting, several property owners residing in the Morningside neighborhood requested that the City Commission approve major changes to the .existing design of the street improvements in the Morningside Highway Improvement District. The changes include storm drainage and roadway realignment, modifications of the materials and methods used during storm drainage and roadway construction and an increase in the amount of construction work required. The City Commission approved the request of the property owners and the Public Works Department complied by re -engineering the design plans and specifications. Morningside Highway Improvement was first included in the Capital Improvement Program in 1980. Since that time, the Metropolitan Dade County Department of Environmental Resource Management has established strict regulations to protect the water and sea life of Biscayne Bay. The regulations require extensive storm drainage system modifications to prevent polluted storm water from entering Biscayne Bay. The design plans and specifications have been modified and upgraded to provide for the protection of the environment.
