AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 10642, ADOPTED SEPTEMBER 28, 1989, AS AMENDED, THE CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE, BY INCREASING THE APPROPRIATION FOR SOUTHWEST 6th STREET STORM SEWERS, PROJECT NO. 352252, IN THE AMOUNT OF $105,000 FROM 1984 STORM SEWER GENERAL OBLIGATION BONDS; CONTAINING A REPEALER PROVISION, SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission adopted Ordinance No. 10642 on September 28, 1989, to establish appropriations for capital improvements, continue previously approved capital improvement projects, and establish new capital improvement projects to begin during fiscal year 1989-90; and WHEREAS, said Ordinance No. 10642 appropriated $600,000 for Southwest 6th Street Storm Sewers, Project No. 352252, to be utilized for the construction or modification of drainage facilities on Southwest 6th Street between Southwest 8th Avenue and Southwest 2nd Avenue; and WHEREAS, the Department of Public Works has expanded the scope of the project to alleviate drainage problems on Southwest 6th Avenue between Southwest 6th Street and Southwest 8th Street; and WHEREAS, the scope of the project was also expanded to retrofit the existing storm drainage outfall to the Miami River on Southwest 5th Street as required by Dade County's Department of Environmental Resources Management (D.E.R.M.); and WHEREAS, competitive bids were received for Southwest 6th Street Storm Sewers on March 13, 1990 and based on the lowest acceptable bid submitted by M. Vila & Associates Inc., the total project cost will be $705,000; and WHEREAS, it is now in order to increase the funds appropriated for Southwest 6th Street Storm Sewers, Project No. 352252, in the amount of $105,000, from $600,000 to $705,000, in 10735 Storm Sewer General Obligation Bonds to enable a contract to be awarded to M. Vila & Associates Inc. for construction of said project; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section 1 of Ordinance No. 10642, as amended, adopted September 28, 1989, the Capital Improvement Appropriations Ordinance is hereby amended in the following particulars: l/ "Section 1. The herein appropriations are hereby made for implementation of all municipal capital improvements of the City of Miami, including new capital improvement projects scheduled to begin during fiscal year 1989-1990. The herein appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriations of prior fund appropriations. The source of revenues to support the herein appropriations is hereby identified by fund and project with the project appropriations and revenues therefor being set forth for seven program (I-VII) areas based upon use or functional category within said areas, as follows: TOTAL APPROPRIATIONS ($ X000) VII. Odio© ENCLOSURES: City Manager RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached ordinance approving an increase in appropriation for S.W. 6 Street Storm Sewers, Project No. 352252. BACKGROUND: The Department of Public Works, in a continuing effort to serve all residents of the City of Miami, is recommending the adoption of the attached ordinance increasing the appropriation for S.W. 6 Street Storm Sewers, Project No. 352252, by $105,000. Ordinance No. 10642, adopted on September 28, 1989, appropriated $600,000 for the S.W. 6th Street Storm Sewer Project. Competitive bids were received for the project on March 13, 1990. Based on the lowest acceptable bid submitted byp M. Vila & Associates Inc., the total project cost will be 5705,000. An additional $105,000 must be appropriated in* order to award a contract and proceed with construction. The additional $105,000 is available from the 1984 Storm Sewer General Obligation Bond Fund. The Drainage improvements on S.W. 6th Street originally proposed by the Department of Public Works are within the original $600,000 budget. The increase in project cost is directly attributable to the following increases in project scope which took place subsequent to the adoption of Ordinance 10642: 1. The Department of Public Works increased the scope of the project to alleviate drainage problems on S.W. 6th Avenue from S.W. 6th Street to S.W. 8th Street in response to citizen complaints. Approxima=e additional cost $42,000. 2. The Department increased the scope of the project to retrofit the existing storm sewer outfall to the Miami River at S.W. 5th Street as required by Dade County's Department of Enviropmental Resources Management (D.E.R.M.).
