ORDINANCE NO. 1.0732
AN EMERGENCY ORDINANCE ESTABLISHING A NEW
SPECIAL REVENUE FUND ENTITLED: "SUMMER FOOD
SERVICE PROGRAM FOR CHILDREN 1990" AND
APPROPRIATING FUNDS FOR THE OPERATION OF SAME
IN THE AMOUNT OF $248,678.00 CONSISTING OF A
GRANT FROM THE UNITED STATES DEPARTMENT OF
AGRICULTURE THROUGH THE FLORIDA DEPARTMENT OF
EDUCATION; AUTHORIZING THE CITY MANAGER TO
ACCEPT THE GRANT AWARD FROM THE UNITED STATES
DEPARTMENT OF AGRICULTURE AND TO EXECUTE THE
NECESSARY DOCUMENT(S), IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY, FOR THE ACCEPTANCE OF
THE GRANT AND IMPLEMENTATION OF SAID PROGRAM,
IN ACCORDANCE WITH APPLICABLE CITY CODE
PROVISIONS; CONTAINING A REPEALER PROVISION
AND A SEVERABILITY CLAUSE.
WHEREAS, the Florida Department of Education, Food and
Nutrition Management Division, with funding from the U.S.
Department of Agriculture, has agreed to allow the City of Miami
to participate once again in its Summer Food Programs; and
WHEREAS, said State agency will reimburse the City at a rate
of $2.0175 per summer lunch, and $0.5275 per supplement, which
the City provides to children within the parks of the City of
Miami; and
WHEREAS, each $2.0175 reimbursement will provide $1.87 for
operational and actual lunch cost, and $0.1475 for administrative
costs of the program, and each $0.5275 reimbursement will provide
$0.49 for operational and actual supplement costs, and $0.0375
for administrative cost of the program; and
WHEREAS, an estimated 97,332 lunches and 99,167 supplements
will be served during the project period starting June 25 and
ending August 24, 1990; and
WHEREAS, an estimated $248,678.00 will be received from the
State of Florida for carrying out said program;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
preamble to this Resolution are hereby approved, confirmed and
adopted by reference thereto and included herein as if fully set
forth in this Section.
Section 2. The following Special Revenue Fund is hereby
established and resources are hereby appropriated as described
herein:
FUND TITLE: Summer Food Service for
Children - 1990.
RESOURCES: Grant Reimbursements from the
United States Department of
Agriculture through the Florida
Department of Education. $248,678.00
APPROPRIATION: Summer Food Service Program
for Children - 1990 $248,678.00
Section 3. This appropriation is contingent upon the approval
of the City's application for said grant by the Florida Department
of Eduction and the City Manager's acceptance thereof.
Section 4. The City Manager is hereby authorized to accept the
grant as set forth in the Preamble to this Ordinance and to execute
the necessary document(s), in a form acceptable to the City Attorney,
and also to implement said program in accordance with applicable City
Code provisions.
Section 5. All Ordinances or parts of Ordinances insofar as
they are inconsistent or in conflict with the provisions of this
Ordinance are hereby repealed.
Section 6. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 7. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases
of goods and supplies, and to generally carry on the functions
and duties of municipal affairs.

Section B. The requirements of reading this Ordinance on
two separate days is hereby dispensed with an affirmative vote of
not less that four -fifths of the members of the Commission.
Section 9. This Ordinance shall become effective
immediately upon its adoption.

SUBJECT: Ordinance for the Summer
Food Service Program .for
Children 1990.

ENCLOSURES:
It is respectfully recommended that the City Commission adopt the
attached ordinance appropriating funds in the amount of $248,678.00
to be received from the United States Department of Agriculture to
conduct a summer food service program for youth aged 18 and under
from June 25, 1990 through August 24, 1990.
BACKGROUND:
Since 196.0 the City of Miami Department of Parks, Recreation and
Public Facilities has sponsored this program. The City of Miami has
provided a nutritional lunch program in conjunction with a recreatio-
nal program featuring arts and crafts, sporting activities, field
trips and special events. This year, we plan to serve up to 2,212
lunches and 2,253 snacks per day using thirty (30) sites throughout
the City.
The Florida Department of Education will reimburse the City at a
fixed rate of $2.0175 per lunch, and $0.5275 per snack. This rate
will provide sufficient funds to cover the lunch cost and hire up to
47 temporary, part-time recreation aides to operate the program.
It is recommended by the Department of Parks, Recreation and Public
Facilities that the attached ordinance be adopted at the Commission
meeting so that start-up funds can be expended to prepare for the
summer food program.
This Ordinance is being requested as an emergency measure so that
funds are in place for the start of the Summer Program on June 25,
1990.
NOTE: A resolution authorizing Metropolitan Dade County to select
a vendor(s) for the program is also being presented for City
Commission action.
