AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF
ORDINANCE NO. 9743, ADOPTED NOVEMBER 16,
1983, AS AMENDED, WHICH ESTABLISHED A .SPECIAL
REVENUE k'UND ENTITLED "PARK DEVELOPMENT
FUND", BY INCR.EkSING RESOURCES AND
APPROPRIATIONS TO SAID FUND 1N THE AMOUNT OF
$130,932; CONTAINING A REPEALER PROVISION AND
A SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 9743 on
November 16, 1983, establishing a special revenue fund entitled
"Park Development Fund", and
WHEREAS, said fund provided a perpetual .revenue fund account
into which private donations are to be deposited, and from which
appropriations will be made on an ongoing basis for park
development or. redevelopment projects, as well as for other bona
fide park improvements; and
WHEREAS, said fund was subsequently increased to a total of
$21,000 by Ordinance No. 10078, adopted March 6, 1986, and by
Ordinance No. 10233, adopted March 13, 1987; and
WHEREAS, since 1987, the City has received additional
donations and commitments of funds for park improvements
totalling $130,932, which must be appropriated before they can be
spent on designated and necessary improvements; and
WHEREAS, certain donors have requested that
improvements be made to designated parks immediately and the

Department of Parks, Recreation and Public Facilities wishes to
comply with their request;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Section 1 of Ordinance No. 9743, adopted
November 16, 1983, as amended, which established the Special
Revenue Fund entitled "Park Development Fund", is hereby amended
in the following particulars: l/

Section 2. This Ordinance hereby appropriates $130,932 in
private donations received for the purposes of defraying the cost
of park development and redevelopment projects, or for providing
local match requirements for state or federal grants for said
projects, or for other designated park improvements.
Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami and upon the further grounds of the necessity to make
the required and necessary payments and to generally carry out
the functions and duties of municipal affairs.

Section 6. The requirement of reading this Ordinance on
two separate gays is hereby dispensed with by an affirmative vote
of not less than four. -fifths of the members of the Commission.
Section 7. This Ordinance shall become effective
immediately upon its adoption.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the
attached legislation to amend Ordinance No. 9743 in order to
increase appropriations for the special revenue fund entitled
"Park Development Fund" by $130.932, which represents the amount
of additional donations and commitments of funds for park
improvements that the City has received since 1987.
BACKGROUND:
The Department of Parks, Recreation and Public Facilities has
prepared the attached legislation relating to donated funds for
park improvements. The Commission originally established the
"Park Development Fund" on November 16, 1983 by Ordinance No.
9743 in order to provide a source into which private donations to
the City could be deposited for the benefit of its park system.
These donations would then be appropriated for specific projects
and improvements on an as needed basis or as requested by the
donor. At the present time, appropriations to this fund amount
to $21,000, consisting of donations received prior to 1987, as
appropriated by Ordinances No. 10078 and No. 10233, adopted in
1986 and 1987 respectively.
Since 1987, the City has received additional donations and
financial commitments totalling $130,932 for park capital
improvements from private developers, neighborhood support groups
and festival sponsors. These have been detailed in the attached
table, which also shows the particular park in which the funds
are to be used, if so designated by either the donor or the City
Commission. The Commission was also given a report (copy
attached) in January 1990 which details donations received from
developers in 1989.
This ordinance is being presented as an emergency measure so that
funds are immediately in place for improvements to particular
parks pursuant to requests from the donors and involved community
groups, including: Marjorie Stoneman Douglas Park (North Grove
Neighborhood Association), Peacock Park (Coconut Grove Civic
Association, Coconut Grove Jaycees, and Coconut Grove
Association), and the park at "Golden Arms" (Silver Bluff
Homeowners Association).
