A RESOLUTION, BY AN AFFIRMATIVE VOTE OF
4/5THS OF THE MEMBERS OF THE CITY COMMISSION,
WAIVING FORMAL COMPETITIVE SEALED BID
PROCEDURES FOR CERTAIN SPECIFIED STRUCTURAL
REPAIRS AND IMPROVEMENTS TO THE ORANGE BOWL
STADIUM; RATIFYING, CONFIRMING AND APPROVING
THE CITY MANAGER'S FINDING THAT A VALID
PUBLIC EMERGENCY EXISTS JUSTIFYING SAID
WAIVER; AUTHORIZING THE CITY MANAGER TO
EXECUTE THE NECESSARY CONTRACTS, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, AND TO ISSUE
THE NECESSARY PURCHASE ORDERS FOR SAID
REPAIRS; ALLOCATING FUNDS THEREFOR IN AN
AMOUNT NOT TO EXCEED $500,000 FROM THE
CAPITAL IMPROVEMENT PROJECT NO. 404238,
ENTITLED "ORANGE BOWL MODERNIZATION PROJECT -
PHASE II".
WHEREAS, the Department of Conferences, Conventions and
Public Facilities and the Department of Public Works are making
preparations for the upcoming University of Miami football season
games at the Orange Bowl Stadium, which begin on
September 29, 1990; and
WHEREAS, the engineering firm of Urban Architects, Inc.,
which is presently under contract with the City for the Orange
Bow Modernization Project, has completed a structural study of
said stadium for said project; and
WHEREAS, said firm, with the assistance of the Public Works
staff, have identified certain structural repairs and
improvements to said stadium that are sufficiently hazardous so
as to require immediate attention prior to the start of the
.football season; and
WHEREAS, said repairs and improvements consist of the
sandblasting, repair or replacement, and repainting of structural
members in designated areas in the northeast and south sections
of the stadium, as well as the repair and/or removal of the
exterior facade at the west end of the stadium; and
WHEREAS, due to unforeseeable delays in the execution of a
contract with the University of Miami, timely implementation of

the work described herein, has n-Dt been possible; and
WHEREAS, sufficient time does not now exist for formal
competitive sealed bidding procedures and the completion of this
work prior to the first Hurricane football dame; and
WHEREAS, funds for said repairs and improvements are
available from the Capital Improvement Project No. 404238,
entitled "Orange Bowl Modernization - Phase II"; and
WHEREAS, the City Manager has made a written finding that
the immediate repair and improvement of certain stadium
structures and the procurement of the necessary services,
materials and/or equipment for same are necessary to safeguard
the property, welfare and convenience of the City, thus
constituting a valid public emergency and justifying the waiver
of formal sealed bid procedures; and
WHEREAS, Sections 18-52.5 and 18-52.6 of the Code of the
City of Miami, Florida, as amended, provides for the City Manager
to waive competitive sealed bidding requirements based on a
finding of an emergency and directs that such procurement be made
with as much competition is practicable under the circumstances;
and
WHEREAS, the herein resolution has been the subject of a
properly advertised public hearing before the City Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By an affirmative vote of four -fifths
(4/5ths) of the members of the City Commission, the City
Manager's finding that a valid public emergency exists justifying
the waiver of formal competitive sealed bid procedures for
certain specified repairs and improvements to the Orange Bowl
Stadium is hereby ratified, confirmed and approved.

said repairs and improvements are hereby waived.
Section 4. The City Manager is hereby authorized to
enter into the necessary contracts, in a form, acceptable to the
City Attorney, and to issue the necessary purchase orders for
said structural repairs and improvements.
Section 5. An amount not to exceed $500,000 is hereby
allocated from the Capital Improvement Project No. 404238,
entitled "Orange Bowl Modernization - Phase II", for this
purpose.
Section 6. This Resolution shall become effective
immediately upon its adoption.

Resolution for Repairs to
the Orange Bowl Stadium:
Emergency waiver
It is respectfully recommended that the City Commission adopt the
attached resolution which waives formal competitive sealed bid
procedures for certain structural repairs and improvements to the
Orange Bowl Stadium for the start of the 1990 football season,
based upon the City Manager's written finding that a valid public
emergency exists justifying such waiver. The resolution also
authorizes the City Manager to execute the necessary contracts
and issue purchase orders for the required goods and services
(construction, materials, and equipment) and allocates funds in
an amount not to exceed $500,000 from the Orange Bowl
Modernization Project — Phase II (C.I.P. No. 404236).
BACKGROUND:
The Department of Parks and Recreation has prepared the attached
legislation, working with the Departments of Conferences,
Conventions and Public Facilities and Public Works. Over the
last several months, staff has worked with the City Manager's
Office and others to resolve issues relating to significant
improvements to the Orange Bowl Stadium and long term agreements
with the major stadium users to assist in the financing of these
improvements.
With assistance of the Public Works Department, Urban Architects,
the architectural and engineering firm presently under contract
with the City for the Modernization Project, has completed a
study of the stadium structure. Together they have identified
certain structural areas which are sufficiently deteriorated so
as to require immediate attention prior to the start of the
Hurricane football season. The improvements would consist of the
sandblasting, repair or replacement, and the repainting of those
structural members designated in the northeast section and near
the south side press box. Additionally, the exterior decorative
facade at the west end of the stadium will be addressed.

Due to unforeseeable delays in the execution of the agreement
with the University of Miami, timely implementation of the
Modernization Project has not been possible. The proposed
emergency repairs would have otherwise been addressed as part of
this larger project. However, it is appropriate that these
repairs take place immediately before the heavy use period of the
stadium.
Can this basis, the City Manager has made a written finding
(attached) that these repairs constitute an emergency situation
requiring particular action to protect the health, safety and
welfare of residents and the convenience of the City. It is
further recommended that formal competitive sealed bid procedures
be waived for this work, in accordance with Sections 18-52.5 and
18-52.6 of the City Code.
By adoption of the attached, the City Manager would be authorized
to execute the necessary contracts and issue purchase orders for
the needed goods and services for this work in an amount not to
exceed $500,000. Funds in that amount are presently available in
the Orange Bowl Modernization Project (Capital Improvement
Project No. 404238).

Emergency Finding: Waiver
of Formal Bid Procedures for
Repairs to the Orange Bowl
This memorandum serves as the written finding of a valid public
emergency for certain structural repairs and improvements to the
Orange Bowl Stadium. These improvements consist of the
sandblasting, the repair or replacement, and the repainting of
those structural members designated in the northeast section and
near the south side press box, and repair or removal of the
exterior decorative facade at the west end of the stadium. This
finding is based upon the following:
* Structural members in the northeast section and near the
south side press box have been found to be in a severely
deteriorated condition during investigations for a recently
completed feasibility study.
* The exterior facade at the west end of the stadium has lost
portions of decorative concrete due problems with its
expansion joints.
* Said repairs and improvements have been included in the
Orange Bowl Modernization Project -- Phase II, however, due to
unforeseeable delays in the execution of the agreement with
the University of Miami, timely implementation of this
Project has not been possible.
* It is appropriate that these repairs take place immediately
before the heavy use period of the stadium, which begins on
September 29, 1990 with the first game of the University of
Miami Hurricane football season.
* Said deadline does not allow sufficient time to meet the
normal requirements of competitive sealed bid procedures.
Such conditions indicate the need for extraordinary measures to

procurement of goods and services (construction, materials,
and/or equipment) required for this project, pursuant to Sections
18-52.5 and .6 of the City Code.
