HomeMy WebLinkAboutR-90-0450J--90-460 5/30/90 RESOLUTION NO. 9 Q- 450 A RESOLUTION WAIVING, BY 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, .AFTER A DULY ADVERTISED PUBLIC HEARING, THE PROHIBITION CONTAINED IN CITY CODE SECTION 2-302 AS SUCH PROHIBITION APPLIES TO RICHARD P. DUNNE, WHO SERVES ON THE CITY'S ZONING BOARD, IN RELATION TO HIS TEMPORARY EMPLOYMENT AS A SENIOR COUNSELOR IN THE CITY OF MIAMI'S SUMMER YOUTH EMPI.,OYMENT AND TRAINING PROGRAM. WHEREAS, Richard P. Dunne is currently serving as a member of the Zoning Board of the City of Miami; and. WHEREAS, Richard P. Dunne seeks temporary employment with the City of Miami as a Senior Counselor in the City of Miami Summer. Youth Employment and Training Program; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The waiver set forth in Section 3 hereof is based upon the recitals and findings contained in Section 1 hereof and upon the following findings: a. The City of Miami desires to employ Richard P. Dunne, who is uniquely qualified to serve in a temporary position as a Senior Counselor in the City of Miami Summer Youth Employment and Training Program, which relationship would be in violation of City Code Section 2-302 were there not a waiver of the prohibition contained in said Section 2-302. b. The herein proposed transaction will be in the best interest of the City of Miami in operating the Summer Youth Employment and Training Program. Section 3. Od REFERENCES: City Commission Agenda City Manage dune 7, 1990 ENCLOSURES RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached resolution waiving, by 4/5ths affirmative vote, the prohibition contained in City Code Section 2-302 as such prohibition applies to Richard P. Dunne, who serves on the City's Zoning Board, in relation to his temporary employment as a Senior Counselor in the City of Miami Summer Youth Employment and Training Program. BACKGROUND The Department of Community Development has offered Mr. Richard P. Dunne a temporary position as a Senior Youth Counselor with the City of Miami Summer Youth Employment and Training Program. Mr. Dunne's educational background and experience will be an invaluable asset in providing direction to youth participating in the program. Mr. Dunne also serves a a member of the City's Zoning Board and a waiver of City Code Section 2-302 is required for him to commence employment with the City. The aforementioned section prohibits a member of a City Board to be employed with the City. Adoption of the proposed resolution waives, by 4/5ths affirmative vote, the prohibition contained in City Code Section 2-302 as such prohibition applies to Richard P. Dunne, who serves on the City's Zoning Board. The waiver will enable Mr. Dunne to accept temporary employment as a Senior Counselor in the City of Miami Sumner Youth Employment and Training Program.
