I would like the opportunity to address the city commission at the
next regular meeting on July 12th. 1990,with regards to a variance
of the Miami City code 4 53 - 48a. In brief,this ordinance is con -
cerned with fuel delivery by trucks on city owned property.
Since the closure of the Merrill Stevens, the cities greatest con -
sontration of pleasure and commercial vessels are without a
convienent source of fuel. Many of the smaller vessels would have
to expend 50% of there fuel capasity to use the available fuel
services or carry in fuel by hand and fuel at there slips in Dinner
Key area;this often presents fire and spilage hazards. Though the
spillage hazzard is minimal by each occurance,rollectively it will
have a great effect to the Bay and the marine environment.
I represent Dockside Fueling Service, a company that is experienced
In mobile fueling and conforms to all state and local guidelines.
This company is overwelmed with requests for fuel delivery at
Dinner Key and the Veric ramp location (the only deep water public
shore access in the Dinner Key area).During an attempt to fuel at
the Veric location they were ticketed for the above mentioned code
violation. A selective enforcement of this code,s.t this particular
location;Watson Island on the other hand recieves almost daily fuel
deliveries even when there is fuel commercially available on this
site.
The boaters of the Dinner Key need and want this service. It was
unforseen by all that the boatyard would grow into such a problem
that would effect the boaters of this area. Without a solution to
Merrill Stevens in sight,Dockside Fueling Service would hope for
your support in this variance request as well as the opportunity
to request the support of the city commision.

Sec. 53-46. Fire signal for vessels.
To minimize the dangers resulting from
ryes aboard vessels or on the dock areas, and
to provide early warning thereof, all vessels
shall use a fire signal. In addition, it is
mandatory that every operator or owner of a
vessel utilize $U fire warning devices or
alarms as may be furnished by the city. (Code

Sec. 53-47. Repairing, fitting out, etc.,
of vessels.
Routine maintenance and minor repairs
necessary for the preservation and seaworth-
iness of the vessel may be performed within
the marina. Major repairs may not be
performed at city marinas. Routine mainte.
nance and minor repairs are considered to be
those which.
(1) Do not disturb the public peace and
tranquility of any person aboard any
boat under the jurisdiction of the stadi-
ums and marinas department.
(2) Do not contribute to a disorderly or
unsightly appearance during the process
of repair or maintenance.
(3) Are capable of accomplishment with
hand tools or certain portable power tools
normally carried aboard the vessel.
(4) Are confined to the vessel.

with a fuel having a flash point lower than
one hundred ten (110) degrees Fahrenheit
with any person aboard, except such of the
crew as are necessary to perform the fueling
operation.

e. 53-49. Removal of vessels --For
cause.
The director of the stadiums and marinas
department may cause the removal of any
vessel from city marina property when it is
necessary in order to repair the dock, because
of a previous reservation, or for any good or
reasonable cause; and should the owner or
person in charge refuse to remove such a
vessel, the city, through the director, may
assess reasonable charges for the cost of
having the vessel moved. (Code 1967, 1 50.44)

The owner or captain of a vessel located at
a city marina or within a city yacht basin
shall remove or cause to be removed his
vessel from city property on or before
issuance -of hurricane warnings by the United

If any noncosnmereial vessel leaves its
assigned space for more than seventy-two
(72) hours, the city reserves the right to recent
this space while such space is known to be
vacant. The owner vacating such space shall
