A RESOLUTION, WITH ATTACHMENT, AUTHORIZING AND PERMITTING THE RESTRICTION OF VEHICULAR ACCESS TO CERTAIN STREETS AND URGING METROPOLITAN DADE COUNTY TO TAKE STEPS WHICH WILL RESULT IN THE INSTALLATION OF TRAFFIC REGULATORY SIGNS IN THE MORNINGSIDE NEIGHBORHOOD IN THE CITY OF MIAMI, FLORIDA, IN ACCORDANCE WITH PLAN "B"jal ON A NINETY (90) DAY TRIAL BASIS, SUBJECT TO CITY _ COMMISSION REVIEW AND PROVISIONS CONTAINED HEREIN; FURTHER DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE HEREIN NAMED OFFICIALS. WHEREAS, a group of property owners have expressed concern about undesirable traffic intrusion into the Morningside neighborhood; and WHEREAS, the property owners of the neighborhood have been divided with respect to the methods to be used to control vehicular traffic into the neighborhood; and WHEREAS, the City Commission adopted Motion No,, 89-995 on October 26, 1989, directing the administration to meet with members on the opposing sides with respect to the methods to be used to control vehicular traffic, namely, proponents and opponents to barricades in the Morningside area, and appointed the City Manager to present to the Commission a recommended traffic plan; and WHEREAS, the Department of Public Works has held a series of meetings with eight (8) designated representatives of the Morningside neighborhood representing both proponents and opponents of the barricades and have prepared a traffic control plan, hereinafter called "Plan B111/, that is acceptable to all designated representatives to be implemented on a ninety (90) day trial basis; and Plan "B" is attached for reference. - ,ATTACH M Is C0NTAIN�.� WHEREAS, the Department of Public Works will monitor the effects of traffic control Plan "B" and, with the consensus of all the designated representatives of the Morningside neighborhood, will modify the traffic plan as necessary, to determine the most efficient combination of traffic regulatory signs and barricades, to control undesirable traffic intrusion and provide adequate access into the neighborhood; and WHEREAS, the Police Department, Fire, Rescue and Inspection Services Department, Solid Waste Department and the Public Works Department have made recommendations on the proposed vehicular access restrictions contained in Plan "B: and have expressed no substantial objections to the proposed restrictions for a ninety (90) day trial period, provided that adequate ingress and egress access to Biscayne Boulevard and complete access for emergency vehicles be allowed at all times; and WHEREAS, Section 54-17 of the Code of the City of Miami, Florida, as amended, gives the City Commission the power, after a properly advertised public hearing to require that vehicular access to a particular street be prohibited where such prohibition is found to be in the best interest of the public; and WHEREAS, pursuant to due public notice, a public hearing was held before the City Commission on this date, as to any objections to the implementation of Plan "B" and the prohibition of vehicular access contained in Plan "B" and no objections were sustained by the Commission; and WHEREAS, the City Commission finds that the herein prohibition should be instituted for a ninety (90) day trial period to determine if Plan "B" and said prohibitions are in the best interest of the public; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: -z- gel- 486. If a Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2* It is hereby directed that the prohibition of vehicular access contained in Plan "B" in the Morningside neighborhood in the City of Miami, Florida, be implemented for a ninety (90) day trial period in accordance with the findings as set forth in Section 1 hereof provided that the following conditions occurs (a) the Morningside neighborhood residents shall secure and post a bond, 'cashier's check or irrevocable letter of credit with the Public Works Department within one hundred twenty (120) days from the date of this Resolution, for the monies needed for the complete installation, monitoring and maintenance of the temporary traffic regulatory signs and barricades required for the implementation of the aforementioned Plan "B" in the amount of Ten Thousand Dollars ($10,000.00); (b) the Department of Public Works shall design the temporary barricades; (c) all of the temporary barricades shall be fabricated and installed by licensed contractors retained by the City of Miami Public Works Department after the posting of the bond, cashier's check or irrevocable letter of credit, as set forth in Paragraph (a) above; (d) all of the traffic regulatory signs shall be subject to review and modification by the Metropolitan Dade County Public Works Department and their installation or rei:Soval shall be accomplished exclusively by said Department; and (e) any modifications to the locations of the barricades shall be accomplished exclusively by the City of Miami Public Works Department after obtaining the consensus of all the aforesaid designated representatives of the Morningside neighborhood. Section 3. In the event that the property owners do not post the required bond, cashier's check or irrevocable letter of credit within one hundred twenty (120) days from the date of this Resolution, the authority and permission granted by this Resolution shall be rescinded. Section 4. The City Manager is hereby authorized to advertise for informal bids for the purchase and installation of the barricades to facilitate the securing'of the Ten Thousand Dollar ($10,000.00) bond, cashier's check or irrevocable letter of credit by the property owners. Section 5. The City Clerk is hereby directed to transmit a copy of this Resolution to Joaquin Avino, County Manager, and Walter Herndon, Director of the Dade County Public Works Department. Section b. This Resolution shall become effective immediately upon its adoption. PASSED AND ADOPTED this 28th days of June , 1990. Od ENCLOSURES :mat Ion t City Manager RECOMMENDATION: The purpose of the June 28, 1990 public hearing Is to consider a Resolution authorizing a traffic control plan, Including vehicular access restrictions, In the Morningside neighborhood an a ninety (90) day trial basis, In accordance with the attached Plan "B". BACKGROUND: At the October 26, 1989 City Commission meeting a group of Morningside neighborhood residents expressed concern about undesirable traffic Intrusion into their neighborhood. The residents, however, were divided on the methods used to control vehicular access into the neighborhood, namely, the Installation of traffic barricades. The City Commission adopted Motion No. 89-998 directing the administration to most with the proponents and opponents of barricades in the Morningside area and arrive at a consensus on the traffic control plan for the neighborhood. The Public Works Department has held a series of meetings with eight (8) designated representatives from both sides of the barricade plan issue and has prepared a temporary traffic control plan acceptable to the designated representatives for a ninety (90) day trial period. The Public Works Department will monitor the traffic control plan during the trial period and with the consensus of all the designated representatives, modify the traffic plan as necessary to determine the most efficient combination of traffic regulatory signs and barricades. The Police Department, Fire, Rescue and inspection Services Department, Solid Waste Department and Public Works Department have been notified of the proposed vehicular access restrictions contained in the plan and letters were mailed to all property owners within the Morningside neighborhood notifying them of the June 28, 1990 public hearing. in addlticn a town meeting open to all residents of the Morningside neighborhood was conducted on June 18, 1990 at City of Miami Legion Park to discuss the proposed traffic plan. Page 1 of 2 v Honorable Mayor and Members of the City Commission As the City Commission noted at Its meeting of May 26, 1988, the City of Miami has no more funds available for neighborhood street closures. If the traffic control measures contained in Plan "B" are adopted by the City Commission, it Is respectfully recommended that their construction and maintenance be voluntarily financed by the residents of the Morningside neighborhood. The total cost for the Implementation of Plan "B" Is estimated to be $10,000.00. Page 2 of 2 90- 486
