A RESOLUTION APPROVING THE CHIEF PROCUREMENT OFFICER'S REJECTION OF A PROTEST RECEIVED FROM AVMARK, INC., IN CONNECTION WITH THE SELECTION OF CONSULTANTS FOR THE AIR TRANSPORTATION FACILITY AT WATSON ISLAND. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMIt FLORIDA: Section 1. The Chief Procurement Officer's rejection of a protest received from Avmark, Inc., in connection with the selection of consultants for the Air Transportation Facility at Watson Island having been approved by both the City Manager and the City Attorney is hereby approved. Section 2. The Chief Procurement Officer is hereby directed to furnish a copy of this Resolution to Avmark, Inc. Section 3. This Resolution shall become effective immediately upon its adoption. BACKGROUND: A protest was received from Avmark, Inc. and it was determined by the Chief Procurement Officer in his role as the arbiter of bid protests pursuant to Section 18-56.1 of the City Code that this protest lacks merit. The RFP requires, under Section III.A. (v) Contents of Submission, Proof of Incorporation for each firm as applicable and as provided by the State of Florida, Secretary of State. Based on their findings your Team has not been certified for this project. The following item contributed to this finding: The iYFP requires, under Section III.A.(v) Contents of Submission, Proof of Incorporation for each firm as applicable and as provided by the State of Florida, Secretary of State. Proof of incorporation with the State of Florida was not provided for the prime Consultant member of your Team. The foregoing omission in your response to the (AFp) is material in nature and is not subject to being corrected. The Committee's decision is final and not reviewable and this letter is to advise you that your proposal has been found to be non -responsive. Although we need to retain one copy of your proposal for our records, please let us know within one week of receipt of this letter, if you would like to retrieve the remaining copies. Pursuant to my duties under Section 15-56.4, City of Miami Code, I have determined that your bid protest is without merit for the reasons set forth below. The City Manager and the City Attorney have approved my determination. The reason your protest lacks merit is as follows: The RFP requires under Section III.A.(v) Contents of Submission on page 7, that the proposal must contain proof of Incorporations for each firm as applicable and as provided by the State of Florida, Secretary of State. Additionally, Section III, Submission Requirements, page 5, states that firms which are corporations, limited partnership and joint venture proposers must be currently recorded with the State of Florida, at the time of submission and copies of Certificates of Incorporation or limited partnership, from the State of Florida, Secretary of State, must accompany the submission.
