HomeMy WebLinkAboutR-90-0465J-90-500 6/22/90 A �+ RESOLUTION NO. 9 0— 4 6 5 A RESOLUTION AUTHORIZING THE CITY MANAGER OF THE CITY OF MIAMI, FLORIDA, TO EXPEND FUNDS TO PROVIDE A CASH ADVANCE PAYMENT, NOT TO EXCEED $42,000, FROM THE CITY'S EQUITY IN POOLED CASH AND INVESTMENTS TO THE WYNWOOD COMMUNITY ECONOMIC DEVELOPMENT CORPORATION ("WCEDC"), FOR PROFESSIONAL SERVICES IN CONNECTION WITH THE PREPARATION OF THE SAFE NEIGHBORHOOD IMPROVEMENT PLAN FOR THE WYNWOOD SAFE NEIGHBORHOOD IMPROVEMENT DISTRICT ("SNID"), SAID FUNDS TO BE REIMBURSED FROM A STATE OF FLORIDA SAFE NEIGHBORHOOD PROGRAM GRANT, FOR THE COMPLETION OF TASKS 2 AND 3 OF THE AGREEMENT BETWEEN THE CITY OF MIAMI AND THE FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS. WHEREAS, the City of Miami and the Wynwood Community Economic Development Corporation have acted as co -applicants and co -grantees on the application and award of the Safe Neighborhood Improvement Grant from the Florida Department of Community Affairs ("Florida DCA"); and WHEREAS, the City of Miami has authorized the formation of the Wynwood Safe Neighborhood Improvement District ("Wynwood SNID") pursuant to Sections 163.603-163.523, Florida Statutes and City Ordinance Nos. 10405, 10406 and 10533; and WHEREAS, the Wynwood SNID and the award of the Safe Neighborhood Improvement Grant from Florida DCA have at all times contemplated that the Wynwood Community Economic Development Corporation would provide necessary matching in -kind services for the award and assume responsibility to perform terms and conditions of Agreement No. 89-SN-17-11-23-20-011 between Wynwood SNID and the Florida DCA dated June 29, 1989 (the "SNID Agreement"), and the intentions of the parties are recorded in City of Miami Resolutions No. 88-1102, No. 38-1039, No. 89-677 and No. 89-677.1, and Dade County Resolution No. R-376-89; and B CITY COMIKY$S ox STING OF JUN 28 M g o - 465 0 WHEREAS, the Wynwood SNID shall at all times remain primarily responsible and shall at all times be the entity preparing and acting as the sole author of the SNID plan; and WHEREAS, Task 1 through Task 6 of the SNID Agreement have been completed by the Wynwood Community Economic Development Corporation and funds totalling $62,500 for completion of Task 1 of the SNID Agreement have been paid to the Wynwood Community Economic Development Corporation; and WHEREAS, the Wynwood Community Economic Development Corporation has experienced certain cash flow problems which have hindered its abilityto pay its subcontractors for work related to this project; and WHEREAS, the Wynwood Community Economic Development Corporation have requested a cash advance payment, not to exceed $42,000, from the City of Miami for completion of certain tasks related to the project; and WHEREAS, the City of Miami is desirous of expending funds to provide a cash advance payment for WCEDC's completion of Tasks 2 and 3 of the Wynwood SNID Agreement; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager of the City of Miami, Florida, is hereby authorized to expand funds to provide a cash advance payment, not to exceed $42,000, from the City's Equity in Pooled Cash Investments to the Wynwood Community Economic Development Corporation ("WCEDC") for professional services in connection with the preparation of a Safe Neighborhood Improvement plan for the Wynwood SNID, for completion of Tasks 2 and 3 of the Agreement between the Wynwood SNID and the Florida Department of Community Affairs. Section 2. The City will be reimbursed upon receipt of the State of Florida Safe Neighborhood Program Grant funds from the Florida Department of Community Affairs. Section 3. It is respectfully requested that the City Commission approve a cash advance payment in an amount not to exceed $42,000, to the Wynwood Community Economic Development Corporation for completion of certain task completion reports in connection with the preparation of the Wynwood Safe Neighborhood Improvement District Plan per, the attached resolution. 1-11.1101,10 :� ►� On December 7, 1989, the City Commission, in its capacity as the Board of Directors of the Wynwood Safe Neighborhood Improvement District (Wynwood SNID), approved a professional services agreement between the Wynwood SNID PEDc)he City") and the Wynwood Community Economic Development Corporation , in connection with the preparation of a Safe Neighborhood Improvement Plan for the Wynwood SNID, for a period of one year, in the amount of $250,000. The City Commission also authorized pa went of $62,500 of said funds to WCEDC for completion of Task 1 of six (6 tasks per the agreement between the Wynwood SNID and the Florida Department of Community Affairs (OCA). Since December, 1989, the WCEDC jointly with the Wynwood SNID ("The City") has completed the additional five (5) Task Reports which have been transmitted to DCA for its review and approval. DCA has not completed its review, therefore, no additional grant funds have been transmitted through the Wynwood SNID ("The City") to WCEDC. The resulting serious cash flow problem has hindered WCEDC's ability to pay its subcontractors for work related to this project. The WCEDC is now requesting a cash advance payment of $42,000 from the City of Miami. The cash advance payment will be funded through the City of Miami's Pooled Cash Fund; said monies would be reimbursed to the City upon receipt of the grant funds from DCA.
