ORDINANCE NO. 10 7 5 4
AN ORDINANCE RELATING TO NOISE ABATEMENT,
AMENDING CHAPTER 36 OF THE CODE OF THE CITY
OF MIAMI, FLORIDA, BY AMENDING SECTION 36-13,
PERTAINING TO CONSTRUCTION EQUIPMENT;
DELETING EXISTING SECTION 36-15 AND
SUBSTITUTING, IN LIEU THEREOF, A NEW SECTION
36-15 ENTITLED "MECHANICAL AND FIRE
EQUIPMENT"; CONTAINING A REPEALER PROVISION
AND SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of Maroh 7, 1990, Item No. 3, following an advertised hearing
adopted Resolution No. PAB 13-90 by a vote of 9 to 0,
RECOMMENDING APPROVAL of amending the City Code as hereinafter
set forth; and
WHEREAS, the City Commission after careful oonsideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to amend
the City Code as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Code of the City of Miami, Florida, is
hereby amended in the following partioulars:�`/

(b) Exoeption. The City manager is hereby
authorized to permit the operation and use of any of
the above oonstruotion maohinery during the aforesaid
prohibited periods of time in the event that suoh
operation or use is required to eliminate or reduoe any
dangerous or hazardous condition whioh endangers life
or property.
(o) Violation; penalty. Any person who shall
violate any provision of this seotion shall, upon
oonviotion thereof, be punished by a fine of not more
than five hundred dollars ($500.00) or imprisonment for
not more than sixty (60) days, or shall be both fined
and imprisoned_: eaoh 24-hour day is to be considered a

Section 2. All ordinances or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
Ordinance are hereby repealed.

phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective thirty
(30) days after adoption thereof.

PETITION
3. Consideration of amending Chapter 36. Noise of the
City Code by deleting existing Section 36-15 and
substituting in lieu thereof a new Section 36-15
entitled Mechanical and Fire Equipment, and amending
Section 36-13 pertaining to construction equipment.
(Items 2 and 3 are companion items).
REQUEST
To institute distance requirements and noise level
parameters for the purpose of attenuating noise from
mechanical and fire equipment.
RECOMMENDATIONS
PLANNING DEPT.
Approval.
BACKGROUND
This proposal addresses an omission in the City Code,
which uses an obsolete method of computing noise from
mechanical equipment so that it is difficult, if not
impossible, to answer complaints about noise from
mechanical equipment.
ANALYSIS
The amendment to the City Code will establish maximum
noise levels, daytime and nighttime, for all ;and uses
as measured at the property line of the receiving land
use and also provide revised controls for construction
equipment.
PLANNING ADVISORY BOARD At its meeting of March 7, 1990, the
Planning Advisory Board adopted Resolution
PAB 13-90 by a 9-0 vote, recommending
approval of the above.
CITY COMMISSION At it meeting of April 26, 1990, the City
Commission passed the above on First
