HomeMy WebLinkAboutO-10753J-90-211 3/13/90 ORDINANCE NO. 10753 AN ORDINANCE AMENDING ORDINANCE 9500, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, BY AMENDING ARTICLE 20 GENERAL AND SUPPLEMENTARY REGULATIONS, SECTION 2008 REQUIRED OPEN SPACES; DETAILED LIMITATIONS ON OCCUPANCY, BY ADDING A NEW SUBSECTION 2008.13 ENTITLED "NOISE AND DISTANCE LIMITATIONS: MECHANICAL EQUIPMENT"; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of March 7, 1990, Item No. 2, following an advertised hearing adopted Resolution No. PAB 12-90, by a vote of 8 to 0, RECOMMENDING APPROVAL of amending Ordinance No. 9500 as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 9500 as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 9500, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by amending the text of said ordinance as follows:l/ "ARTICLE 20. GENERAL AND SUPPLEMENTARY REGULATIONS Sec. 2008. Required yards and other required open spaces; detailed limitations on occupancy. Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. 1 ' 10753 f l 2008.12. Unenclosed swimming pools, tennis courts and other active recreational facilities. such as air conditioning compressors. pumps, exhaust fans,_ filters and other similar noise producing equipment is permitted on the walls, roof, or in windows or within the rear yard only if located at least ten (10) feet from the adjacent properry lines In commercial and _industrial districts, where yard areas and setbacks are required, said equipment and air exhaust discharge from such equipment shall not be installed within ten (10) feet. of adjacent property lines or within the width of the re ui ed yard or setback, whichever measurement is greater. In commercial and industrial districts, where no setbacks are required and buildings are built to the progertty line, no such equipment shall be installed within ten (10) feet, measured vertically from grade of the property line, and air discharge from such equipment shall be directed vertically upward from the discharge outlet In any event, such equipment shall not discharge exhaust air across a public sidewalk in any district. Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective thirty (30) days after adoption thereof. Consideration of amending Ordinance 9500, as amended, the Zoning Ordinance of the City of Miami, by amending Article 20 General and Supplementary Regulations, Section 2008 Required Yards and Other Required Open Space; Detailed Limitations on Occupancy, by adding a new Subsection 2008.13 Noise and Distance Limitations: Mechanical Equipment for the purpose of attenuating noise from mechanical and fire equipment such as exhaust fans. (Items 2 and 3 are -companion items). REQUEST To institute distance requirements and noise level parameters for the purpose of attenuating noise from mechanical and fire equipment. RECOMMENDATIONS PLANNING DEPT. Approval. BACKGROUND This proposal addresses an omission in the zoning ordinance. It does not have separation requirements so that plans examiners can examine construction drawings for the proper placement of mechanical equipment. ANALYSIS These proposed amendments to Zoning Ordinance 9500 will: require that mechanical and fire equipment in commercial and industrial districts where yards are required, be installed 10' from adjacent property lines and not within the yard or setback. Where no setback is required and the building is built at the property line, such equipment shall be located at least 10, vertically from grade and discharged vertically. require that mechanical equipment and fire equipment in residential districts be installed on walls, roof or windows or in the rear yard only if at least 10' from adjacent property lines. PLANNING ADVISORY BOARD At its meeting of March 7, 1990, the Planning Advisory Board adopted Resolution PAB 12-90 by an 8-0 vote, recommending approval of the above. CITY COMMISSION At it meeting of April 26' 1990; the City Commission passed the above on First Reading.
