hd RESOLUTION NO. $0.`. 546 A RESOLUTION, WITH ATTACHMENT, MAKING FINDINGS, AND DIRECTING THE PERMANENT PROHIBITION OF VEHICULAR ACCESS TO NORTHWEST 23 STREET, NORTHWEST 24 STREET, NORTHWEST 26 STREET, NORTHWEST 27 STREET AND NORTHWEST 28 STREET AT THE EASTERLY SIDE OF THEIR INTERSECTION WITH NORTHWEST 6 AVENUE, AND NORTHWEST 5 AVENUE AT THE NORTHERLY SIDE OF ITS INTERSECTION WITH NORTHWEST 22 STREET IN THE CITY OF MIAMI, FLORIDA, IN ACCORDANCE WITH THE WYNWOOD SAFE NEIGHBORHOOD PLAN; SUBJECT TO THE PROVISIONS CONTAINED WITHIN THIS RESOLUTION AND THE AVAILABILITY OF FUNDS. WHEREAS, in accordance with the provisions of the Safe Neighborhood Act, the Miami City Commission created the Wynwood Safe Neighborhood Improvement District by the adoption of Ordinance No. 10406 on March 24, 1988, as amended by Ordinance No. 10522. adopted on November 17, 1988; and WHEREAS, on June 7, 1990 the Miami City Commission passed Resolution No. 90-431 adopting the Wynwood Safe Neighborhood Plan and further, directed the administration to prepare legislation authorizing the permanent prohibition of vehicular access to certain streets identified in the Wynwood Safe Neighborhood Plan in the City of Miami, Florida; and WHEREAS, the Police Department, Fire, Rescue and Inspection Services Department, Solid Waste Department and Public Works Department have made recommendations on the proposed prohibition of vehicular access to certain streets identified in the Wynwood Safe Neighborhood Plan and have expressed no substantial objections to the proposed restrictions; and y WHEREAS, Section 54-17 of the Code of the City of Miami, Florida, gives the City Commission the power, after a properly advertised public hearing, to require that vehicular. access t,o.a. particular street be prohibited at an intersection or zoning district boundary line where such prohibition is fouAd to, be in the best interest of the public; and :.,.,-WHEREAS, pursuant to due public notice, a public hearing was .:`hetd `before the City Commission on June 28, 1990 as to any 66.3 ctions "to the permanent prohibition of vehicular access to certain streets identified in the Wynwood Safe Neighborhood Plan and: no objections of substance were sustained by the City Commission, accordingly, the City Commission has approved the prohibition of vehicular access of certain streets 11 identified in the Wynwood Safe Neighborhood Plan to be implemented on a permanent basis; and WHEREAS, the City Commission hereby finds that the herein prohibitions are in the best interest of the public; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in the Preamble to this Resolution are hereby adopted by reference theretoand incorporated herein as if fully set forth in this Section. Section 2. It is hereby directed that vehicular access to Northwest 23 Street, Northwest 24 Street, Northwest 26 Street. Northwest 27 Street and Northwest 28 Street at the easterly side of their intersection with Northwest 6 Avenue, and Northwest 5 Avenue at the northerly side of its intersection with N.W. 22 Street in the City of Miami, Florida, in accordance with the Wynwood Safe Neighborhood Plan, is permanently prohibited in accordance with the findings as set forth in Section 1 hereof, subject to the availability of funds. City Manager , 11 DAM JUL .:31990 .,«, SUsr6CT: Permanent Closure of Streets within the Wynwood Safe Neighborhood REFERENCEC: Improvement District ENCLOSURMResolution, Location Map RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution -authorizing the .permanent restriction of vehicular access, to streets contained in the previously approved Wynwood Safe Neighborhood Plan. BACKGROUND: The City. Commission passed Resol'ution'No. 90-431 on June 7 1990 adopting the Wynwood Safe Neighborhood Plan and further directed the administration 'to prepare legislation authorizing the permanent prohibition of vehicular access to certain streets contained in the Wynwood Safe Neighborhood'Plan. The Police Department, Fire, Rescue and Inspection Services' Department, Solid Waste Department and the Public Works Department have been notified of these vehicular access restrictions and have been requested to' evaluate the effects on their respective operations. All costs related to the installation of the vehicular access restriction barriers are contingent on a transfer of Community Development Block Grant funds at a City Commission Public Hearing on July 26, '1990.
