AN ORDINANCE CREATING A COCONUT GROVE SPECIAL EVENTS DISTRICT BOUNDED ON THE NORTH BY OAK AVENUE, ON THE SOUTH BY THE SHORELINE OF BISCAYNE BAY, ON THE EAST BY MARY STREET AND KENNETH MEYERS PARK, AND ON THE WEST BY MCDONALD STREET, COMMODORE PLAZA AND PEACOCK PARK; LIMITING THE NUMBER OF SPECIAL EVENTS HELD WITHIN SAID DISTRICT; CREATING AND ESTABLISHING THE COCONUT GROVE STANDING FESTIVAL COMMITTEE; ESTABLISHING A SUPPLEMENTARY USER FEE FOR SAID EVENTS; PROVIDING FOR A REPEALER PROVISION, SEVERABILITY CLAUSE; AND PROVIDING FOR INCLUSION IN THE CITY CODE. WHEREAS, on September 8, 1988, the City Commission adopted Motion No. 88-826, establishing an informal official Committee "to draft guidelines and make recommendations" to the City Commission in connection with special public events held in the Coconut Grove area of the City; and WHEREAS, said Committee held several public meetings in Coconut Grove eliciting and evaluating input from all interested groups and individuals who shared concerns over the impact of multiple events, including festivals throughout the year upon their lives and activities; and WHEREAS, the Committee with City Commissioner J. L. Plummer, Jr., serving as its Chairman has now proposed certain recommendations which merit favorable consideration; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Notwithstanding any City Code provision to the contrary, the following provisions shall be added to said Code: "Sec. 1. Coconut Grove Special Events District Created. A. There is hereby created a Special Events District bounded on the North by Oak Avenue, on the South by the shoreline of Biscayne Bay, on the East by Mary Street and Kenneth Meyers Park, and on the West by McDonald Street, Commodore Plaza and Peacock Park, said district to be known as the "Coconut Grove Special Events District." 10764 B. The following restrictions shall apply to the District: (1) There shall only be two events per month. The term "event", for the purpose of this Ordinance, is hereby def fined as an activity where any one of the following conditions occur within the Special Events District: (a) any selling of alcoholic beverages in the public right-of-ways, or in City parks, other than in lawfully permitted sidewalk cafes; (b) any pyrotechnics display; (c) (i) any temporary street closure, pursuant to Section 54-3 or Section 54-6 of the City Code; (ii) any partial use of streets which results in a partial obstruction of vehicular traffic for which City Commission approval is sought; (d) any parade or procession, other than funeral procession, of more than vehicles , floats, bands or marching units; (e) any temporary vending or concession permit conducted in the public right-of-ways or obtained pursuant to Section 38-45 of the City Code; or (f) any use of mechanical rides. (2) Only one of the two events may involve street closures. (3) The two events shall not take place on successive weekends. (4) The above restrictions do not apply to those events that have occurred previously in the Coconut Grove area; however, there shall not be more than twenty-four events per year, inclusive of those events. (5) Applications for events must be submitted to the department of community development at least 120 days prior to the date of the event but not earlier than 180 days prior to the event. (6) Priority dates will be given on a first come first serve basis to events that have occurred in the Coconut Grove area for five or more preceding years. City Attorney's note: This number has been left off since it is to be determined by the Police Department. 10'764 -2- C. The City Commission has the authority to waive or modify any of the above restrictions. Sec. 2. Coconut Grove Standing Festival Committee Created. A. There is hereby created and established the "Coconut Grove Standing Festival Committee". Use of the term "Committee" in this Section shall mean the Coconut Grove Standing Festival Committee. B. The Committee is to serve as an instrument of advice and recommendation to the City Commission. The Committee shall make recommendations to the City Commission concerning the expenditure of the Coconut Grove Special Events District Fund. C. The Committee shall consist of five (5) members. Each member of the Committee shall reside or have its principal place of business in the Coconut Grove area of the City of Miami and shall be an individual of outstanding reputation for integrity, responsibility and commitment to serving the community. One City Commissioner may be an ex-officio nonvoting member of the Committee. Each member of the City Commission shall appoint one member to the Committee. The terms of office of the initial membership of the Committee shall be as follows: Category A: Two (2) members shall be appointed to serve until the first Commission meeting following the 1991 regular City election. The Commissioners elected from Groups II and III shall each make one (1) nomination of an individual to serve as a member in this Category. Category B: Three (3) members shall be appointed to serve until the first Commission meeting following the 1993 City election. The Mayor and the Commissioners elected from Groups IV and V shall each make one (1) nomination of an individual to serve as a member in this Category. Upon expiration of each initial term, each successor member shall be named and appointed by the City Commission for a term of three ( 3 ) years, except that any person appointed to fill a vacancy due to the death, resignation or removal of any member of the Committee shall serve only for the unexpired term. The Committee shall select a chairperson from among its members and may create and fill such other offices as it may determine. The director of the community development department shall be the executive secretary of the Committee. D. At all meetings of the Committee, the presence of three members of the Committee shall constitute a quorum for the transaction of business, and each member shall have one vote on every issue submitted to a vote of the Committee. The act of a majority of the members present at a meeting at which a quorum is present shall be the act of the Committee. 10764 -3- 9 A The members of the Committee shall make and adopt bylaws and rules and regulations for the Committee's governance. The Committee shall hold regular quarterly meetings and may hold such other meetings as it deems necessary. All meetings of the Committee shall be public and written minutes of the proceedings thereof shall be maintained by the Committee. All actions taken at the meetings of the Committee shall be promptly and properly recorded. The official city policies relating to the attendance of regular board meetings shall be applicable to members of the Committee. It shall be the responsibility of the director of the department of community development to handle all procedural activities for all public hearings required to be held by the Committee, including the preparation of detailed minutes and official records of such hearings. The official records of such public hearings shall be filed with the city clerk. It shall be the responsibility of the executive secretary of the Committee to maintain records of other public meetings of the board. Records of such meetings shall be maintained in the office of the community development department. Sec. 3. Supplementary User Fee Established. There shall be a fee required for special events occurring within the Coconut Grove Special Events District as follows: (1) (a) The promoter of the event shall pay to the City a supplementary user fee of twenty-five percent of the estimated cost of the City's services for said event. This supplementary fee is in addition to the monies paid for the City's services fee. (b) In the event that the City services fee is lower or higher than the estimated cost previously given, either the City shall refund certain monies or the promoter shall pay to the City additional monies within thirty (30) days after the date of the event. (2) The supplementary user fee shall not exceed the amount of Ten Thousand Dollars ($10,000.00). (3) The supplementary fee shall be paid to the City ten (10) days prior to the event. (4) All revenues derived from said supplementary fee shall be deposited in an account known as the Coconut Grove Special Events District Fund and shall be utilized for the maintenance, improvement and beautification of Peacock Park and the Coconut Grove Special Events District, without reducing the otherwise normal allocation to the parks. 10764 -4- (5) The City Commission may waive all or part of the supplementary user fee." Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of the City of Miami, Florida. The sections of this Ordinance may be renumbered or relettered to accomplish such intention, and the word "ordinance" may be changed to "section," "article," or other appropriate word. Section 8. I was contracted by the Coconut Grove Chamber of Commerce in 1988 to coordinate and conduct the show to be upgraded in order to increase the attendance to visibly showcase the downtown Coconut Grove area. This festival brings many people to the area during the two days who contribute to the business activity, also many will be repeat visitors and customers. The success of the festival could not have been done without the assistance of the City of Miami Police, Fire, Maintenance, Solid Waste and other departments which I have increased the amount of services each year to meet the demands of the street closure, crowd control and whatever was suggested to me by various department heads. The sum of money is deducted from the proceeds of the show and goes directly to each individual department servicing the show. The remainder of the proceeds go to the Chamber to benefit the community. By requiring the additional 25% fee, I feel the committee will find it necessary to cut back on the City of Miami services to make up for the added financial obligation, which I feel will definitely not benefit the show or the area. Also some of the fee will be ultimately passed an to the artists who are at this time paying an amount in line with comparable shows. Increasing their fees will possibly eliminate some of the participants thereby causing a decrease in the amount of artists/money received by the Chamber. I sincerely hope that this situation can be settle so that the Banyan Festival can continue to be a benefit to the community as well as to the Coconut Grove Chamber of Commerce. I am very distressed about the proposed ordinance that includes road races in the same category as street festivals. I understand City of Miami wishing to limit the number of street festivals in Coconut Grove, but don't feel that road races should be included in this category. Road races do not impact Coconut Grove to the same extent as street festivals. All the road races take place in the early morning hours and are completed by 9:00 A.M. Miami Runners Club produces three road races in Coconut Grove out of thirty events annually. The cost of City services automatically limits the number of activities we can do in the Grove. Our organization is non-profit and any proceeds are used to give back to the community. We have extensive youth, handicapped, and fitness walker programs. Our services would be greatly curtailed if we were to be included in the proposed ordinance. Many runners plan their vacations around road races. I have participated in races in at least twelve different states. With as much negative press as Miami has received, there is no better way to showcase the City as tourists see many parts of Miami they wouldn't ordinarily see. I strongly urge you to exclude running events from this ordinance. Thank you for your consideration. I would be very disappointed if this were to happen. Coconut Grove is one of the few places left were there is still grass and vegetation - where there is still natural beauty. It is considered to be one of the best places in South Florida to run because of the bike lanes and sidewalks, as well as, the natural shade during most of the day. People from all over South Florida go to Coconut Grove for the festivals and to get away from the concrete jungle from which they live. I have been told that the second reading of the ordinance will be held at the commission meeting on July 12, 1990. I am writing to ask that you exempt from such ordinance running events which are held only in the early morning on weekends. The Miami Runners Club is one of the largest running organizations in the United States. Last year, the Road Runners Club of America, the largest national organization of running clubs in this country, held its annual convention in Dade County because of the tireless efforts of the volunteers of the Miami Runners Club. Our Club has an excellent reputation all over the country for the excellence of its programs and the dedication of its organization. This outstanding volunteer organization organizes and promotes 18 races a year around Dade County; operates a program called the Achilles Track Club for retarded and disabled persons in Dade County; and runs an outstanding track program in the summer for high school and junior high school kids. We pay all of the expenses of these races. The Miami Runners Club expects to receive 500 of its annual budget from the 3 races in the Grove, all of which would be affected adversely by the special events ordinance. Our most important race, the Baby Boomer Race, is held the first week of December and would have to be rescheduled. This race, together with the other two races, has been widely promoted all over the country and will attract runners from other countries. These events have been publicized worldwide by the Miami Runners Club. Why is it so important for running events to be held in the Grove? The Grove is naturally suited to running events. It has a special character which lends itself to creating the type of excitement which attracts runners to visit to compete. Because of South Florida's steamy climate, it is very important that running events be held early in the morning and in areas like the Grove with shaded streets. Another reason why the Grove is popular with runners is that traditionally the Grove has been the heart of the running movement and the physical fitness boom. I do not believe it would be wise to do anything to dampen the enthusiasm of organizations which are committed to advancing the public health and fitness. Many of Dade County's best runners train everyday in the Grove and have done so for many years. The Grove is a fine symbol of the physical fitness interest in Miami. The running events begin no later than 8:00 a.m., always on Saturday and Sunday mornings. The streets are cleared no later than 9:30 a.m. Always the events are short, (in the nature of 5k or 10k), and only involve a couple of the Grove's streets. They are operated professionally and use paid off -duty police officers for traffic control. The impact of these events on the Grove, as far as disruption to traffic and creation of noise is almost non existent. I have drafted a short provision which I believe would be appropriate to omit running events from the ordinance: Section 1: D. Morning running events are excepted from the terms of this ordinance. Other than his concern for his family and clients, his foremost interest is running. He was a college star and at age 43 runs in the major marathons throughout the United States. He will appear on behalf of the Miami Runners Club as an unpaid spokesman on the issue of an ordinance that could affect one of the finest activities we have in our community. He will request that the ordinance not apply to people running in an event in the Grove area during the hours of 8:00 a.m. to 10:00 a.m. on Saturday or Sunday. I totally endorse his proposal and am enclosing a list of a few of the many reasons in support of people being able to continue an activity that is one of the most positive things they could do. I wouldn't think of doing anything to restrict this effort anymore than I would ask our citizens not to walk at these times of the week. You can't jog or run if you are on drugs or alcohol. This is one marvelous activity in which we need to keep kids participating. I totally understand that festivals can be overdone, but I urgently suggest that you not put in the same category a twenty minute weekend morning race a few times a year. The runners and wheelchairs pay a small fee and do not ask for any money from the city. The majority of the money is raised privately so that the special off -duty police can be paid to protect both the traffic and the race. By including running events within the ordinance, you are effectively eliminating all foot races in Coconut Grove. Since these races start at 7:30 a.m. on the weekend and are over before retail stores open and traffic is a problem, it is not necessary to include these races within the ordinance. These races are important to the health and well being of thousands of runners who will. be denied the opportunity to run in Coconut Grove, should you include running events in this ordinance. I am writing in regard to the pending legislation limiting special events in the Grove to two a month. It is hard for me to believe that you are considering road races with the various other special events held in Coconut Grove. I feel that road races because of their nature and effect on Coconut Grove should be considered a separate issue for the following reasons. The road races are held early either Saturday or Sunday morning before many people are even awake. The cars and people usually out of here by late morning. II Road Closings This is a -big complaint of mine with most of the Grove special events. Living in Yacht Harbour I am very much effected. Not so with the road races. The races are held early in the A.M. (7:00-8:00) and usually the roads are accessible right after the race ends at very little inconvenience to the residents of Coconut Grove. III Drinking, Vendors. People Congestion During most of the special events vendors line the streets selling their wares the entire day (one to three days). Many of these vendors sell alcohol. At a recent special event held here, two different groups of people attending the special event jumped the fence to Yacht Harbour, entered the pool area and proceeded to use the facilities not in a quiet way. Vendors bring people to the Grove to buy therefore, causing congestion and often rowdy behavior. This is not the case with road races. The people who attend are runners and some spectators. The runners run the race, attend the awards 10 7 6 4 '_ , ceremony usually held in one location such as Peacock Park, and go home afterwards. There is no comparison with the noise of a road race and the noise of other special events held in the Grove. I have had to close my apartment some week -ends due to the blaring music that often lasts into the evening. Again, the music played at road races is short lived. I'd like to make one further comment. In my opinion, Coconut Grove has a reputation as a fairly physically active community. On any day of the week you can find people exercising (biking, walking, running) in the Grove. I've noticed it here more than in other surrounding areas. This I feel is a positive image for the Grove and road races go along with this image. Runners in general are = rowdy people. They are athletes who come to the Grove to compete in a race, relax after the race at a ceremony and leave shortly thereafter. For the above reasons, I feel that you should consider road racing as a separate issue and not combine it with the pending special events legislation. The street festivals (such as the Grove Art Show, Bed Race, Taste of the Grove, etc.) are either all —day or multi —day events which seriously alter traffic and lifestyles of local residents. Moreover, I am outright disgusted with the excuses that you have fabricated for passing such an ordinance which, in effect, would prohibit future running and walking events in the most attractive area of Miami, and alienate a part of the community who view and treat Coconut Grove with the highest respect. One reason that you have cited for the need for this ordinance is that during running events, we residents of Coconut Grove cannot leave our driveways and parking lots. Yet, I cannot remember one instance where I was held hostage In my residence due to any event that took place on or through the streets of the Grove. I admit that for Cat most) two hours I have to take an alternate traffic route when a running or walking event is in process. However, this minor Inconvenience is never in evidence after 10:00 a.m. Furthermore, the traffic Inconveniences that result from the runs and walks pale in comparison to the traffic, noise and crowd hassles my neighbors and I must accommodate during the Goombay Festibal and the Art Fair, two events that totally disrupt and reroute traffic throughout the Grove for entire weekends. You also allege that running and walking events are noisy. The only time and place that any inordinate noise occurs at these events is when instructions are given over a loudspeaker to the participants at the starting line and the starting horn. The only people who might be inconvenienced by this are the residents of high rise buildings along two blocks of Bayshore Drive. I seriously doubt that anyone living above a third floor can hear a loudspeaker at all, or that anyone is disrupted by a one -second blast of a starting horn. And these people are still welcome? Although I cannot agree with your plans to give events grandfathered rights, If you wish to include a "loyalty" provision as part of your ordinance, clearly the runners and walkers should receive favored status. Those who come to run and walk In the Grove, for both organized events and Just to meet their friends for a training run or walk, have done so for a number of years. They are truly loyal to the Grove out of respect for the area and its residents. The same cannot be said for those who only come to the Grove for an annual festival, and really don't care about the area until next year. As the elected leaders of the City of Miami, you have the duty to represent the interests and desires of all of its citizens. The Grove with its shaded streets and overall ambiance is a favorite of local and out of town athletes. As a local resident I understand and agree that some type of guideline or limitation should be placed on the type and amount of events which take place in the Grove. However, I am concerned that the running races which have been taking place will be forced to compete with events of a much greater magnitude for these two monthly slots. Running races such as The Baby Boomer and The Coconut Grove 5 Miler start early in the morning at 8:00 a.m., on Saturday Qg Sunday, not both. The races are finished by 9:30 a.m. at the latest. Streets are limited to traffic usually for only one hour as opposed to an art show or music festival which closes streets for an entire weekend. These running events promote fitness throughout the community, state, and in the case of The Baby Boomer, the nation. At the same time these races are promoting fitness IN Coconut Grove. this is a positive portrayal and promotion of which Coconut Grovites should be very proud. Also, following many of the running races, many participants spend the remainder of their day shopping and eating in the Grove. This is good for the economy of Coconut Grove. Please reconsider this pending proposal to limit all events to two per month and vote Ma. A better solution can be reached. A local resident, /� - J an A.
