ORDINANCE NO.
AN EMERGENCY ORDINANCE AMENDING SECTIONS 1,
21 3 AND 5 OF ORDINANCE NO. 10648, THE ANNUAL
APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR
ENDING SEPTEMBER 30, 1990, ADOPTED SEPTEMBER
28, 1989, AS AMENDED, FOR THE PURPOSE OF
IMPLEMENTING BUDGETARY ADJUSTMENTS TO COMPLY
WITH GENERALLY ACCEPTED ACCOUNTING PRINCIPLES
AS OUTLINED BY THE CITY'S EXTERNAL AUDITORS;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 10648,
the Annual Appropriations Ordinance, on September 28, 1989,
establishing revenues and appropriations for the City of Miami,
Florida, for the Fiscal Year ending September 30, 1990; and
WHEREAS, amendatory adjustments to the FY190 appropriations
ordinance are outlined below together with the explanation for
said adjustments; and
WHEREAS, a net increase of $3,112,000 has been identified
primarily from contributions from the Capital Improvement Fund,
Conference and Conventions reserve funds, General Obligation
Bonds interest earnings, and Cable Television retained earnings,
offset with revenue shortfalls from property taxes, contributions
from Property and Lease Management, and other items; and
WHEREAS, a savings of $2,000,000 is projected for FY190 in
Special Programs and Accounts; and
WHEREAS, the Police Department requires an additional
appropriation of $5,000,000 to cover costs associated with union
negotiated increases and increased hiring of sworn personnel; and
WHEREAS, the City Clerk's Office requires an additional
appropriation of $112,000 to cover increased costs related to the
November, 1989 City Elections; and
WHEREAS, a sum of $2,510,030 has been allocated in the
Utility Service Tax Special Revenue Fund to pay FY190 principal
and interest payments on the Certificate of Participation Notes
(COP); and
(COP) Notes.

WHEREAS, proper accounting principles require that the
aforementioned payment be made from the Fleet Management Division
of the General Services Administration Department rather than
charged directly to the Utility Service Tax Special Revenue Fund;
NOW, THEREFORE , BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Sections 1, 2, 3, and 5 of Ordinance No. 10468
adopted September 28, 1989, the Annual Appropriations Ordinance
for the Fiscal Year ending September 30, 1990, are hereby amended
in the following particulars 1
"Section 1. The following appropriations
are made for the municipal operation of
the City of Miami, Florida, for the
Fiscal Year 1989-90, including the
payment of principal and interest on all
General Obligation Bonds.

Section 2. The herein net increase in appropriations for
the General Fund in the amount of $3,112,000 consists of
$5,000,000 increase for the Police Department, a $112,000
increase for the City Clerk's Office, and a reduction of
$2,000,000 in Special Programs and Accounts.
Section 3. The herein net revenue increase of $3,112,000 to
the General Fund will come primarily from contributions from the
Capital Improvement Fund, Conferences and Conventions reserve
funds, General Obligation Bonds interest earnings, and Cable
Television retained earnings, offset with revenue shortfalls from
property taxes, contributions from Property and Lease Management,
and other items.
Section 4. The herein increase in appropriations for the
Fleet Management Division of the General Services Administration
Department in the amount of $2,510,030 is to pay principal and
interest payments for FY190 for the Certificate of Participation

this Ordinance are hereby repealed.
Section 7. If any section, part of section, paragraph,
clause, phrase, or word of this ordinance is declared invalid,
the remaining provision of this Ordinance shall not be affected.
Section 8. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases
of goods and supplies, and to generally carry on the functions
and duties of municipal affairs.
Section 9. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 10. This Ordinance shall become effective
immediately upon its adoption.

it is respectfully recommended that the City commission adopt the
attached ordinance making budgetary adjustments to comply with
generally accepted accounting principles as outlined by the
city's external auditors.
The Department of Budget has identified the need to make certain
budgetary changes to the FY190 Annual Appropriations Ordinance.
The reasons for these amendments are stated below.
A $5,000,000 increase in appropriations for the Police Department
is needed to cover costs associated with union negotiated salary
increases and increased overtime. A $112,000 increase in
appropriations to the City Clerk's Office is needed to cover
additional costs related to the November, 1989 City Elections.
An anticipated savings of $2,000,000 in Special Programs and
Accounts causes the net increase in General. Fund Appropriations
to be $311`1120000.
A net revenue increase of $3,112,000 has been identified
primarily from contributions from the Capital improvement Fund,
Conferences and Conventions reserve funds, General Obligation
Bonds interest earnings, and cable Television retained earnings,
offset with revenue shortfalls from property taxes, contributions
from Property and Lease Management and other items.
The appropriation for the Fleet Management Division of the
General Services Administration (GSA) is being increased by
$2,510,030 so that the FY190 principal and interest payments on
the Certificate of participation Notes can be charged directly to
GSA rather than the Utility Service Tax Special Revenue Fund
where the $28510,030 is currently allocated.
