ORDINANCE NO.
AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF
ORDINANCE NO. 10642, ADOPTED SEPTEMBER 28,
1989, AS AMENDED, THE CAPITAL IMPROVEMENTS
APPROPRIATIONS ORDINANCE, BY MODIFYING
CERTAIN FUNDING SOURCES FOR FIFTEEN PARKS AND
RECREATION PROJECTS AND BY INCREASING
APPROPRIATIONS TO THE PROJECT ENTITLED
"DOWNTOWN COMPONENT OF METRORAIL, STAGE II -
CONTRIBUTION", PROJECT NO. 343229, IN THE
TOTAL AMOUNT OF $2,100,000; APPROPRIATING
FUNDS THEREFOR FROM GUARANTEED ENTITLEMENT
REVENUE BONDS - FY'89; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 10642 on
September 28, 1989, appropriating funds for Capital Improvement
Projects; and
WHEREAS, said Ordinance included two (2) projects, "Hadley
Park - Pool Replacement" (Project No. 331349) and "City of Miami
Youth Center" (Project No. 331353) which utilize Guaranteed
Entitlement Revenue Bonds - FY'89 as a funding source in the
amounts of $2,100,000 and $3,000,000 respectively; and
WHEREAS, Federal guidelines require that 75% of the City's
Guarantee Entitlement Bonds sold in June, 1989, be spent within
18 months after being sold, or by December, 1990; and
WHEREAS, said Ordinance also appropriated funds for thirteen
(13) other park improvement projects which are detailed herein;
and
WHEREAS, the scope of work involved in said thirteen (13)
projects will permit the timely expenditure of the Guaranteed
Entitlement Revenue bonds within the schedule stipulated by the
federal guidelines; and

WHEREAS, it is thus recommended that $3,000,000 in the
Guaranteed Entitlement Revenue Bonds from the City of Miami Youth
Center Project be redistributed to said thirteen 13 Dark ( ) w k
projects in place of specific funds; and
WHEREAS, the City is also required to make an annual
contribution of $1,800,000 toward the construction of the
Downtown Component of Metrorail (Stage 2) under the Capital
Improvement Project No. 343229, starting in the current (FY 190)
budget year up to a total contribution of $7,200,000; and
WHEREAS, it is thus recommended that $2,100,000 in the
Guaranteed Entitlement Revenue Bonds from the Hadley Park - Pool
Replacement Project be reallocated to the project entitled
"Downtown Component of Metrorail, Stage 2 - Contribution"; and
WHEREAS, funds in the total amount of $5,100,000 will be
replaced in the Hadley Pool and Youth Center Projects upon the
issuance of new debt instruments;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby incorporated by reference
thereto and adopted as if fully set forth in this Section.
Section 2. Section 1 of Ordinance 10642, adopted
September 28, 1989, as amended, is hereby further amended in the
following particulars: 1/
"Section 1. The herein appropriations are hereby
made for implementation of all municipal capital
improvements of the City of Miami, including new
capital improvement projects scheduled to begin during
fiscal year 1989-90. The herein appropriations which
are hereby designated by reference to descriptive
project title and number also include appropriations
for previously approved scheduled projects as well as
reappropriations of prior fund appropriations. The
source of revenues to support the herein appropriations
is hereby identified by fund and project with the
project appropriations and revenues therefor being set
forth for seven program (I-VII) areas based upon use or
functional category within said areas, as follows:

words and/or figures shall be added. The remaining provisions are now in
effect and remain unchanged. Asterisks indicate omitted and unchanged
material. All figures are rounded to the nearest hundred dollars.

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchasers
of goods and supplies, and to generally carry on the functions
and duties of municipal affairs.
Section 6. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 7. This Ordinance shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the
attached ordinance to amend Ordinance No. 10642, the Capital
Improvements Appropriations Ordinance, by modifying certain
funding sources for fifteen (15) Parks and Recreation projects
and by providing an increase in the amount of $2,100,000 to the
Downtown Component of Metrorail, Stage II Project (No. 343229)
from Guaranteed Entitlement Revenue Bonds - FY189.

The Parks and Recreation Department has prepared the attached
legislation with the assistance of the City Manager's office and
the Finance Department. Its primary purpose is to adjust the
funding sources on several park projects, so that Guaranteed
Entitlement Revenue Bonds are placed into projects which have a
schedule of expenditures that meet the federal requirements.
Federal guidelines requires that 75% of the City's Guarantee
Entitlement Bonds sold in June, 1989, be spent within 18 months
after being sold, or by December, 1990. These bond proceeds are
currently appropriated to the Hadley Park - Pool Replacement
Project (No. 331349) and the Youth Center Project (No. 331353),
which have very extended schedules due to the level of community
involvement and scope of design and construction required.
'It is proposed that the Youth Center monies ($3,000,000) be
redistributed among thirteen (13) smaller park projects that are
expected to be completed in FY 190 and FY 191. Additionally, the
Hadley Pool monies ($2,100,000) would be moved into the Downtown
Metrorail Project, Stage 2 (No. 343229). The City is required to
make the first of four annual contributions in the amount of
$1,800,000 for this transportation project in this fiscal year.
Replacement funds in the total amount of $5,100,000 will be
placed into the Hadley Pool and Youth Center projects upon the
issuance of new debt instruments.
