HomeMy WebLinkAboutO-10758J-90-571 6/27/90 ORDINANCE NO. 10758 AN EMERGENCY ORDINANCE AMENDING SECTIONS 3 AND 5 OF ORDINANCE NO. 10648, THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1990, ADOPTED SEPTEMBER 28, 1989, AS AMENDED, BY INCREASING THE APPROPRIATION FOR THE GENERAL SERVICES ADMINISTRATION: FLEET MAINTENANCE DIVISION, IN THE AMOUNT OF $287,284 FROM CERTIFICATE OF PARTICIPATION NOTES FOR THE PURPOSE OF PURCHASING CITY VEHICLES; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 10648, the Annual Appropriations Ordinance, on September 28, 1989, establishing revenues and appropriations for the City of Miami, Florida, for Fiscal Year ending September 30, 1990; and WHEREAS, the City of Miami needs approximately $184,000 to purchase twenty-seven (27) new motorcycles; and WHEREAS, the remainder of the herein appropriation will be used in conjunction with previously appropriated funds to purchase new light fleet vehicles as needed; and WHEREAS, $287,284 of Certificate of Participation Notes are available to be used to purchase said additional vehicles; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Sections 3 and 5 of Ordinance No. i0648, adopted September 28, 1989, the Annual Appropriations Ordinance for the Fiscal Year ending September 30, 1990, are hereby amended in the following particulars: 1/ 1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. 1 10758 V , "Section 3. The herein appropriation of $287,284 from Certificate of Participation Notes is hereby approved for the purchase of motorcycles and other light fleet vehicles needed by the City of Miami. Section 3. All Ordinances or parts of ordinances insofar as they are inconsistent or in conflict with provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. -2- 10758 0 ra Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary payments to generally carry out the functions and duties of municipal affairs. Section 6. The requirements of reading this Ordinance on two (2) separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. Section 7. This Ordinance shall become effective immediately upon its adoption. ENCLOSURES: N RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached emergency ordinance appropriating $287,284 of Certificate of Participation Notes to be used by the General Services Administration Department to purchase twenty-seven (27) motorcycles and other light fleet equipment. BACKGROUND: The General Services Administration Department has determined that additional funds are needed to purchase twenty-seven (27) motorcycles and other light ,fleet vehicles and equipment for the City's fleet. This ordinance is beingpresented as an emergency ordinance to adhere to the adopted replacement schedule. Said acquisition will enhance. the department's ability to provide adequate service and: effectuate the department's overall goal in providing service in a timely and efficient manner.
