AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF
ORDINANCE NO. 10642, THE CAPITAL IMPROVEMENT
APPROPRIATIONS ORDINANCE, ADOPTED
SEPTEMBER 28, 1989, AS AMENDED, BY DECREASING
THE TOTAL APPROPRIATIONS TO THE CAPITAL
PROJECT ENTITLED "SOLID WASTE COLLECTION
EQUIPMENT - FY '90-91', PROJECT NO. 353010, IN
THE AMOUNT OF $195,445.00, SAID DECREASE BEING
MADE IN FUNDS AVAILABLE FROM PROCEEDS OF
CERTIFICATE OF PARTICIPATION NOTES; CONTAINING
A REPEALER PROVISION AND A SEVERABILITY
CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 10642 on
September 28, 1989, establishing appropriations for
implementation of capital improvements in the City of Miami; and
WHEREAS, said Ordinance established appropriations for
Capital Improvement Project No. 353010, "Solid Waste Collection
Equipment - FY 190-9l'; and
WHEREAS, funds in the amount of $195,445.00 available in
the form of proceeds from Certificate of Participation Notes are
being decreased hereby; and
WHEREAS, these funds will be available for the necessary
purchase of approximately twenty-seven (27) motorcycles to ensure
continued productivity and functional needs of the City;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Section 1 of Ordinance No. 10642, the Capital
Improvement Appropriations Ordinance, adopted September 28, 1989,
as amended, is hereby amended in the following particulars: 1/
1/ Words and/or figures stricken through shall be deleted.
Underscored words and/or figures shall be added. The
remaining provisions are now in effect and ilamain unchanged.
Asterisks indicate omitted and unchanged material. All
figures are rounded to the nearest hundred dollars.
"Section 1. The herein appropriations are
hereby made for implementation of all municipal
capital improvements of the City of Miami, including
new capital improvement projects scheduled to begin
during fiscal year 1989-1990. The herein
appropriations which are hereby designated by
reference to descriptive project title and number also
include appropriations for previously approved
scheduled projects as well as reappropriations of
prior fund appropriations. The source of revenues to
support the herein appropriations is hereby identified
by fund and project with the project appropriations
and revenues therefor being set forth for seven
program (I-VII) areas based upon use or functional
category within said areas, as follows:

Section 2. All ordinances, or parts of ordinances
insofar as they are inconsistent or in conflict with provisions
of this Ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety and propertly of the City of
Miami, and upon the further grounds of the necessity to make the
required and necessary payments to its employees and officers,
payment of its debts, necessary and required purchases of goods
and supplies, and to generally carry on the functions and duties
of municipal affairs.

Section 5. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 6. This Ordinance shall become effective 30 days
after final reading and adoption hereof.

ENCLOSURES:
It is respectfully recommended that the City Commission adopt the
attached emergency appropriation ordinance which will decrease
the appropriation of Capital Improvement Program (C.I.P.) Project
No. 353010 ("Solid Waste Collection Equipment - FY 190-FY 19111)
by the amount of $195,445, from the Certificate of Participation
(C.O.P.) Notes and increase the 1989-90 General Services
Administration Department, Fleet Management Division's Operations
Budget Account No. 420901-840, for the acquisition of twenty-
seven (27) police motorcycles and other light equipment.
Per the City Commission approval, given on May 24, 1990, to
purchase twenty-seven (27) motorcycles, the General Services
Administration Department (GSA) is proposing the utilization of
said C.O.P. funding currently appropriated for the acquisition of
Solid Waste equipment. Funds in the amount of $195,445 will be
appropriated to the GSA Account No. 420901-840 for the purchase
of twenty-seven (27) police motorcycles for the Police Department
and other light equipment.
This ordinance is being presented as an emergency ordinance to
adhere to the adopted replacement schedule outlined in Resolution
#89-794. Said acquisition will enhance the department's ability
to provide adequate service delivery and effectuate the
department's overall goal in providing service in an expeditious
manner.
