AN ORDINANCE AMENDING THE STONING ATLAS OF ORDINANCE NO. 11000 (EFFECTIVE SEPTMMIR 4, 1990) , THE NEW ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY APPLYING / SECTION 710, RC-1: GENERAL VON HERITAGE CONSERVATION OVERLAY DISTRICT TO THE MIAMI RIVER RAPIDS ARCHEOLOGICAL ZONE: APPROXIMATELY 2810-2916 NORTHWEST SOUTH RIVER DRIVE AND THAT SECTION OF THE NORTH FORK OF THE MIAMI RIVER LOCATED ALONG THE SOUTHEASTERLY PROPERTY LINE OF 1851 DELAWARE PARKWAY, MIAMI, FLORIDA (MORE PARTICULARLY DESCRIBED HEREIN); MAKING FINDINGS; INCORPORATING THE DESIGNATION REPORT; AND MAKING ALL NECESSARY CHANGES ON PAGE NUMBER 28 OF SAID ZONING ATLAS; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Miami River Rapids Archeological Zone contains the site of the original rapids of the north Fork of the Miami River, as well as the site of both a Tequesta oamp or village and the nineteenth century Ferguson mill and homestead; and WHEREAS, the Miami River Rapids Archeological Zone has been Included in the Future Land Use map series of the Miami Comprehensive Neighborhood Plan 1989-2000 as an archeological oonservation area; and WHEREAS, the herein provisions would make any excavation, filling, digging, tree removal, or any other ground disturbing activity on the subject property that may alter or reveal any interred archeological site subject to review by the Heritage Conservation Board; and WHEREAS, the herein designation would assure that adequate archeological investigations would be oonduoted prior to any olearing or development of the property; and WHEREAS, the Miami Heritage Conservation Board, at its meeting of January 16, 1990, following an advertised publio hearing, adopted Resolution No. HC 90-2, by a 7 to 0 vote, RECOMMENDING APPROVAL of the herein historical designation; and
