A RESOLUTION COMPUTING A PROPOSED MILLAGE RATE FOR THE CITY OF MIAMI, FLORIDAt FOR THE FISCAL YEAR BEGINNING OCTOBER 11 1990 AND ENDING SEPTEMBER 300 1991; INSTRUCTING THE CITY MANAGER TO SUBMIT SAID PROPOSED MILLAGE RATE TO THE DADE COUNTY PROPERTY APPRAISER AND THE TAX COLLECTOR TOGETHER WITH THE DATE, TIME AND PLACE OF THE PUBLIC HEARING AT WHICH _ 3� THE CITY COMMISSION WILL CONSIDER THE PROPOSED MILLAGE RATE AND THE CITY`S TENTATIVE BUDGET FOR SAID FISCAL YEAR. WHEREAS, the State Legislature has enacted H8-4D, entitled "Truth in Millage" (TRIM Bill), which requires municipalities to compute a proposed millage rate; and WHEREAS, said law stipulates that said proposed millage rate be submitted to the Property Appraiser and the Tax Collector; and WHEREAS, said rate will reflect the levy necessary to fund the City's tentative budget other than the portion of the budget to be funded from sources other than ad valorem taxes; and WHEREAS, the proposed millage rate submitted to the Property Appraiser is not binding but is necessary for the purpose of preparation of tax notices; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Prior to the conclusion of the initial public hearing, the date you have scheduled, you shall amend the tentative budget as you see fit and adopt the same. If appropriatew you shall also recompute the proposed millage rate and publicly announce the percent, if any, by which the recomputed proposed millage rate exceeds the rolled -back rate. NOTE: "Rolled -back rate" is "a millage rate which, exclusive of new construction, additions to structures, deletions, and property added due to geographic boundary changes, will provide the same ad valorem tax revenue for each taxing authority as was levied during the prior year." Within 15 days of the Meeting at which you shall have adopted the tentative budget (see Paragraph 1 above), you must advertise notice of a public hearing to finalize the City's budget and adopt the millage rate to support said budget. NOTE: This final budget hearing has to be held not less than 2 days or more than 5 days after the day that the advertisement is first published. [F.S. 200.065(2)(d)) 3. Because of the succinct statutory language governing -the conduct of the initial and the final public hearings to be held by you, we are setting out that subsection verbatim: 90- 581 90- .�f Honorable Mayor and Members July 26t 1990 of the City Commission Page #�L Owl. in the hearings required pursuant to paragraphs (c) and (d), the first substantive issue discussed shall be the percentage increase in millage over the rolled -back rate necessary to fund the budget, if anyt and the specific purposes for -_ which ad valorem tax revenues are being increased. During such discussion, the governing body shall hear comments regarding the proposed increase and explain the reasons for the proposed increase over the rolled - back rate. The general public shall be allowed to speak and to ask questions prior to adoption of any measures by the governing body. The governing body shall adopt its tentative or final millage rate prior to adopting its tentative or final budget. 4. Within 3 days of your adoption of the final millage and budget, the millage-levy resolution is submitted to the County Property Appraiser, Tax Collector, and the Florida Department of Revenue. This submission is required to be _ made no later than October 10. He includes said rate plus the details on the initial public hearing in a mailed notice to property owners. This mailing must occur not later than August 24th [F.S. 200.069, F.S. 2O0.065(2)(b)]. We have been informed of the following in regard to this subject: (a) the Dade County School Board has already held its first (of two) required public hearing and has scheduled its second public hearing on September 5th (Wednesday); and (b) the Dade County Comni.ssion will hold its tw�ippuubltic ic hearings on September 6th (Thursday) and September epteer 18th (Tuesday) . above dates established (in (a) and (b)), the City cannot hold its required public hearings on those dates (Wednesday, S%"rber 5th; nursdayit 6th, and Tuesday, September 18th) because of the statutory p of said in F.S. 200.065: more particularly, Subparagraph 2 in Para 2)(e ) section. Upon a further review of the statutory provisions, we have modified the language for the resolution appearing before you on to orrow's Meeting Agenda (Item #8). The resolution form which now also provides for your scheduling I of the first public hearing after 5:00 p.M.), pursuant to the requirement of Paragraph (2)(b) of F.S. 200.065, is attached for substitution. Alsof the word "establishing" has been changed to ,computing" for literal exactness as provided in Subparagraph 1 of Paragraph (2)(a) of said section.
