AN ORDINANCE CONCERNING FEES FOR CITY
SERVICES BY AMENDING SECTION 2-75 OF THE CODE
OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TO
INCREASE FEES FOR ANNUAL REINSPECTION OF
BUILDINGS AND PREMISES, SAID INCREASES BEING
NECESSARY TO COVER INCREASES IN OPERATIONAL
COST; ALSO PROVIDING THAT SAID FEES MAY BE
INCREASED WHEN NECESSARY TO COVER THE COST OF
SAID REINSPECTIONS; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City Manager recommends that in order to perform
needed services for the operation of the City of Miami that fees
be increased and redefined to cover the inbrease in operational
costs;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Section 2-75 of the Code of the City of
Miami, Florida, as amended, is hereby amended in the following
particulars:l/
"Sec. 2-75. Zoning certificate of use required;
annual reinspection of buildings and
premises; fees for inspections and
issuance of certificates.
(C) Annual -lEjainspection of Buildings and Premises:
(1) Annual �reinspection certificates will be issued,
and each existing use and/or premises shall be
inspected annually to determine that it complies with
the provisions of applicable ordinances and
regulations.

are to be increased, the City Manager shall file a list
of the new charges which shall become effective no

Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this'Ordinance are hereby repealed.
Section 3. If any section, or part of this section,
paragraph, clause, phrase or word of this Ordinance is declared
invalid, the remaining provisions of this Ordinance shall not be
affected.
Section 4. This Ordinance shall become effective 30

days after final reading and adoption thereof.

The City of Miami has been experiencing rising costs in all
areas of operations. The City, to a large extent, has been
subsidizing these cost increases. One of these areas is that of
Certificate of Use and Certificate of Use Renewals. The costs
include those of the Fire Rescue Department.
Fees have not been increased over the past two years. In order
to cover the costs of providing this service, effective on
January 1, 1994, fees will be increased. Enclosed is the new
schedule of renewal fees reflecting the increases as permitted
by Ordinance number 10766.

with ordinance Number 10766.
According to ordinance .Number 10766, passed on July 12, 1990,
regarding Fire Department Fees, there is a provision (Section 1
part G) stating:

It is respectfully recommended that the amendment of inspection
and reinspection fees for buildings and plans be amended to
reflect an increase in the cost of providing these services.

The Department of Budget has completed cost analysis and
comparative studies with regard to other cities and their charges
for these services. The City is providing the same level of
services as any other municipality at a rate that has steadily
increased, however, have not passed on those increasing costs to
the users of these services. This amendment will still keep in
the City's responsibility of maintaining an equitable fee
structure.

of the Emergency Medical Transportation Services of the
Fire, Rescue and Inspection Services Department. Said fees

BUILDINGS AND PREMISES, SAID INCREASES HEING
NECESSARY TO COVER INCREASES IN OPERATIONAL
