DISCUSSION:
This item is being presented at the request of Mayor Xavier L. Suarez, Chairman,
Wynwood Safe Neighborhood Improvement District (Wynwood SNID), and William Ms.
Executive Director, Wynwood Community Economic Development Corporation (Consultant
to" the WSNID), for clarification and explanation of the Florida Department of

Community Affairs requirements for the expenditure of the Enterprise 1ont, Safe

Neighborhood Capital ` Improvement project funded by the Florida Legislature, per
Section 163.5210 F.S. (See attachment A)
BACKGkOUND:
y
Based on the approved Wynwood Safe Neighborhood Improvement District Plan,' the
Florida Legislature has appropriated approximately $100,000 to the Wynwood Safe
—
Neighborhood Improvement District to fund capital improvements. The Department of
i-
-
Community 'Affairs has requested that the City (Wynwood SNID) submit a project
-
timetable, scope of -work, budget, and budget modification to facilitate the
preparation of a contract with DCA per the special Legislative Appropriation (see
attachment'!B). The City defines a "Capital Improvement" as a capital or "in -kind"
-
expenditure 'of $5,000 or more, resulting in the acquisition, improvement or
—
addition to fixed assets in the form of land, buildings or improvements, more or
less permanent in character, and durable equipment, with a life expectancy of at
least three years. it is the City Administration's intent to utilize those funds
to implement the street improvements i.e., street closures, security gates, etc.,
detailed in the Plan.
The WCEDC is requesting that the special legislative appropriation be used to fund

the submission of the Wynwood Foreign Trade Zone Application to the Foreign Trade
Zone Board of the U.S. Department of Commerce. The WCEDC, through Senator: Jack
k+
Gordon, --believes the legislative intent allows the funds to be used. for: soft
costs`, i.e.`, Foreign Trade Zone application fees (see attachment C).
However, even though the City Administration is supportive of WCEDC efforts to:

complete a Foreign Trade Zone application, the City Administration in consultation
with DCA, affirms that the funds can only be used for those improvements which are
-of
eligible per Section 163.521, F.S., e.g. engineering and construction `street
closures, security gates, etc.; and that the City lacks the authority to
unilaterally change the use of State funds approved by State legislation unless;
otherwise,authorized by DCA.

agreement between the Wynwood SNID and WCCDC to prepare a safe Neighborhood
ImorovemoAt Plan for the Wynwood SNID, in the amount of $250,D0o, and on April 96#
19900 the City Commission approved a professional services agreement between the
City and the Wynwood SNID Partnership in the amount of $30,000 for technical
assistance in the preparation of the Safe Neighborhood Plan,
The Safe Neighborhood Plan was prepared for the Wynwood Safe Neighborhood District
(Wynwood SNID) for the coordinated, balanced, and harmonious development of the
Wynwood SNID and designed through the use of Crime Prevention Through
Environmental Design (CPTCD) techniques to effectively change the physical
environment and reduce the perception, incidence and fear of crime in the area.
The area is bounded by N.W. 36th Street, N.C. 21st Terrace and N.W. 22nd Street,
North Miami Avenue, and N.W. 6th Avenue, containing approximately 368 acres.
on July 26, 1990, through Resolution No. 90-634, the City Commission approved the
Wynwood Safe Neighborhood Improvement District (Wynwood SNID) Board's adopted Safe
Neighborhood Improvement Plan, finding that there was no need to amend the Miami
Comprehensive Neighborhood Plan 1989-2000 for the inclusion of the Wynwood Safe
Neighborhood Improvement District Plan, per section 163.516(8) F.S.
The Wynwood Safe Neighborhood Plan determined that the most effective means to
reduce the incidence of crime, and change the physical environment, was to provide
a mechanism to increase employment and develop a secure facility. The Plan
proposes the establishment of a Mynwood Foreign Trade Zone (WFU) at N.W. 5th
Avenue and N.W. 22nd Street to ac-c—omi-plisn the dual goal oT increasing employment
and reducing crime. The Wynwood Foreign Trade Zone is totally contained within
the Wynwood Safe Neighborhood Improvement District. The Plan also recommends,
although it is not limited to, the following:
Controlled access to the WFTZ. Northwest 5th Avenue
should terminate with a cul-de-sac at N.M. 22 Street.
o The ending of N.M. 23rd and N.W. 24th Streets at N.M. 6th
Avenue.
The establishment of security gates at N.M. 24th, 26th,
27th and 28th Streets that would allow controlled access
from N.M. 6th Avenue.
At the request of the Wynwood SNID Advisory Board to expedite the implementation
of the Plan, the City Commission, through Resolution No. 90-546, approved the
permanent prohibition of vehicular access to the streets mentioned above. The
total estimated costs for these improvements are approximately $108,000. (See
attachment 0)
The City Commission (Wynwood SNID Board), transmitted the Wynwood Safe
Neighborhood Improvement District Plan, which included a budget request to fund
the implementation of the Capital Improvements recommended in the Plan, per
Section 163.521, F.S., to the Florida Department of Community Affairs (DCA) for
its review and approval.

Legislative Appropriation. I have also enclosed completed sam-
ples of these forms for your reference. You will need to com-

Foreign Trade Zone Area site plans and possible street closure
locations and offer the following comments and cost estimates.
The proposed site plan Indicates that several streets wlII be
closed and vacated so that new buildings and parking structures
can be constructed on the vacated right of way. These streets
Include N.W. 22 Street from N.W. 5 Avenue to 150 feet west of
N.W. 5 Avenue, N.W. 22 Terrace from N.W. 2 Avenue to N.W. 3
Court, N.W. 22 Lane from N.W. 2 Avenue to N.W. 5 Avenue, N.W. 3
Court from N.W. 22 Street to N.W. 22 Lane and several _public
alleys. In order to accomplish the proposed development, the
property must be repiatted to officially close and vacate these
rights of way. The replatting process, will include public
hearings before the C i ty ' s Zoning Hoard and, the City: Comt I ss Ion
and w I I I most I1keIy Include some ..Improvements to the streets
abutting the subdivislon. Please refer to City Code Chapter 54 5
for detailed requirements for closing and vacating=public
right of way. The replatting process will Incur additional

This estimate Is for roadway and drainage construction only and
does not include the cost of any proposed security walls
surrounding the project site. If the site plan remains the same
and a cul-de-sac is required on N.W. 22 Street, then.,this
estimate will be comparable to the cuI -de-sac on N.W. 5 Avenue.
The "vehicular access restrictions" requested on N.W. 23 and 24
Streets at N.W. 6 Avenue would be similar to those constructed; In
the "Belle Meade" neighborhood of the City of Miami. The
estimated costs of these barricades are $12,000.00 per
Intersection, for a total cost of $24.000.00. This price,:`
Includes landscaping and allowance for overland drainage.
The "vehicular access restrictions" requested on N.W. 26, 27 and
28 Streets at N.W. 6 Avenue consist of security gates to control,
access from N.W. 6 Avenue. These unmanned gates were originally
proposed for use in the "Say Heights" neighborhood of the City of
Miami and are estimated to cost $11,000.00 per Intersection, for,`}
a.total cost of $33,000.00. These gates will require scheduled
and emergency maintenance.
