A RESOLUTION AUTHORIZING THS LAW FIRM OF
HOLLAND & KNIGHT TO PROVIDE A FORMAL WRITTEN
BOND COUNSEL OPINION ON THE IE3UE OF WHETHER

THE CITY MAY IMPOSE A FEE OR CHARGE ON THE }-
GROSS INCOME GENERATED BY THE USE OF OFF-
STREET PARKING DEPARTMENT'S PARKING METERS—
WITH SAID. MONIES TO BE PAID DIRECTLY TO THE
CITY ON AN ANNUAL BASIS, WITH THE COST OF -_
SAID LEGAL SERVICES NOT TO EXCEED THE SUM OF
$3,000.00 BEING ALLOCATED FROM FY '90-91
BUDGETED FUNDS, SPECIAL PROGRAMS AND
ACCOUNTS,
WHEREAS, the City Commission has requested the City
Attorney's Office to render a legal opinion on whether the City �-
Commission may impose a fee or charge on the gross income

generated by the use of Off -Street Parking Department's parking
meters; and
WHEREAS, the City Attorney has determined that the answer to -
such question necessarily involves a review of the City Carter
and of the outstanding trust indentures and other relevant bond
instruments governing revenue generated by the Department of Off -
— Street Parking, thereby requiring a formal written bond counsel

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The appointment of the Law Firm of

Holland & Knight to render a formal written bond counsel opinion
in connection with the question of whether the City may impose a
fee or other form of charge on the gross income generated by the
use of Off -Street Parking Department's parking meters with said

monies to be paid directly to the City on an annual basis, is
hereby authorized, with fees for said services not to exceed
