A RESOLUTION BY AN AFFIRMATIVE VOTE OF 4/5THS
VOTE OF THE MEMBERS OF THE CITY COMMISSION
WAIVING FORMAL COMPETITIVE SEALED BID
PROCEDURES FOR THE REQUIRED SERVICESi
EQUIPMENT, GOODS AND/OR MATERIALS FOR THE
GENERAL ANTONIO MACEO PARR DEVELOPMENT
PROJECT - PHASE II; RATIFYING, APPROVING AND
CONFIRMING THE CITY MANAGER'S FINDING THAT A
VALID PUBLIC EMERGENCY EXISTS JUSTIFYING SUCH
WAIVER FOR SAID PROJECT; AUTHORIZING THE CITY
MANAGER TO ACCEPT THE LOWEST RESPONSIVE AND
RESPONSIBLE BID(S) FOR NECESSARY
IMPROVEMENTS, SERVICES, EQUIPMENT, GOODS
AND/OR MATERIALS FOR SAID PROJECT; ALLOCATING
FUNDS THEREFOR IN AN AMOUNT NOT TO EXCEED
$255,000 FROM THE CAPITAL IMPROVEMENT PROJECT
OF THE SAME NAME, PROJECT NO. 331354; FURTHER
AUTHORIZING THE CITY MANAGER TO EXECUTE
AND/OR ISSUE THE NECESSARY DOCUMENTS, IN A
FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH
THE SUCCESSFUL BIDDER(S).
' WHEREAS, the City Manager has made a written finding that

the continued development (Phase II) of General Antonio Maceo
Park constitutes a valid public emergency which requires the
immediate procurement of the required services, material, goods
and/or equipment to protect the health, safety and welfare of
residents and for the convenience of the City; and
WHEREAS, the nature of said valid public emergency is based
on the -community's need for waterfront recreational facilities
and upon State grant requirements that these additional
_j recreational facilities be completed no later than
December 31, 1990; and
WHEREAS, plans and specifications for Phase II of the

Project have been prepared by professional staff of the Public
Works Department with assistance from the General Antonio Maceo
Foundation and input from the community; and
WHEREAS, Phase II of the project will include additional
shoreline stabilization, demolition, floating docks, a waterside
promenade, site furnishings, a playground, walkways, irrigation,
landscaping and site lighting; and -_

WHEREAS, the City Manager and Directors of the Departt"nts
of Public Works and Parke and Recreation recolftond that Itifotmal'
bid procedures be utilised to procure the needed services,
equipment goods and/or materials for said project; and
WHEREAS, after receipt of informal bids,, conttacts'for said
services,, equipment, goods and/or materials will be awarded to
the lowest responsive and responsible bidder(s) by the City
Manager; and
WHEREAS, Ordinance No. 10671 adopted November 30,,'. 1989f
established the General Antonio Maceo Park Development Project
(No. 331354) within the City Capital Improvement Program and
appropriated $470,000 for said Project, of which $255,000 will be
utilized for Phase II; and
WHEREAS,, the herein resolution has been the subject of a
properly advertised public hearing before the City Commission;
NOWj, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMIr FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby incorporated by reference
thereto and adopted as if fully set forth in this Section.
Section 2. The City Manager's finding that a valid
public emergency exists justifying the waiver of formal
competitive sealed bid procedures for the General Antonio Maceo,
Park Project Phase II is hereby ratified, approved and
confirmed.
Section 3. By an affirmative vote of 4/5ths of the
members of the City Commission,, formal competitive sealed bid
procedures for the procurement of services, equipment, goods,
and/or materials for the construction of improvemento for the
General Antonio Maceo Park Project Phase rl are hereby waived.

accept the lowest responsive and responsible bid(d) for necessary
services, equipment, goods and/or materials for said Project,
with funds therefor hereby allocated in an amount not to exceed
$255,000 from the General Antonio Maceo Park Project, CIP Project
No. 331354.

This memorandum serves as the written finding of a valid public
-emergency for the General Antonio Maceo Park Developneat`-
Project - Phase 11. This finding is based upon the following: -
* The Maceo Park, located on the inland waterway known as Blue'
Lagoon, is a vital recreational resource that the -dity.
acquired with State and Federal assistance for the benefit of>
its citizens and visitors.
* Initial development of the park is in progress of Phase I of.;
the Project, but serious delays have been encountered in the
design and programming for Phase 11.
* The State of Florida, Department of Natural Resources,:"sliieh;

construction of Phase II be completed by December 31, 1�#
or the City may be required to return said funding.
